That Demolition Control Application DC111121C/GS requesting permission to demolish a
single detached dwelling at 100 Cress Lane, owned by Shelane Properties Inc., be approved
without conditions.

BACKGROUND:
The Planning Division has received an application requesting the demolition of a single detached
dwelling located at 100 Cress Lane. The property is currently zoned as Heavy Industrial (M-4) and
designated as Heavy Industrial in the City's Official Plan (OP).
The Owner is applying for Demolition Control permission in order to prepare the site for the future
redevelopment of the property with an industrial use. The Owner has indicated that the existing
building is not habitable and is poor condition.
REPORT:
The property is currently zoned as Heavy Industrial Zone (M-4) and designated as Heavy Industrial
in the OP. The current zoning permits a dwelling unit only as an accessory use to another permitted
use on the property and does not permit single detached dwellings. The existing single detached
dwelling is legal non-conforming. The existing zoning and the surrounding land uses favour heavy
industrial uses rather than residential development.
Properties designated as Heavy Industrial is the OP allow for uses that are not permitted in other
industrial areas because they may be obnoxious due to vibration, noise, emission or odour. The OP
also states that areas identified as Heavy Industrial should be separated from residential areas due
to the possibility of adverse affects.
Internal Circulation Comments:
Preliminary circulation of the demolition control application was undertaken from August 12, 2011 to
September 9, 2011 to all applicable internal departments. All comments that were received from
internal departments are attached (Appendix B). There were no objections to the proposed
demolition.
Planning Analysis:
Staff are of the opinion that the proposed demolition is appropriate to implement the future
redevelopment of the property with an industrial use. The existing single detached dwelling is in
poor condition and has not been maintained for almost 40 years. The Heavy Industrial OP
designation and Heavy Industrial zoning support the redevelopment of the property with a more
compatible industrial use.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The proposed demolition is required prior to the redevelopment of the subject site and will align with
the Kitchener Strategic Plan as it ensures the implementation of the community priority
"Development'; with comprehensive redevelopment that is consistent with Provincial, Regional and
City planning policies.
FINANCIAL IMPLICATIONS:
No new or additional capital budget requests are expected with this recommendation.

COMMUNITY ENGAGMENT:
Preliminary circulation of the demolition control application was undertaken to all property owners
within 60 metres as no new residential development is proposed. No comments were received. All
property owners within 60 metres of the subject property will receive notice of the date of the
Committee meeting dealing with this demolition control application for information purposes.
CONCLUSION:
Planning staff have considered this application and are of the opinion that the proposed demolition is
justified as the removal of the existing single detached dwelling is required to redevelop the subject
lands with a more appropriate industrial use.

The following is a brief summary of the general conditions of the building.
Property Features:
Two storey house, approximately 1,30o SF, unfinished basement.
Evidence of previous garage which has been remo~red.
Property is serviced with water, hydro, and sanitary, no storm or gas at this time. There is likely a septic bed in
the rear yard, septic tank decommissioned when sanitary installed a few years ago.
House Description:
Single family dwelling
Rubble and field stone foundation with wood frame construction.
Exterior Conditions:
Exterior parged siding, soffit, and fascia in fair to poor condition
Roof is in goad condition, insulation collected for removal.
Front porch and addition over are in poor condition.
Interior Conditionsp
Forced air heating throughout, oil furnace removed, tank empty.
Electric hot water heater, newer.
® Kitchens, bathrooms, and finishes are approximately 4o years old and in need of replacement.
® Some evidence of settling in additions, brick foundations failing.

Averall Observations:
® The house appears to be about ~ oo years old and is generally in poor condition.
The house has not been maintained for over 4o years with the exception of a new roof. It is now in such a state
that major structural finishing work will be required.
®verall condition: Poor.
It is understood that the house in the current condition does not meet the needs of the owner. we understand that the
owner's intention is to demolish the existing house and redevelop the property for commercial use. The Building Division
has no objections to the demolition of this home. Please note that a demolition permit will be required, please contact

Any existing services to be capped at the owners expense, There are no curb and gutter or sidewalks
along the frontage of this property, sa there is no issue with redundant drive rays. Any new services
required must be applied for and paid for prior to the Building Permit being issued. Dan
