HomeMy WebLinkAboutAdjustment - 2003-09-09 SG COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD SEPTEMBER 9, 2005 MEMBERS PRESENT: Messrs. S. Kay, B. Isaac, and D. Cybalski. OFFICIALS PRESENT: Mr. B. Sloan, Planner and Ms. D. Gilchrist, Acting Secretary-Treasurer. Mr. S. Kay, Chair, called this meeting to order at 10:30 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, September 29, 2003, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. Voisin Contra: None Public Submissions: None The Committee was advised that the applicant requests permission to erect 5 pylon signs with a height of 9.1 m (29.85 sq. ft.) rather than 7.5 m (24.6 ft.), an area of approximately 30 m2 2 (322.925 sq. ft.) rather than 20 m (215.28 sq. ft.), a clearance between the bottom of the sign and grade of 1.9 m (6.25 ft.) rather than 2.44 m (8 ft.), and permission for a portion of each sign to contain 3rd party advertising. The Committee noted correspondence from the Ministry of Transportation, dated August 29, 2003, in which they advised that they do not anticipate a problem with the highway system as a result of this application. Further, they advise that all signs within 400 m of the highway and visible to the highway require a permit. The Committee noted the comments of the Development and Technical Services Department, dated September 3, 2003, in which they advised that staff have calculated the sign area for each pylon sign to be 20 m2 which meets the sign by-law requirement; consequently, the variance for a sign area of 30 m2 is not required. Isaac That the application of Voisin Developments Limited requesting permission to erect 5 pylon signs having a height of 9.1 m (29.85 ft.) rather than the permitted 7.5 m (24.6 ft.) a clearance between the bottom of the sign and grade of 1.9 m (6.25 ft.) rather than the required 2.44 m (8 rd ft.), and permission for a portion of each sign to contain 3 party, non-accessory advertising, on Part Lots 46 & 47, German Company Tract and Block 39, Registered Plan 1758, 1400 & 1450 Ottawa Street South, Kitchener, Ontario, BE APPROVED, subject to the following conditions: 1. That the applicant shall obtain sign permits for all 5 signs prior to them being erected. That the non-accessory (3rd party) advertising shall be limited to only those businesses operating in the Sunrise Shopping Centre. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property. Speers Contra: None Public Submissions: None The Committee was advised that the applicant requests permission to erect a pylon sign with the copy area located 1.52 m (5 ft.) above grade, and no clearance between the bottom of the copy area and grade rather than providing a clearance of 2.44 m (8 ft.). The Committee noted the comments of the Development and Technical Services Department, dated September 2, 2003, in which they recommend that the application as submitted be refused, based on visibility concerns for vehicles parked in close proximity to the sign. They also recommend two possible solutions to the visibility problem. Mr. Cluthe advised the Committee that the applicant wishes to amend the application to relocate the sign to a landscaped area, in order to alleviate the visibility problem. The Committee generally agreed to defer consideration of this application to the September 30, 2003 meeting. Mr. Cluthe was directed to provide the Secretary-Treasurer with a revised site plan showing the new location of the sign, which is to be distributed to the public agencies for comment.
