HomeMy WebLinkAboutFCS-12-009 - Liquor Licence Review Application - The Honest LawREPORT TO:Council DATE OF MEETING: January 16, 2012 SUBMITTED BY: Liquor Licensing Review Committee PREPARED BY: Patricia Harris, Manager of Licensing, 2854 WARD(S) INVOLVED: 9 DATE OF REPORT: January 10, 2012 REPORT NO.: FCS-12-009 SUBJECT: LIQUOR LICENCE REVIEW APPLICATION – THE HONEST LAWYER RESTAURANTAINMENT – 305 KING STREET WEST – ADDENDUM RECOMMENDATION: For Council’s information BACKGROUND: At the Finance and Corporate Services meeting of January 9, 2012 Report FCS-12-003 was presented to Council. After discussion, Council requested that further information be provided to them and the matter was deferred to the Council meeting of January 16, 2012. REPORT: As requested, the Waterloo Regional Police were contacted regarding this establishment. They have indicated that they would appreciate being contacted as part of the application review process. They commented that they felt that the patio would not create too many problems from a crowd management perspective, but the noise coming from any outdoor music would be the main problem. Council could consider a condition where no music (live or pre-recorded) could be played in the outdoor patio area after 11:00 p.m. However, soft pre-recorded and soft background live music could take place from 11 a.m. to 11:00 p.m. This condition was added to the licence of a current restaurant/bar located on King Street with a large patio area. Although, in some instances they were in agreement with requiring a paid duty officer for certain types of establishments such as night clubs, they were hesitant to require this type of a condition on a restaurant/bar. Historically, the condition of a paid duty officer has only been added to the liquor licences for the night clubs in the downtown core with a capacity of 600+ with a liquor to food ratio of over 70%. Further research indicated that this condition has not been requested by Council to be included on the liquor licence of any restaurant/bar in the downtown with a liquor to food ratio less than 70% since the process was put into place in 1999. The Liquor Licensing Inspector for this area was contacted and he indicated that this condition could be added to a liquor licence after there had been infractions or where the Registrar imposes it as a condition due to capacity levels. He also indicated that there were no major liquor licensing violations against this company in any of the locations that they are situated. The BIA contacted the management team of Eaton’s Lofts and they had no concerns with the opening of this establishment. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Community Priority – Dynamic Downtown The Liquor Licence Review Committee (LLARC) is in place to review all establishments that propose to sell liquor in the Downtown Core. This allows Council to then review and provide comments regarding the establishment to the Alcohol and Gaming Commission of Ontario (AGCO) in order to continue to provide a safe and dynamic downtown core. FINANCIAL IMPLICATIONS: None COMMUNITY ENGAGEMENT: Inform – A copy of the report will be provided to the Applicant prior to the Council meeting date. Consult – Property owners immediately adjacent to 305 King Street West were verbally consulted by the KDBIA and Downtown Development staff. No further concerns were noted. ACKNOWLEDGED BY: D.
