McColl OFFICIALS PRESENT: Ms. J. von Westerholt, Senior Planner, Mr. J. Lewis, Traffic & Parking Analyst, Mr. D. Seller, Traffic & Parking Analyst, Ms. D. Saunderson, Secretary-Treasurer and Ms. H. Dyson, Administrative Clerk Mr. D. Cybalski, Chair, called this meeting to order at 9:41 a. m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to the City of Kitchener Sign By-law. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday April 23, 2012 at 7:00 p. m., and the applicants may register with the City Clerk to appear at the meeting if desired. UNFINISHED BUSINESS Submission No.: SG 2012-002 Applicant: PS Canada Company ULC Property Location: 409 Weber Street West Legal Description: Part Lot 8, Plan 373, Part Lot E, Plan 386, Part Lot 28 of Subdivision Lot 15, German Company Tract, Part Lot 24, Subdivision of Lot 4, German Company Tract, Part Lot 1, Subdivision of Lot 4, German Company Tract, Part Lot 15, Subdivision of Lot 15, German Company Tract, being Part 1, Reference Plan 58R-5554, save and except Part 1, Reference Plan 58R-6654, Part 1, Reference Plan 58R-7835 and Part 1, Reference Plan 58R-15601 Appearances: In Support: N. Dart Contra: None Written Submissions: None The Committee was advised that the applicant is requesting permission to erect a ground supported sign having a distance of 12.1m (39.7') from another ground supported sign, whereas the By-law requires a distance separation of 50m (164.04'). The Committee considered the report of the Planning Division, dated February 13, 2012, advising that the sign is located at the intersection of Weber Street West and Raitar Aveenue. The applicant is requesting a minor variance to erect a ground supported sign having a distance of 12.1 m (39.7') from another ground supported sign, whereas the By-law requires a distance separation of 50m (164.04'). The variance meets the intent of the Sign By-law and can be considered minor for the following reason. The intent of the regulation restricting the separation distance is to ensure the sign is not dominating the streetscape and that it be of appropriate scale as not to create a distraction to traffic, thereby ensuring an aesthetically pleasing landscape. Staff is of the opinion that this sign meets the intent of the By-law as it is located on a property with a frontage of approximately 135.8m (445.5'). COMMITTEE OF ADJUSTMENT Submission No. SG 2012-002 (Cont'd MARCH 20, 2012 Weber Street West is a major arterial road having a high volume of traffic and this type of signage is appropriate for the property and the surrounding neighbourhood. The Committee considered the report of the Region of Waterloo Transportation Planner, dated February 10, 2012, advising that they have no concerns with this application. Moved by Mr. B. Lise That the application of PS Canada Company ULC requesting permission to erect a ground supported sign having a distance of 12.1m (39.7') from another ground supported sign, whereas the By-law requires a distance separation of 50m (164.04'), on Part Lot 8, Plan 373, Part Lot E, Plan 386, Part Lot 28 of Subdivision Lot 15, German Company Tract, Part Lot 24, Subdivision of Lot 4, German Company Tract, Part Lot 1, Subdivision of Lot 4, German Company Tract, Part Lot 15, Subdivision of Lot 15, German Company Tract, being Part 1, Reference Plan 58R-5554, save and except Part 1, Reference Plan 58R-6654, Part 1, Reference Plan 58R-7835 and Part 1, Reference Plan 58R-15601 , 409 Weber Street West, Kitchener, Ontario, BE APPROVED, subject to the following condition: That the owner shall apply for and receive approval of a sign permit from the City of Kitchener for the proposed sign. It is the opinion of this Committee that: The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of Chapter 680 (SIGNS) of the City of Kitchener Municipal Code is being maintained on the subject property.
