Goodeve, Committee Administrator CSD-12-006 -DEMOLITION CONTROL APPLICATION DC11/21/O/MV - 275 OLD HURON ROAD - WILL-O HOMES INC. The Committee considered Community Services Department report CSD-12-006, dated December 28, 2011 recommending approval of Demolition Control Application DC11/21/O/MV for the property municipally known as 275 Old Huron Road, subject to conditions. Councillor Y. Fernandes expressed concerns with the proposed demolition, stating that the existing single detached dwelling appears to in good condition and is in keeping with the other homes in the area. She suggested the developer be asked to incorporate it into the design of the stacked townhouse development, which has been proposed for the future use of the site. Ms. Kendra Murphy, GSP Group, was in attendance in support of the staff recommendation, advising that the location of the existing dwelling would impede future development as it would create access issues to the remainder of the property. She added that it would also disrupt the flow, scale and massing of the proposed stacked townhouses. She confirmed that the site plan for proposed redevelopment has yet to be finalized and an application was made to the City's Committee of Adjustment to reduce the rear and side yard setbacks. She estimated that the existing house was constructed circa 1970, adding that from the Applicant's perspective the proposed stacked townhouse development was the best fit for the site. Ms. D. Ross advised that staff examined the possibility of integrating the existing building and determined it could not be viably retained as a part of the proposed redevelopment. She acknowledged that the demolition control process was put in place to prevent the premature or unjustified removal of buildings. She stated that when processing this type of application, primary planning consideration is given to preserving the City's housing stock. She noted that in this regard, the existing single detached dwelling is proposed to be replaced by a 28-unit stacked townhouse development. On motion by Councillor S. Davey - itwas resolved: "That Demolition Control Application DC11/21/O/MV requesting permission to demolish one (1) single detached dwelling located at 275 Old Huron Road, owned by Will-O Homes Inc., be approved, subject to the following conditions: 1) That the owner obtains a building permit for the proposed residential dwelling unit; and further, That upon satisfaction of Condition 1, the Chief Building Official may authorize and issue a demolition permit under Section 33(6) of the Planning Act subject to the following condition: COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE CSD-12-006 -DEMOLITION CONTROL APPLICATION DC11/21/O/MV - 275 OLD HURON ROAD - WILL-O HOMES INC. (CONT'D) That in the event that construction of the new dwelling unit is not substantially complete within 2 years of the date of issuance of the demolition permit, the City Clerk may enter on the collector's roll, to be collected in like manner as municipal taxes, $20,000. for each dwelling unit contained in the residential properties in respect of which the demolition permit is issued and such sum shall, until the payment thereof, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued." CSD-12-007 -DEMOLITION CONTROL APPLICATION DC11/22/O/MV - 14 OLD COTTAGE PLACE - R & C BRITTAIN The Committee considered Community Services Department report CSD-12-007, dated December 28, 2011 recommending approval of Demolition Control Application DC11/22/O/MV for the property municipally known as 14 Old Cottage Place, subject to conditions. On motion by Councillor S. CSD-12-013 - WILLIAMSBURG CEMETERY AGREEMENT -SERBIAN SECTION The Committee considered Community Services Department report CSD-12-013, dated December 30, 2011 regarding an agreement with the Holy Trinity Serbian Orthodox Church Kitchener-Waterloo for a designated area at the Williamsburg Cemetery. In response to questions, Ms. T. Bradshaw confirmed that similar agreements are in place with other groups for use of designated lands within the City's cemeteries. On motion by Councillor S. Davey - itwas resolved: "That the Mayor and Clerk be authorized to execute an agreement, subject to the satisfaction of the City Solicitor, with the Holy Trinity Serbian Orthodox Church Kitchener-Waterloo respecting a designated area at the Williamsburg Cemetery with terms as outlined in Community Services Department report CSD-12-013; and, That the Manager of Cemeteries be authorized to sign amendments to the agreement with the Holy Trinity Serbian Orthodox Church Kitchener-Waterloo from time to time for the purpose of expanding the designated area at the Williamsburg Cemetery; and further, COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE CSD-12-013 - WILLIAMSBURG CEMETERY AGREEMENT -SERBIAN SECTION (CONT'D) That the Manager of Cemeteries be authorized to hold burial space in the Williamsburg Cemetery for reasonably foreseen expansion(s) of the designated area set out in the agreement with the Holy Trinity Serbian Orthodox Church Kitchener-Waterloo." INS-12-017 - TRAVELWISE TRANSPORTATION MANAGEMENT ASSOCIATION The Committee considered Infrastructure Services Department report INS-12-017, dated January 6, 2012 recommending that the City enter into a Travelwise Program Services Agreement to allow for membership in the Transportation Management Association (TMA) established by the Region of Waterloo. Clarification was requested as to the benefits that would be realized by virtue of entering into the Travelwise Program Services Agreement. Mr. J. McBride advised that the Travelwise TMA was created to assist large regionally based employers in providing Transportation Demand Management (TDM) services and programming. He stated that membership would allow the City to benefit from buying services in bulk and enable the establishment of a number of TDM programs. He confirmed that the annual cost to participate in the Travelwise TMA would be $4,500., noting that this includes enrolment in Carpoolzone, Guaranteed Ride Home as well as an enhanced Grand River Transit (GRT) Corporate Transit Pass program. He estimated it would cost the City approximately $10,000. if it were to independently pursue these initiatives. Councillor Y. Fernandes requested that regular updates be provided outlining the uptake by City staff in the services provided through the Travelwise TMA. Mr. McBride indicated that staff intends to present an annual report card on the uptake and successes of the TDM program. He confirmed that should the City not realize the anticipated benefits, it can withdraw from the Travelwise TMA at any time. On motion by Councillor S. Davey - itwas resolved: "That the Mayor and Clerk be authorized to execute the Travelwise Program Services Agreement, subject to the satisfaction of the City Solicitor, with the Region of Waterloo, the City of Cambridge, the City of Waterloo, Paradigm Transportation Solutions Limited, the University of Waterloo, Wilfrid Laurier University, Open Text Corporation, the Equitable Life Insurance Company of Canada, Hendry Coachlines Inc., Miller Thomson LLP and all other future Participating Organizations; and further, That the Mayor and Clerk be authorized to execute the Employers Acknowledgement regarding the Travelwise program, in a form satisfactory to the City Solicitor." CSD-12-018 - 2012 NEIGHBOURHOOD ASSOCIATIONS AFFILIATION RENEWAL The Committee considered Community Services Department report CSD-12-018, dated January 13, 2012 regarding the annual affiliation renewal of the City's 29 active Neighbourhood Associations. On motion by Councillor S. Davey - itwas resolved: "That the list of Neighbourhood Associations attached to Community Services Department report CSD-12-018, dated January 13, 2012, be approved for affiliation with the City of Kitchener for 2012." INS-12-018 - ON-STREET PARKING REGULATIONS - LIBERTY AVENUE The Committee considered Infrastructure Services Department report INS-12-018, dated January 18, 2012 recommending the implementation of a "No Parking" anytime regulation annually from January 1St to March 31St on the south side of Liberty Avenue. In addition, the COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE JANUARY 30. 2012 - 9 - CITY OF KITCHENER 6. INS-12-018 - ON-STREET PARKING REGULATIONS - LIBERTY AVENUE (CONT'D) Committee was in receipt this date of a survey conducted by Melanie LaFlamme of residents in the Liberty Avenue area, which suggested the proposed parking regulation should come into effect annually from October 1St to March 31St Ms. Melanie LaFlamme addressed the Committee, expressing concerns regarding the existing on-street parking issues faced by the residents of Liberty Avenue. She advised that the roadway is narrow and during winter months, the snow banks make two-way traffic difficult reducing emergency service vehicle access. She stated that the staff recommendation proposes a prohibition on parking from January 1St to March 31St and indicated this timeframe would not be sufficient to meet the needs of residents. She noted that her driveway is frequently blocked by illegally parked cars, most of which belong to patrons of the Kitchener Memorial Auditorium Complex (KMAC). Accordingly, she requested that the prohibition be extended to run annually from October 1St to March 31St, which would coincide with when the Kitchener Rangers play at the KMAC. In response to questions, Ms. LaFlamme estimated that the eight residents who completed her survey were probably the same eight residents who responded to the survey conducted by City staff. She stated that the City's survey only gave respondents the option to leave the on- street parking as it currently stands, or to have it prohibited annually from January to the end of March. She noted that everyone who responded to her survey was in favour of having the prohibition commence annually on October 1St Mr. J. McBride advised that the original request received by staff to prohibit parking on Liberty Avenue related to winter parking issues. He stated that accordingly, the timeframe being recommended by staff aligns with the City's existing winter parking regulations. He added that the proposed start date of October 1St would be inconsistent with the other parking regulations in that area. He suggested that a prohibition could be enacted now until the end of March, and a report could be brought forward prior to October 1, 2012 examining the implications of modifying the timeframe. Councillor D. Glenn-Graham indicated that he was satisfied with the information gathered by Ms. LaFlamme and expressed support for the proposed annual start date of October 1St. He suggested that no further staff examination was needed for this matter. On motion by Councillor D. Glenn-Graham - itwas resolved: "That the Uniform Traffic By-law be amended to prohibit on-street parking annually from October 1St to March 31St on the south side of Liberty Avenue from Pandora Avenue to Stirling Avenue North." CSD-12-003 -DEMOLITION CONTROL APPLICATION DC11/23/B/ATP - 184 BREITHAUPT STREET - THE ALLEN BUILDING INC. The Committee considered Community Services Department report CSD-12-003, dated January 19, 2012 recommending approval of Demolition Control Application DC11/23/B/ATP for the property municipally known as 184 Breithaupt Street, which is intended to be redevelop as a commercial parking facility. Councillor B. loannidis noted that while Mr. Bob Egan had registered to speak as a delegation on this issue, he instead submitted written comments which were circulated with the meeting agenda. Mr. John Alati addressed the Committee on behalf of the Applicant, advising that the owner of the subject property also owns the recently renovated building across the street at 108 Ahrens Street. He stated that 108 Ahrens Street does not have the capacity to meet the prescribed parking requirements on-site. Accordingly, it is proposed that the necessary parking spaces be accommodated at 184 Breithaupt Street. He added that the proposed redevelopment is supported by the surrounding neighbours. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE CSD-12-003 -DEMOLITION CONTROL APPLICATION DC11/23/B/ATP - 184 BREITHAUPT STREET - THE ALLEN BUILDING INC. (CONT'D) In response to questions, Mr. Alati indicated that issues relating to acceptable levels of lighting would be addressed as part of the site plan application process. He added that the Applicant would be amenable to installing achain-link fence, as requested by one of the adjacent property owners. He estimated that with the removal of the large accessory building previously located on-site and the proposed landscaping, the amount of impervious surface at 184 Breithaupt Street would decrease as a result of the redevelopment. On motion by Councillor D. Glenn-Graham - it was resolved: "That Demolition Control Application DC11/23/B/ATP requesting permission to demolish one (1) single detached dwelling located at 184 Breithaupt Street, owned by The Allen Building Inc., be approved without conditions." CSD-12-017 - 2011 ARTIST-IN-RESIDENCE COMMISSION AGREEMENT - ARTIST-IN-RESIDENCE SEAN PUCKETT The Committee considered Community Services Department report CSD-12-017, dated January 13, 2012 regarding the commission proposal submitted by the 2011 Artist-in- Residence, entitled "Portrait of Kitchener." Ms. C. York reviewed the staff report. On motion by Councillor J. Gazzola - itwas resolved: "That the commissioning and installation of art work by the City's 2011 Artist-in- Residence, Sean Puckett, be approved; and further, That the Mayor and Clerk be authorized to execute the Artist-in-Residence 2011 Commission Agreement with Sean Puckett in a form satisfactory to the City Solicitor, such agreement encompassing the terms set out in Community Services Department report CSD-12-017." INS-12-015 - 2012 TRAFFIC CALMING PRIORITY REPORT The Committee considered Infrastructure Services Department report INS-12-015, dated January 18, 2012 regarding the traffic calming reviews proposed for 2012. Mr. K. Carmichael reviewed the staff report. In response to questions, Mr. Carmichael confirmed that the $200,000. allocated for the traffic calming reviews would only be used to fund the installation of the recommended traffic calming measures. He advised that staff continue to monitor speeds, volumes and collisions on both warranted and unwarranted streets on an annual basis. He noted that any changes that are observed in traffic conditions are used to modify the rankings on the traffic calming priority lists. He acknowledged that Morrison Road and Guelph Street are ranked second and third respectively behind Alpine Road on the priority list of minor collector roadways. He stated that Alpine Road is not recommended for a review at this time as it primarily provides access to commercial and industrial sites, with limited residential frontage. He noted that while traffic volume on Morrison Road between King Street East and Grand River Boulevard is probably limited, to get a full understanding of the issues facing Morrison Road it was determined that the review should include the linkages to the nearest arterial roads. Questions were raised as to why traffic calming reviews have not been recommended for Pioneer Drive, Doon Village Road or Doon Mills Drive, given were those streets are ranked. Mr. Carmichael advised that while Glasgow Street is ranked below Pioneer Drive on the priority list, the results from its review will be incorporated into the roadway redesign scheduled for construction in 2013/2014. He added that consideration of traffic calming reviews for Doon Village Road and Doon Mills Drive have been put on hold pending a determination as to the impacts of the Strasburg Road extension on traffic patterns in that area. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE INS-12-015 - 2012 TRAFFIC CALMING PRIORITY REPORT (CONT'D) Referring to the traffic calming review proposed for Glasgow Street, Mayor C. Zehr suggested that focus should be given to identifying the cause of and implementing measures to mitigate the high number of vehicle collisions occurring on that road. Councillor P. Singh declared a pecuniary interest with respect to the traffic calming review proposed for the neighbourhood bound by and including, Traynor Avenue / Connaught Avenue / Wilson Avenue /Franklin Street, as he owns property in that area. Accordingly, he did not take part in any discussion or voting regarding that matter. The following motion was voted on clause by clause and was Carried. On motion by Mayor C. Zehr - itwas resolved: "That traffic calming reviews be initiated in 2012 for the following streets, as outlined in Infrastructure Services Department report INS-12-015: • Glasgow Street between Fischer Hallman Road and Belmont Avenue; • Morrison Road between King Street East and Sims Estate Drive; • Neighbourhood bound by and including, Traynor Avenue / Connaught Avenue / Wilson Avenue /Franklin Street; and, • Guelph Street between Weber Street and Lancaster Street." 10.
