CITY OF KITCHENER
Heritage Kitchener met this date, chaired by Councillor M. Galloway, commencing at 4:15 p.m., with the
following members present: Ms. J. Armstrong, Ms. D. Kuehl and Messrs., Z. Janecki, E. Lucy and M.
Stranz.
As a quorum of the Committee was not in attendance, Councillor Galloway suggested the meeting
proceed, and stated Council will be advised that any recommendations forwarded to them from this
meeting were voted on without benefit of a quorum.
HERITAGE PERMIT APPLICATIONS 2003-V-18, 9 OAK STREET - VICTORIA PARK AREA
HERITAGE CONSERVATION DISTRICT DEMOLISH EXISTING GARAGE AND
CONSTRUCTION OF NEW DETACHED GARAGE
The Committee was in receipt of Development and Technical Services Department report DTS-
03-104, dated May 28, 2003, with respect to Heritage Permit Application 2003-V-18, for the
property municipally known as 9 Oak Street, located in the Victoria Park Area Heritage
Conservation District. A copy of the Heritage Permit Application and accompanying drawings
were attached to the staff report.
Mr. Stojcic, property owner, was in attendance.
Mr. Bensanson displayed images of the subject property, noting that the property owner has
revised his request since he last applied: the proposed garage is 2 feet wider than the existing,
10 feet longer, but no closer to the street, and will be 20 centimetres higher. The applicant
proposes to face the front and east elevations with brick, and the other two elevations will be
painted to match the brick. He advised that staff recommend approval of this application.
On motion by Mr. Z. Janecki
it was resolved:
"That Heritage Permit Application 2003-V-18 (9 Oak Street - Victoria Park Area Heritage
Conservation District) be approved, pursuant to Section 42 of the Ontario Heritage Act, to
permit the demolition of an existing garage and construction of a new detached garage, as
shown on the plans submitted with the application."
HERITAGE PERMIT APPLICATIONS 2003-1V-16 - 72 VICTORIA STREET SOUTH
INSTALLATION OF ROOTOP COMMUNICATIONS EQUIPMENT
The Committee was in receipt of Development and Technical Services Department report DTS-
03-103, dated May 28, 2003, with respect to Heritage Permit Application 2003-1V-16, for the
property municipally known as 72 Victoria Street South.
Mr. Bensanson advised that although the owners have objected to Council's Notice of Intention
to designate this property, it is protected under the Ontario Heritage Act as though it were
designated; consequently, this Heritage Permit Application has been submitted.
Ms. T. Kerbel and Mr. J. Kennedy, Telus Mobility, were in attendance in support of the
application. They provided in drawing form, 2 alternatives for the location of communication
equipment on the roof. One alternative shows the equipment within an enclosure, and the other
alternative is without an enclosure.
Mr. Bensason advised that staff recommended approval of alternative number one, which shows
the equipment on the roof without an enclosure.
The Committee commented on the location of the conduit on the outside of the building and
requested it be located on the side of the stairwell away from Joseph Street.

INSTALLATION OF ROOTOP COMMUNICATIONS EQUIPMENT (CONT'D)
On motion by Ms. D. Kuehl
it was resolved:
"That Heritage Permit Application 2003-1V-16 (72 Victoria Street South) be approved,
pursuant to Sections 30 and 33 of the Ontario Heritage Act, to permit the installation
of roof top communication equipment, shown as Alternative 1 on the plans submitted
June 10, 2003; subject to the following conditions:
(a) That staff evaluate this proposal in light of the City's new communications tower
policy; and,
(b) That the conduit and vertical flashing be located on the southerly side of the rear
stairwell, away from Joseph Street."
709 KING STREET EAST - LISTED ON HERITAGE INVENTORY - COMMENTS TO STAFF
RE: PROPOSED DEMOLITION
The Committee was in receipt of a memorandum from Mr. L. Bensason, dated May 29, 2003,
advising the Building Division has received an application for a Demolition Permit for the property
municipally known as 709 King Street East, which is listed on the Heritage Inventory.
Mr. T. Gallamor was in attendance to represent the property owner.
On motion by Ms. D. Kuehl
it was resolved:
That Heritage Kitchener recommends to City Staff that with respect to the Demolition
Application for 709 King Street East, the following take place prior to issuing the
Demolition Permit:
· Mr. T. Reitzel, Region of Waterloo, be requested to evaluate the building;
· the building be relocated;
· all efforts be made to salvage the building;
· if the building must be demolished, it be recorded and documented prior to demolition
DOORS OPEN WATERLOO REGION - REQUEST FOR VOLUNTEERS
Mr. Karl Kessler was in attendance on behalf of Doors Open Waterloo Region to request that
members of Heritage Kitchener volunteer for this event which will take place on September 20,
2003, from 10:00 a.m. to 4:00 p.m.
Mr. Z. Janecki volunteered to assist with this event.
The Committee Administrator was requested to notify other Heritage Kitchener Members of this
request for volunteers.
437 PIONEER TOWER ROAD - PROPOSED DESIGNATION & HERITAGE DESIGN
GUIDELINES FOR HISTORIC PIONEER TOWER WEST COMMUNITY
Mr. Z. Zanecki declared a pecuniary interest in this matter as he is employed by PEI
Consultants who represent the owner of 437 Pioneer Tower Road, and other properties in the
Pioneer Tower West Community, and did not participate in any discussion of voting with respect
to this matter.

GUIDELINES FOR HISTORIC PIONEER TOWER WEST COMMUNITY (CONT'D)
The Committee was in receipt of a memorandum from Mr. L. Bensanson, dated May 29, 2003,
providing background information and outlining how staff expects to meet the City's Heritage
Conservation objectives in Pioneer Tower West. In addition, copies of the draft Historic Pioneer
Tower West Community Heritage Design Guidelines were distributed at this meeting.
Mr. Janecki, on behalf of 346874 Ontario Ltd., one of the property owners in the Pioneer Tower
West area, advised the Committee that the owners are generally in support of the guidelines,
subject to a couple of changes, and an allowance for porches and balconies in order to maximize
the view of the river.
Mr. P. Puopolo, on behalf of one of the area property owners, was in attendance and advised that
the guidelines have been circulated to four construction companies who will build in this area,
and they are generally in support of the guidelines.
When questioned as to how these guidelines will be enforced, Mr. Bensanson advised they will
become part of the conditions of the subdivision agreement, and registered on title.
Mr. Bensason advised that a staff report recommending these guidelines will soon be submitted
to the Development and Technical Services Committee for their consideration.
With respect to the proposed designation of 437 Pioneer Tower Road, the Committee was in
receipt of a Heritage Property Report and draft Reasons for Designation were distributed at the
meeting. Messrs. Puopolo and Janecki, representing the property owner, were in attendance in
support of the designation. They advised that an addition on the left side of the house will be
removed, also a small building at the rear of the property, built 10 years ago, and a trailer on the
property, will not be designated.
Mr. Bensason showed images of the subject property and reviewed the Reasons for
Designation.
On motion by Ms. J. Armstrong
it was resolved:
"That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be directed to publish
a Notice of Intention to designate the property municipally known as 437 Pioneer Tower
Road as being of historic and architectural significance:
Historically, the property is part of the earliest (Spring 1800) inland non-native settlement
of what would become Waterloo County;
The built resources and land, and its historic association with the founding families of
Waterloo County are also of cultural heritage significance;
Architecturally, the Betzner farmhouse serves as an example of a Mennonite Georgian
residence, and the symmetrical proportions and base architectural features that identify
the farmhouse as a Mennonite Georgian structure are of significance. Specific features of
the proposed designation include all building elevations; the fieldstone foundation; roof
and roofline; return eaves; window and door openings, and 6 pane attic windows in gable
ends;
Specific features of the proposed designation of the driveshed include: all building
elevations; the fieldstone foundation; roof and roofline; window and door openings; door
hardware on north and west elevations; and the 6/6 windows."
120 WATER STREET SOUTH
Mr. Bensason advised that the anticipated Heritage Permit Application for 120 Water Street
South has not been received.

NEW BUSINESS
Mr. Bensason advised that Council approved the Demolition Control Application for 35 & 39
Weber Street East.
Mr. M. Stranz advised there will be a Downtown Advisory Committee tour of the Mayfair Hotel on
Thursday, June 12, 2003 at 3:30 p.m.
Mr. Bensason advised of his understanding that 1021 Doon Village Road has been sold to
people who want to live there, and work with the house.
381 Pioneer Tower Road
Mr. Bensason advised that at the August meeting, this Committee will be asked to recommend to
Council that the original Notice of Intention to Designate, published for 381 Pioneer Tower Road,
be withdrawn, and that a new Notice of Intention be published.
