HomeMy WebLinkAboutBy-law No. 2009-025 - Amend c110 - By-law Enforcement,~.: .~ BY-LAW NUMBER ~ ~~ ~' ~ (~~ OF THE CORPORATION OF THE CITY OF KITCHENER (Being a by-law to repeal and replace Chapter 554 of The City of Kitchener Municipal Code with respect to Lotteries.) The Council of the Corporation of The City of Kitchener enacts as follows: 1, In this By-law: (a} "City" shall mean The Corporation of the City of Kitchener; {b} "Council" means the Council of The Corporation of the City of Kitchener; {c) "Manager of Licensing" shall. mean the Manager of Licensing of The Corporation of the City of Kitchener; (d) "Order in Council" shall mean Order In Council Number 14'13108 made on August 12, 2008, by the Lieutenant Governor in Council under the Gaming Confrol Act, 1992, S.O. 1992, c.24. 2. The Manager of Licensing is appointed Lottery Licensing Officer for the City 3. The Lottery Licensing Officer shall receive applications, collect fees and make investigations on applications for lottery licences within the power of this Council. 4. If all information received by the Lottery Licensing Officer. on an application is favourable and helshe knows no reason why such application should not be granted, the proper fee having been paid, helshe shall issue a licence over hislher signature. 5. When all information on an application is not favourable or the Lottery Licensing Officer knows of .any reason why the licence should be refused, helshe may refuse the licence, subject to the right of the applicant to appeal to Council; or the Lottery Licensing Officer may refer the application to Council for direction. 6. In accordance with the Lottery Licensing .Policy Manual issued by the Alcohol and Gaming Commission of Ontario, the following lottery licensing fees shall be charged: Bazaar - $10.00 per wheel and 3% of the value of the prizes offered for a raffle or bingo event ~` ~_ ~~ Raffle - 3% of the total value of the prizes to be awarded Break Open Tickets - 3% of the total prize to be awarded Bingo -the annual rate set by the Manager of Licensing which shall not exceed $165.00 per event. 7. In no case shall any licence be issued for any lottery which would, notwithstanding such licence, be contrary to section 206, 207 or 208 of the Criminal Cade of Canada or to the Order in Council. 8. The City shall use such forms as may be prescribed or provided by the Registrar of the Alcohol and Gaming Commission of Ontario pursuant to section 13(e) of its Order in Council. 9. By-law 87-180, by-law 89-60, section 2 of by-law 92-264, by-law 200D-158 and the contents of Chapter 554 are hereby repealed. 10. The Clerk of the City is hereby directed to make this by-law a part of The City of Kitchener Municipal Code by adding it to the Concordance and arranging and numbering it as Chapter 554 so as to fit within the scheme of the Code.
