HomeMy WebLinkAboutFCS-12-037 - Committee of AdjustmentREPORT TO:Committee of the Whole DATE OF MEETING: March 5, 2012 SUBMITTED BY: Dianna Saunderson, Secretary-Treasurer, Committee of Adjustment (741-2277) PREPARED BY: Holly Dyson, Administrative Clerk (741-2594) WARD(S) INVOLVED: 1 and 8 DATE OF REPORT: February 27, 2012 REPORT NO.: FCS-12-037 SUBJECT: Fence Variance - 2 Westgate Walk Sign Variance - 1800 Victoria Street North RECOMMENDATION: “That the application of Peter Hodson & Vicki Gohl (FN 2012-001 – 2 Westgate Walk) requesting legalization of a brick fence under construction be used to support a pergola structure, having a height of 2.9m (9.51‘) rather than the permitted 2.44m (8.0’), as shown in the BE drawings provided with this application, on Lot 1, Plan 977, 2 Westgate Walk, APPROVED. ” - and - “That the application of 1586896 Ontario Inc. (SG 2012-001 – 1800 Victoria Street North) requesting permission to erect a roof sign projecting 6.47m (21.23’) above the roof line rather than the permitted 3m (9.84’), on Lot 41, Plan 1677, 1800 Victoria Street North, Kitchener, BE APPROVED Ontario,, subject to the following conditions: 1. That the owner shall apply for and receive approval of a sign permit from the City of Kitchener for the proposed sign. 2. That the owner shall obtain a Certificate of Occupancy from the Planning Division by March 30, 2012.” REPORT: The Committee of Adjustment met as a standing committee of City Council on Tuesday February 21, 2012, to consider two applications: one pursuant to Chapter 630 (FENCES) and one pursuant to Chapter 680 (SIGNS), of the City of Kitchener Municipal Code. These recommendations are being forwarded to you on behalf of the Committee of Adjustment for your consideration. í ó ï ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Respecting Sign By-law and Fence By-law variances, the Committee of Adjustment operates as a Standing Committee of City Council, and as such represents efficient and effective government. FINANCIAL IMPLICATIONS: None COMMUNITY ENGAGEMENT: As directed by the Sign By-law and Fence By-Law, notice of Applications for Variance to the Sign By-law and Fence By-law are published in the Record 15 - 18 days prior to the Committee of Adjustment meeting at which the application will be considered.
