KIT _ N : C mmunityServices Department www.kitchener.ca COM Dr., A On January 30, 2012, the Planning and Strategic Initiatives Committee passed a resolution approving Zone Change Application ZC11 /07 /C /GS, for 1180 Countrystone Drive, to change the zoning from Residential Four (R -4) to Residential Six (R -6) with a special regulation provision which would permit a maximum of 24 dwelling units on the property. At the request of the Committee, Staff have prepared Special Regulation Provision 601 R which permits a maximum of 24 dwelling units on the property. After further consideration, Planning staff are not recommending specific wording within Regulation 601R which restricts duplex dwelling units. Planning staff are of the opinion that Regulation 601 R is clear and enforceable, allowing a maximum of 24 dwelling units, and not allowing for the further division of units (duplex, secondary dwellings, etc). The resolution of the Committee did not specifically address the two proposed special zoning provisions recommended by Planning staff in Report CSD -11 -157. Planning staff recommend that Special Regulation Provision 598R to allow for an easterly side yard setback of 1.5 metres as well as Special Regulation Provision 5998 to allow for a rear yard setback of 3.0 metres, be implemented through Zone Change Application ZC11 /07 /C /GS. As the resolution of Committee was not specific with respect to the Special Regulations Provision 598R and 5998, staff have prepared two different Proposed By -laws which are attached to this report for consideration by Council. The Proposed By -law and applicable Map No. 1 in Appendix A proposes Residential Six (R -6) zoning with Special Provisions 598R, 599R, and 601 R. Appendix to By-law 85-1 is hereby amended by adding Section 598 thereto as follows: "598. Notwithstanding Section 40.2 of this By-law, for the lands shown as affected by this subsection on Schedule No. 13 of Appendix "A", the following special regulations shall apply: a) The minimum easterly side yard setback of the property shall be 1.5 metres." 4. Appendix "D" to By-law 85-1 is hereby amended by adding Section 599.thereto as follows: "599. Notwithstanding Section 40.2 of this By-law, for the lands shown as affected by this subsection on Schedule No. 13 of Appendix "A", the following special regulations shall apply: a) The minimum rear yard setback of the property shall be 3.0 metres." 5. Appendix "D" to By-law 85-1 is hereby amended by adding Section 601 thereto as IMI "601. Notwithstanding Section 40.2 of this By-law, for the lands shown as affected by this subsection on Schedule of Appendix "A", the following special regulations shall apply: a) The maximum number of dwelling units permitted is 24.
