HomeMy WebLinkAboutFCS-12-020 - Agreement for GRT bus shelters signs benches on CiREPORT TO:Committee of the Whole DATE OF MEETING: February 6, 2012 SUBMITTED BY: Lesley MacDonald, City Solicitor and Director of Legal Services PREPARED BY: Lesley MacDonald, City Solicitor and Director of Legal Services WARD(S) INVOLVED: All DATE OF REPORT: January 30, 2012 REPORT NO.: FCS-12-020 SUBJECT: Agreement with the Regional Municipality of Waterloo for GRT bus shelters, signs and benches on City road allowances RECOMMENDATION: That the Mayor and Clerk be authorized to execute an agreement with the Regional Municipality of Waterloo with respect to installation and maintenance of; and indemnification related to Grand River Transit bus shelters, signs and benches located on City road allowances.” BACKGROUND: The Region assumed the responsibility for the operation of the Kitchener Transit System as of January 1, 2000. In order to facilitate the various changes to the Transit System it makes sense to enter into one agreement dealing with the various components of the transit operation as they encroach on City of Kitchener road allowances. REPORT: GRT is responsible either directly or indirectly for the installation and maintenance of all existing and new bus shelters, signs, and benches. These structures are predominantly located on City road allowances. A consolidated agreement is being suggested to formalize the installation and maintenance of these structures by GRT. The agreement would address the City’s consent to the construction or presence of the structures and would indemnify the City from any claims or future claims arising from the construction, presence and maintenance of the structures. Ultimately the City reserves the right to request relocation or removal of the structure if there are any identified safety or obstruction issues, as well as relocation necessitated as a result of changes to the road pattern as determined by the City ê ó ï ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Not applicable. FINANCIAL IMPLICATIONS: The Region is responsible for all costs associated with the installation and maintenance of bus shelters, signs and benches and would be responsible for any relocation so required above. COMMUNITY ENGAGEMENT: Not applicable. CONCLUSION: It is appropriate for the Mayor and Clerk to execute a consolidated Agreement with the Region to address Grand River Transit bus shelters, signs and benches located on City road allowances.
