SUBJECT:
Delegated Authority for Kitchener Market
RECOMMENDATION:
That Council delegate to the Kitchener Market Manager, and in their absence the
Executive Director of Economic Development, the authority to sign all Kitchener Market
License Agreements and Facility Rental Agreements, to the satisfaction of the City
Solicitor, and further, provided that any amendments to the License Agreement or
Facility Rental Agreement, be to the satisfaction of the City Solicitor.
BACKGROUND:
Due to the growing popularity of the Kitchener Market, more and more mid-week rental
agreements are being signed, and although small scale, a written agreement limits liability. For
example, on March 27 and 28, 2012, the Kitchener Market will be hosting a Skills Canada
carpentry competition (which is a regional competition where students build a carpentry project,
as to advance to the provincial competitions held at RIM Park in Waterloo with Skills Canada –
Ontario. The event will be hosted in the Parking area on the lower level of the Kitchener Market
and will require aFacility Rental Agreementfor the event as there will be overnight storage and
insurance requirements. The delegated authority will allow authorized staff to provide better
customer service through the streamlining of the approvals process.
REPORT:
In order to simplify and streamline agreements with a view of being more efficient, we propose
that the Kitchener Market Manager, and in their absence the Executive Director of Economic
Development, be given the authority to sign the Kitchener Market License Agreements (the one
that is currently being used for Saturday morning Market vendors as prepared by the City
Solicitor) and Facility Rental Agreement, as prepared by the City Solicitor, and further that in the
event the applicant requests changes to any condition of the License Agreement or Facility
Rental Agreement, the Agreement must be reviewed by the Legal Department and, if
appropriate, brought before Council.
