HomeMy WebLinkAboutCouncil Minutes - 2003-09-08 SSPECIAL COUNCIL MINUTES SEPTEMBER 8, 2003 CITY OF KITCHENER A special meeting of City Council was held at 5:40 p.m. this date, Chaired by Mayor C. Zehr with all members present. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council was in receipt of Corporate Services Department report CRPS-03-160 (J. Koppeser), dated September 2, 2003, recommending no objection to a Provincial Lottery Licence being issued to Kitchener-Waterloo Oktoberfest to hold a gaming event from October 10 - 18, 2003. Moved by Councillor B. Vrbanovic Seconded by Councillor G. Lorentz "That the City of Kitchener has no objection to a Provincial Lottery Licence being issued to Kitchener-Waterloo Oktoberfest to hold a Fair or Exhibition Gaming Event from October 10 to 19, 2003, at Marshall Hall, Bingeman Park, 1380 Victoria Street North, Kitchener." Carried. Mayor C. Zehr advised of an additional item for in-camera discussion this date regarding a matter subject to solicitor-client privilege. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Smola "That an in-camera meeting of City Council be held immediately following this special meeting to consider a land acquisition / disposition matter and two matters subject to solicitor-client privilege." Carried. Mayor C. Zehr advised that Councillor B. Vrbanovic has requested that the special meeting of Council recess and re-convene following the Development and Technical Services Committee meeting to be held later this date. Councillor Vrbanovic explained that pending the outcome of the Development and Technical Services Committee meeting, he may wish to bring forward the recommendation with respect to Item 2 regarding traffic issues on Grand River Boulevard and Morrison Road. Council agreed to recess and re-convene the special Council meeting following the Development and Technical Services Committee meeting to be held later this date. Council was in receipt of Community Services Department report CSD-03-140 (F. Pizzuto), dated September 5, 2003, recommending the costs and operating incentives as discussed by Council at the August 25, 2003 Council meeting and, requesting that Council consider the construction of both retail wings. F. Pizzuto advised that at the Council meeting of August 25, 2003, Council considered and approved loan guarantees, operating incentives and additional budget requirements for the Market project. Council also directed staff to continue discussions with Barrel Works Inc. on the feasibility of both retail buildings being constructed at this time. F. Pizzuto advised that City staff have negotiated with Barrel Works Inc. with respect to the additional square footage of the New Market and is recommending compensation to the company in the amount of $500,000. He also advised that in these negotiations, Barrel Works Inc. has agreed to construct the second wing if the City would provide an additional loan guarantee of $750,000. Councillor J. Gazzola asked what the cost would be for remediation of the property should the second wing not be constructed at this time. F. Pizzuto answered that the costs, depending on whether it is a temporary or a permanent situation would be between $50,000. - $200,000. Mr. Andrew Lambden of Barrel Works Inc. was in attendance to advise that the shell of the retail wings would be substantially completed shortly after the Market but the interiors may take an additional 60-90 days depending on the leasehold improvements. With respect to the housing component, Mr. Lambden advised that the project would take approximately 9 months to construct and should be completed sometime early in 2005. Mayor C. Zehr advised that the proposal outlined in the report with respect to the loan guarantees and operating incentives would reduce the City's exposure and financial risk. Vrbanovic "That the City of Kitchener approve final negotiated square footage costs of $500,000. as approved in the Market Project budget on August 25, 2003; and, That the City approve construction of both retail buildings by Barrel Works and additional loan guarantees of $750,000.; and further, That operating incentives remain at $240,000. for both buildings combined, as approved on August 25, 2003, reducing the City's risk to operating guarantees. A recorded vote was requested and the motion was Carried, Unanimously. The meeting then recessed at 5:55 p.m. and re-convened at $:30 p.m., Chaired by Mayor C. 7ehr and with all members present. Mayor C. 7ehr advised of Councillor B. Vrbano¥ic's earlier request to have an item arising from the Development and Technical Services Committee meeting held earlier this date added to the special Council agenda. Moved by Councillor J. Smola Seconded by Councillor B. Vrbanovic "That pursuant to Chapter 25 of the Municipal Code (Council Procedure), the following matter be added to the agenda of the special meeting of Council on September $, 2003: consideration of a recommendation arising from the Development and Technical Services Committee meeting of this date regarding traffic issues on Grand River Boulevard and Morrison Road." Carried Unanimously. Council then considered a recommendation arising from the Development and Technical Services Committee meeting held this date with respect to Development and Technical Services Department report DTS-03-156 regarding traffic issues on Grand River Boulevard and Morrison Road. Moved by Councillor B. Vrbanovic Seconded by Councillor G. Lorentz "That the traffic study results outlined in Development and Technical Services Department report DTS-03-156 be forwarded to Waterloo Regional Police for enforcement of the speed limit; and, That two (2) temporary speed humps and temporary 40 km/h Speed Control signs be installed on Grand River Boulevard between River Road East and Morrison Road; and, That one (1) temporary speed hump and temporary 40 km/h Speed Control signs be installed on Morrison Road between Grand River Boulevard and Quinte Crescent; and further, That Transportation Planning continue to monitor this area with regards to speeding and vehicular volume." Moved by Councillor J. Smola Seconded by Councillor G. Lorentz Carried. Carried. "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2003-164 by the Clerk."
