OCTOBER 4, 2011 CITY OF KITCHENER
The Heritage Kitchener Committee met this date, commencing at 4:05 p.m.

- 117 KING STREET WEST
- PROPOSED FAÇADE ALTERATIONS AND CLEANING
The Committee considered Community Services Department report CSD-11-137, dated
September 22, 2011, recommending approval of Heritage Permit Application 2011-IV-019,
proposing alterations and cleaning of the façade at 117 King Street West. Ms. M. Drake
reviewed the report, advising that staff have requested that further details be provided on the
method of cleaning the granite façade, prior to the issuance of a building permit.
Messrs. Angelo Caranci, Bogdan Newman Caranci Inc. and Craig Beattie, Perimeter
Development addressed the Committee in support of the staff recommendation. In response
to questions, Mr. Beattie advised that the method that will be employed to clean the façade has
yet to be determined. He confirmed that given the depth of the units, the proposed alterations
would serve to maximize the amount of natural light entering the buildings. He noted that the
proposed work should not impede traffic along King Street.
Mr. J. Ariens suggested that when applying for their building permit, the Applicants should
explore the possibility of attaining a Façade Improvement Grant for the proposed work. Mr.
Beattie noted that 117 King Street West recently received an Economic Development Façade
Improvement Grant, adding that it was unlikely that they would be awarded further funding so
soon after receiving that grant.
On motion by Councillor F. Etherington -
it was resolved:
“That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application
HPA 2011-IV-019, be approved to permit alterations to the façade and cleaning of the
granite at 117 King Street West, in accordance with the plans submitted with the
application, subject to the following conditions:
i) That the details regarding the proposed method of cleaning be submitted,
reviewed and cleared by Heritage Planning staff prior to the issuance of a
building permit; and further,
ii) That the final building permit drawings be submitted and approved by Heritage
Planning staff prior to the issuance of a building permit.”

- PROPOSED ALTERATIONS TO VICTORIA PARK
- VICTORIA PARK LAKE IMPROVEMENTS PROJECT
The Committee considered Community Services Department report CSD-11-132, dated
September 16, 2011, recommending approval of Heritage Permit Application 2011-V-018,
which proposes alterations to Victoria Park as part of the Victoria Park Lake Improvements
Project. Ms. M. Drake reviewed the report.
Ms. M. Ryan reviewed the alterations that are proposed for Victoria Park as part of HPA 2011-
V-018. She advised that the Victoria Park Heritage Conservation District Plan comprises two
components, voluntary guidelines and compulsory policies. She stated that work on landscape
related features of the Park is subject to the District Plan guidelines, and compliance is
determined by Heritage Planning staff. She added that policy related work requires formal

approval under the Ontario Heritage Act through the Heritage Permit Application process. She
indicated the following work as being pursued as part of HPA 2011-V-018:
Repair of Roos Island Bridge Piers/Abutments;
Introduction of a New Pedestrian Bridge;
Replacement of Boathouse Dock/Patio;
Decommissioning of Pump Station and Associated Weir;
Outlet Reconfiguration; and,
Removal of Flagpole.
Ms. Ryan advised that minor modifications are being put forward to some design elements.
She stated that from a geotechnical standpoint it was determined that the shoreline retaining
wall required more support, so additional precast concrete blocks were included in the design.
She indicated that the concrete blocks would be below the waterline and therefore not visible
to someone standing on shore. In addition, to mitigate the impact this may have on
surrounding tree roots, the retaining wall will be constructed in front of the existing gabion
baskets. She advised that a further revision relates to the size of the Boathouse Dock/Patio’s
retaining wall, which has been increased and additional vertical bars have been added to hand
rail for improved safety. She then reviewed the project schedule and noticed that it is their
intent to begin construction by the end of November 2011.
Questions were raised regarding the proposed tree removal. Ms. Ryan advised that during the
design process, considerable effort was expended to protect as many of the existing trees as
possible. She stated that out of the 420 trees surveyed, 42 will be removed during construction
due to poor health, safety hazards, or because they will be significantly impacted by
construction. She noted that additional trees will be planted as a part of the restoration work
around the Lake.
Councillor Y. Fernandes suggested that in addition to native species, staff should consider
using trees that would have been planted when Victoria Park was originally constructed; such
as Black Walnut trees.
Concerns were raised with respect to the use of the Boathouse Patio, and Ms. Ryan advised
that the Boardwalk and Patio are currently proposed to be separated by a raised planter bed.
She stated that staff are cognizant that some modifications may need to be made to the design
to accommodate the Patio being licensed by the Alcohol and Gaming Commission of Ontario
(AGCO). She noted that work on the Patio is not anticipated to begin until Spring 2012, which
should leave sufficient time to adjust the design.
Ms. E. Young stated that it was her understanding that part of the reason why people could no
longer skate on Victoria Park Lake was due in part to the warm water being discharged
through the pump house. She inquired into whether skating could be resumed as a result of
pump house being decommissioned. Ms. Ryan advised that it was unlikely that skating would
ever be resumed on Victoria Park Lake. She noted that given the constant flow of water into
the Lake, as well as unpredictable weather conditions each winter, with a tendency towards
warmer conditions, ice skating will not likely be possible.
In response to questions regarding the removal of the flagpole, Ms. Ryan stated that as an
engineered structure located in the middle of the Lake, the flagpole is visually and physically
conspicuous and might be considered disruptive to the aesthetic serenity. She added that the
flagpole is no longer being used for lighting or sound, and presents considerable maintenance
and operational challenges. She noted that the erection of a new flagpole in another location in
the Park may be investigated at a later date.
Councillor F. Etherington spoke in support of removing the flagpole and suggested that it could
possibly be re-located next to the statue of Queen Victoria.
On motion by Councillor Etherington, the recommendation contained in Report CSD-11-132
was brought forward for consideration.

Councillor Z. Janecki stated that even though the flagpole was installed in the 1950s and was
not original to the Park, in his opinion it is an important heritage feature of Victoria Park Lake.
A motion by Councillor Janecki was brought forward to amend the staff recommendation to

exclude the removal of the Victoria Park Lake flagpole, which was voted on and was .
On motion by Councillor F. Etherington -
it was resolved:
“That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA 2011-V-018, be approved to permit alterations to Victoria Park associated with the
Victoria Park Lake Improvements Project, in accordance with the plans and supporting
information submitted with the application.”

- NOTICE OF INTENT TO DEMOLISH 26 KING STREET EAST
Ms. M. Drake advised that that in accordance with Section 27.(3) of the Ontario Heritage Act,
an owner of a non-designated property of cultural heritage value or interest listed on the
Municipal Heritage Register (MHR) is required to provide written notice indicating their
intentions to demolish or remove said buildings. She stated that pursuant to this, on
September 13, 2011 the owner of 26 King Street East submitted a Notice of Intention to
Demolish that building, as a result of structural damage caused by a fire in March 2011. She
noted that 26 King Street East is one of five buildings that make up what is referred to as the
American Block, which were added to the MHR by Council on September 7, 2010. She added
that once a Notice of Intention to Demolish is submitted, Council has 60 days to consider
whether it will pursue designating the subject building under Part IV of the Ontario Heritage
Act. She noted that at the September 6, 2011 Heritage Kitchener meeting, the Committee
agreed with staff’s rationale for not pursuing the designation of either 24 or 26 King Street
East. She advised that staff anticipate presenting a report at the November 1, 2011 Heritage
Kitchener meeting, providing an update on the status of both buildings.

Ms. M. Drake reminded the Committee that the presentation of the 2011 Mike Wagner
Heritage Awards would be taking place on Wednesday, October 5, 2011 at Kitchener City Hall.
HOMER WATSON HOUSE AND GALLERY SUB-COMMITTEE

Councillor Y. Fernandes advised that she attended a meeting today with the Ontario Heritage
Trust, who are proposing amendments to the Heritage Conservation Easement Agreement for
the Homer Watson House and Gallery to include the Coach House and grounds as part of the
identified heritage attributes. She commented that one potential concern is that the addition of
the Coach House and grounds could potentially limit the future expansion plans being
considered by the Gallery. She noted that at the meeting it was suggested that Heritage
Kitchener form a Sub-Committee to examine this issue.
Ms. M. Drake advised that Heritage Planning staff would be involved with the Sub-Committee
to review this matter.
Mr. J. Ariens volunteered to participate on the Sub-Committee, and suggested that Ms. A. Oja
should be encouraged to also participate as she is the Heritage Kitchener representative for
the Upper Doon Heritage Conservation District.
Councillor Fernandes volunteered for the Sub-Committee and indicated that she would contact
Ms. A. Oja regarding her possible participation.
