SUBJECT: EXEMPTION TO CHAPTER 450 (NOISE) -DOWNTOWN
SPECIAL EVENTS
RECOMMENDATION:
That an exemption from Chapter 450 (Noise) of the City of Kitchener Municipal Code be
approved for the events listed on Schedule `A' of Report CSD-12-080.
BACKGROUND:
The Special Events office is, once again this year, involved in coordinating a series of special
events in and around the downtown area, including the Civic Square and Victoria Park. It is a
primary focus of the City to provide events that will create urban vitality and attract more people
to the downtown core. Many of the events involve amplified music or other forms of noise. As
such, staff have requested permission for various events taking place from May to December
2012.
REPORT:
The schedule attached to this report detail the events and the purpose for Council's
consideration.
There are several events listed as being located in Victoria Park. In the past there have been
some complaints from neighbouring residents with regard to noise issues. Members of Council
will recall that By-law Enforcement staff presented a report to the Community and Infrastructure
Services Committee on March 21, 2011 relating to the process for noise exemption requests in
the Park. As a result, any other events to be held in the Park, not listed on Schedule A, will not
be subject to noise exemptions and will be required to comply with the Noise By-law.

Further, Special Events staff have met with the Victoria Park Working Group to discuss issues
related to some of the events in the Park. It appears that the Group are satisfied that controls
are in place to manage the types of issues that have arisen in the past.
Special Events staff will be present at all events, which allows for a point of contact between
them and By-law Enforcement staff, in the event that an issue arises that needs to be
addressed .
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The aforementioned amendments support the Community Priority of Quality of Life, as
contained in the City's Strategic Plan.
FINANCIAL IMPLICATIONS:
N/A
COMMUNITY ENGAGEMENT:
Special Events and Communications staff have developed a detailed communications plan to
build awareness of these events throughout the Downtown and across the City. In addition, a
vast number of volunteers and external stakeholders are involved in the wide array of events.
