Zehr and Members of Council DATE OF MEETING: November 28, 2011 SUBMITTED BY: Lesley MacDonald, City Solicitor and Director of Legal Services, (519)741-2267 PREPARED BY: Lesley MacDonald, City Solicitor and Director of Legal Services, (519)741-2267 WARD(S) INVOLVED: Ward 4 DATE OF REPORT: November 17, 2011 REPORT NO.: FCS-11-219 SUBJECT: REQUEST RE EXECUTION OF AN AGREEMENT REGARDING FIBRE OPTIC CABLE ACROSS HIGHWAY 401 PEDESTRIAN BRIDGE RECOMMENDATION: That the Mayor and Clerk be authorized to execute a Fibre Optic Installation Agreement with The Conestoga College Institute of Technology and Advanced Learning, The Corporation of the City of Cambridge and The Regional Municipality of Waterloo to acknowledge the responsibilities of Conestoga College with respect to its fibre optic conduit and cables running across the Highway 401 pedestrian bridge, said Agreement to be to the satisfaction of the City Solicitor. BACKGROUND: The City of Kitchener, the City of Cambridge and the Region of Waterloo entered into an Agreement in May, 2005 to assume responsibility for certain obligations with respect to the funding, construction and on-going maintenance of the pedestrian crossing bridge over Highway 401. REPORT: Conestoga College would like to construct, install, repair and maintain 60.3 mm steel conduit and communication cables across the Highway 401 pedestrian bridge in order to provide essential telecommunication and network infrastructure between its two main campuses located in the Cities of Kitchener and Cambridge. Accordingly, an Agreement is required between the Region and the Cities of Cambridge and Kitchener to identify Conestoga College’s responsibilities relating to the fibre optic cable crossing and to indemnify the three municipalities with respect to the said responsibilities. ï ó ï ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Not applicable. FINANCIAL IMPLICATIONS: Conestoga College is responsible for all costs associated with the conduit and cables. COMMUNITY ENGAGEMENT: Not applicable. CONCLUSION: It is appropriate for the Mayor and Clerk to execute the Agreement to facilitate the ongoing presence of Conestoga College’s fibre optic cable.
