SUBJECT: Hwy 8 Reconstruction and Widening, Ministry of
Transportation -Noise Exemption Extension
RECOMMENDATION:
That the Ministry of Transportation and its contractor(s) be exempt from the provisions
of Chapter 450 Noise of the City of Kitchener Municipal Code Article 6 Construction Work
during the reconstruction and widening of Highway 8 from 1.0 km north of the Grand
River Bridge southerly to Highway 401 in the City of Kitchener, Ministry of Transportation
G.W.P 277-97-00. The request for the noise by-law exemption extension is only between
the hours of 7:00 p.m. to 7:00 a.m. for the period anticipated from May 1, 2012 to
tentatively be completed in November 30, 2012.
BACKGROUND:
The Highway 7/8 reconstruction and widening for the MTO on Highway 8 is from 1.0 km north of
the Grand River Bridge southerly to Highway 401 in the City of Kitchener.
This exemption is requested in order to complete the work as required and is an extension to
the original request outlined in DTS- 09-01 which gained approval for the original exemption for
March 31, 2009 through to December 31, 2011. Traffic interference will be minimized by
working at night when volumes are lower.
REPORT:
The extension is to accommodate schedule conflicts and changes as required. Construction is
in the final stages and includes:
• surface course paving
• shouldering
• pavement markings
• some minor structure work.
Paving is the only noise-generating operation to occur at night along with the associated
construction and traffic management plan for single-lane staging.

Emergency service providers that operate within and in proximity of the study area including fire,
police and ambulance services will continue to participate in construction meetings to address
concerns related to night time closures and traffic staging.
The contractor is required to keep idling of construction equipment to a minimum and to
maintain equipment in good working order to reduce noise. In addition, then MTO construction
noise protocol requires that the Contract Administrator monitor and investigate any complaints
regarding construction noise.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
This initiative falls under the Community Priority of Ouality of Life. "Work with partners, including
all orders of government, to create a culture of safety in our community." The implementation of
improved traffic flow and safety will provide positive direction for motorists.
FINANCIAL IMPLICATIONS:
None.
COMMUNICATIONS:
Newspaper advertisements will be published advertising to local residents of the re-
commencement of construction operations, and time specific activities will be broadcast on local
radio and media outlets.
