HomeMy WebLinkAboutFCS-11-216 - Liquor Licence Application - Da Vinci Caffe Bar, RStaff Re~p~r~ I~TCn~nT~~ Finance and Corporate Serlvices Department www.kitthenexca DATE OF REPORT: November 15, 2011 REPORT NO.: FCS-11-216 SUBJECT: Liquor Licence Application - Da Vinci Caffe Bar, Restaurant and Pizzeria - 21 Weber Street West RECOMMENDATION: That Condition #4 of the liquor licensing agreement entered into by The City of Kitchener and Dejan Kerkez owner of Da Vinci Caffe Bar, Restaurant and Pizzeria located at 21 Weber Street West be amended to allow the applicant to serve alcohol until 2:00 a.m. daily and further; That staff be directed to advise the Alcohol and Gaming Commission of Ontario (AGCO) that Condition #4 of the agreement has been amended and the City has no concerns with any corresponding condition on his liquor licence being amended accordingly. BACKGROUND: On August 29, 2011 a recommendation was approved by Council that they would take no action to oppose the application for a liquor licence for "Da Vinci Caffe Bar, Restaurant and Pizzeria located at 21 Weber Street West applied for by Dejan Kerkez. Mr. Kerkez entered into an agreement whereby he agreed to abide by several conditions. These conditions were also added to his liquor licence by the Alcohol and Gaming Commission of Ontario (AGCO). Condition #4 of the agreement requires Mr. Kerkez to stop serving alcohol by 12:01 a.m. daily in the first year of holding the liquor licence and thereafter to stop serving alcohol by 2:00 a.m. daily. This is a standard condition for any business that has no experience in the sale and serving of alcohol. REPORT: The City has received correspondence from Mr. Kerkez, owner of Da Vinci Caffe Bar, Restaurant and Pizzeria requesting that Condition #4 of the agreement be amended to permit the sale of alcohol until 2:00 a.m. daily. He is concerned that his inability to serve alcohol past 12:01 a.m. may cause a loss of customers and possibly his business as he has received several complaints from customers. Since the agreement was signed Mr. Kerkez has indicated to staff that he previously owned a restaurant in Buffalo, NY where he sold and served alcohol and is therefore familiar with the regulations regarding the sale and service of alcohol. 1- 1 Staff Re~p~r~ I~TCn~nT~~ Finance and Corporate Servvices Department www.kitthenexca The Alcohol and Gaming Commission of Ontario (AGCO) has requested a letter from the City advising that the City has no concerns with this condition being waived. The Liquor Licensing Review Committee (LLARC) have no concerns with this request because Mr. Kerkez has indicated that he has had experience owning and operating a restaurant that served alcohol in the past. There have been no complaints with this operation regarding the sale and service of alcohol. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Community Priority -Dynamic Downtown The Liquor Licence Review Committee is in place to review all establishments that propose to sell liquor in the Downtown Core. This allows Council to then review and provide comments regarding these establishments to the Alcohol and Gaming Commission of Ontario (AGCO) in order to continue to provide a safe and dynamic downtown core.
