MINUTES OF THE REGULAR MEETING HELD FEBRUARY 21, 2012

Mr. A. Head, Chair, called this meeting to order at 10:10 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider applications regarding variances to the City of Kitchener Sign By-law. The
Committee will not make a decision on these applications but rather will make a recommendation
which will be forwarded to the Committee of the Whole and Council for final decision.
The Chair explained that the Committee's decisions with respect to sign variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendations will be forwarded to City Council on Monday March 5, 2012 at 7:00 p. m., and the
applicants may register with the City Clerk to appear at the meeting if desired.

The Committee was advised that the applicant is requesting permission to erect a roof sign
projecting 6.47m (21.23') above the roof line rather than the permitted 3m (9.84').
The Committee considered the report of the Planning Division, dated February 10, 2012,
advising that the sign is located at the north west intersection of Victoria Street North and
Shirley Drive.
The applicant is requesting a minor variance to erect a roof sign projecting 6.47m (21.23')
above the roof line rather than the permitted 3m (9.84')
The variance meets the intent of the Sign By-law and can be considered minor for the following
reasons. The intent of the regulation restricting the height of a roof sign is to ensure the sign is
not out of proportion to the building and thereby ensuring an aesthetically pleasing streetscape.
Staff is of the opinion that this sign meets the intent of the By-law as it is located on a large
commercial building and appropriately sized signage is required. The applicant has advised all
BMW dealerships in the country use this type of sign and that it meets their corporate
standards.
Victoria Street North is a major arterial road and has a high volume of traffic. This type of
signage is appropriate for the development of the property and the surrounding neighbourhood.

The Committee considered the report of the Region of Waterloo Transportation Planner, dated
February 10, 2012, advising that they have no concerns with this application.
Mr. Quinn advised that he is in support of staff's recommendation.

Seconded by Mr. B. McColl
That the application of 1586896 Ontario Inc. requesting permission to erect a roof sign
projecting 6.47m (21.23') above the roof line rather than the permitted 3m (9.84'), on Lot 41,
Plan 1677, 1800 Victoria Street North, Kitchener, Ontario, BE APPROVED, subject to the
following conditions:
That the owner shall apply for and receive approval of a sign permit from the City of
Kitchener for the proposed sign.
2. That the owner shall obtain a Certificate of Occupancy from the Planning Division by
March 30, 2012.
It is the opinion of this Committee that:
The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
3. The general intent and purpose of Chapter 680 (SIGNS) of the City of Kitchener
Municipal Code is being maintained on the subject property.
