BACKGROUND: The Grand River Slope Stabilization project has been initiated to address slope stability and erosion issues on the bank of the Grand River, near the Chicopee Vale subdivision. Both the toe of the slope and the upper few metres of slope have experienced, and continue to experience active erosion. The conditions identified as influencing the slope stability are groundwater seepage onto the slope face, the discharge of surface water onto and over the slope area. This has caused steepening and erosion of the upper slope and the toe of the slope at the edge of the Grand River. In February of 2010, the City retained MTE Consultants Inc. to complete an Environmental Assessment (EA) Addendum, detailed design and contract administration for the Grand River Slope Stabilization project. The approved fees for MTE Consultants Inc. were $266,958.00 plus applicable taxes. On June 28, 2010, Council approved the EA for this project and directed staff to implement its recommendations. The project scope includes the installation of toe of slope protection, a groundwater collection system, a surface drainage system, a reinforced slope stabilization system, and trail works. On June 27, 2011, Council approved the tender to proceed with construction for $3,199,036.50 plus applicable taxes. The contractor started on August 15, 2011 and is expected to be completed in August, 2012. Total costs for this project are estimated at approximately $3,800,000 and were included in the 2011 capital forecast. Throughout the duration of this project the City has consulted with several regulatory agencies including the Grand River Conservation Authority (GRCA), Ministry of Natural Resources (MNR), Ministry of the Environment (MOE), and Department of Fisheries and Oceans (DFO). î ó ï REPORT: During the detailed design of the Grand River Slope Stabilization there have been changes to the engineering consultant’s scope of work due to an increase in the construction schedule and additional requests from regulatory agencies. MTE Consultants Inc. is requesting additional fees due to a change in the original scope of work. The reason for changes to the scope of work and associated costs are listed below: Item Description Additional Cost Additional work At the time the City hired MTE, it was not possible to $29,520 related to permits determine the extent of required permitting. In particular the MNR Endangered Species Act (ESA) permit. This is very involved and required several meetings and application submissions. Due to the length of time required to receive permit approval, it was necessary to revise the permit to specify a two year construction period instead of one. An addendum was also required during the tendering process to specify a two year construction period instead of one. Additional Working The project has been tendered with 105 working $11,600 Daysdays to complete the construction work compared to 70 working days of contract administration in the consultant’s original scope of work. The additional working days account for the complexity of construction which was determined during detailed design. A portion of the work does not require full time inspection. Total$50,860 FINANCIAL IMPLICATIONS: Funding will be provided from the Grand River Slope Stabilization account. There is currently a projected surplus in this account of approximately $1,588,000. Total consultant engineering fees for Grand River Slope Stabilization are estimated to be 9.9% of total construction cost. Fee increases are based on consultant’s unit pricing submitted at the time of consultant selection evaluation, and are therefore competitive in nature. î ó î CONCLUSION: Staff have reviewed the request and recommend that the existing purchase order to MTE Consultants Inc. be increased to complete the additional scope of work for this project.
