HomeMy WebLinkAboutINS-11-092 - Delegate Signing Authority for Gas Pipeline AgreemREPORT TO:Mayor and Members of Council DATE OF MEETING: October 24, 2011 SUBMITTED BY: Pauline Houston, Deputy CAO Infrastructure Services PREPARED BY: Sylvie Eastman, Utilities Engineer, 4178 WARD(S) INVOLVED: All DATE OF REPORT: October 21, 2011 REPORT NO.: INS–11-092 SUBJECT: COUNCIL DELEGATE SIGNING AUTHORITY TO THE MAYOR AND CLERK TO SIGN ANY FUTURE AGREEMENTS TO INSTALL GAS PIPELINES ON CITY EASEMENTS RECOMMENDATION: That the Mayor and Clerk be authorized to execute any documentation required to secure and/or release temporary and/or permanent easements required for the installation of gas pipelines; said documentation to be to the satisfaction of the City Solicitor. BACKGROUND: From time to time natural gas service can only be provided to a customer via gas pipeline on private property owned by another entity, either in a temporary location initially and then relocated or in a permanent location. REPORT: In order to utilize and or install a gas pipeline over other people’s property, the City requires either a temporary or permanent easement and the costs associated with same are paid by the customer benefitting from the arrangement. In the event the easement needs to be flexible to facilitate redevelopment of the property a supplemental agreement may be required to establish how the gas pipeline will be relocated to ensure continued service, which may then be followed by a replacement easement in due course. The temporary or permanent easement as well as any supplemental agreement pertaining to the arrangement will be reviewed by the City Solicitor prior to being presented for signature. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Customer Service – “Ensure service is delivered in an effective and cost efficient manner.” An easement is required to allow installation of the gas service. An agreement is required to ensure continued gas service in the event relocation of the gas pipeline is necessitated by redevelopment, and to identify how costs will be shared. Delegating signing authority to the Mayor and Clerk will expedite future installation of gas pipelines and provide timely service to customers. FINANCIAL IMPLICATIONS: None. COMMUNITY ENGAGEMENT: Not applicable. CONCLUSION: In order to ensure continued gas service to customers, it is necessary for the City to enter into these standard agreements. Delegating signing authority to the Mayor and Clerk will expedite installation of gas pipelines and provide timely service to customers.
