AMENDMENT TO STREET VENDOR’S BY-LAW
RECOMMENDATION:
That By-law 2012-023 be amended to add an additional location at 45 Woodside Avenue,
Kitchener.
BACKGROUND:
The Street Vendors By-law permits the licensing of refreshment vehicles such as hot dog carts,
food carts, etc. on specifically approved public property. There are currently three locations
where refreshment vehicles are permitted. The current street vendor’s by-law was passed by
Council February 6, 2012. Since then, staff has received a request from an individual who
wishes to operate a refreshment vehicle at Harry Class Pool, 45 Woodside Avenue. In order to
accommodate this request an amendment must be made to the by-law to add the location.
REPORT:
The individual who has made this request has been advised by staff that if Council decides to
add a new location to the by-law, they may not be the successful applicant. The by-law directs
that any new location which has been established by an amendment to the by-law must be
advertised inviting applicants to apply to the Manager of Licensing before the deadline provided.
The Manager of Licensing reviews all applications using the criteria as set out in the by-law to
determine the successful applicant. If there are multiple applicants meeting the same criteria
the names are part of a lottery process whereby the successful applicant is chosen through a
draw.
The new location is at Harry Class Pool, 45 Woodside Avenue. There is one food establishment
located across the street at 600 Queen St. Attached is a site map showing where the
refreshment vehicle will be located. Discussions have been had with Community Services Staff
and they have no concerns with this request.

FINANCIAL IMPLICATIONS:
The licence fee for a street vendor operating a refreshment vehicle on public property is
$1,835.00 per season.
