HomeMy WebLinkAboutFCS-12-063 - Committee of AdjustmentREPORT TO:Committee of the Whole DATE OF MEETING: April 23, 2012 SUBMITTED BY: Dianna Saunderson, Secretary-Treasurer, Committee of Adjustment (741-2277) PREPARED BY: Holly Dyson, Administrative Clerk (741-2594) WARD(S) INVOLVED: 8 & 10 DATE OF REPORT: April 2, 2012 REPORT NO.: FCS-12-063 SUBJECT: Sign Variance – 409 Weber Street West Fence Variance – 289 Overlea Drive RECOMMENDATION: “That the application of PS Canada Company ULC (SG 2012-002 – 409 Weber Street West) requesting permission to erect a ground supported sign having a distance of 12.1m (39.7’) from another ground supported sign, whereas the By-law requires a distance separation of 50m (164.04’), on Part Lot 8, Plan 373, Part Lot E, Plan 386, Part Lot 28 of Subdivision Lot 15, German Company Tract, Part Lot 24, Subdivision of Lot 4, German Company Tract, Part Lot 1, Subdivision of Lot 4, German Company Tract, Part Lot 15, Subdivision of Lot 15, German Company Tract, being Part 1, Reference Plan 58R-5554, save and except Part 1, Reference Plan 58R-6654, Part 1, Reference Plan 58R-7835 and Part 1, Reference Plan 58R-15601, BE APPROVED 409 Weber Street West, Kitchener, Ontario, , subject to the following condition: 1. That the owner shall apply for and receive approval of a sign permit from the City of Kitchener for the proposed sign.” - and - “That the application of Jose DaSilva (FN 2012-002 – 289 Overlea Drive) requesting legalization of an existing wooden privacy fence having a height of 3.65m (11.98‘) rather than the permitted BE APPROVED 2.44m (8.0’), on Lot 29, Plan 1324, 289 Overlea Drive, Kitchener, Ontario, .” REPORT: The Committee of Adjustment met as a standing committee of City Council on Tuesday March 20, 2012, to consider two applications: one pursuant to Chapter 630 (FENCES) and one pursuant to Chapter 680 (SIGNS), of the City of Kitchener Municipal Code. These recommendations are being forwarded to you on behalf of the Committee of Adjustment for your consideration. î ó ï ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Respecting Sign By-law and Fence By-law variances, the Committee of Adjustment operates as a Standing Committee of City Council, and as such represents efficient and effective government. FINANCIAL IMPLICATIONS: None COMMUNITY ENGAGEMENT: As directed by the Sign By-law and Fence By-Law, notice of Applications for Variance to the Sign By-law and Fence By-law are published in the Record 15 - 18 days prior to the Committee of Adjustment meeting at which the application will be considered.
