BACKGROUND: The Board of Management for the Belmont Improvement Area and the Corporation of the City of Kitchener entered into a parking lot lease agreement in 1979 to allow business operators and customers of Belmont Village to park in the City owned parking lot located at the end of Argyle Street at Belmont Lane West, adjacent to Argyle Park. This agreement expired on December 31, 1993. Recent discussions with the Belmont Improvement Area have brought the issue of this expired parking agreement to the forefront, with a desire to renew the agreement to maintain the current parking arrangements. REPORT: In 2009, Belmont Avenue was reconstructed within Belmont Village. In association with this reconstruction, on-street parking regulations were reviewed and amended through a survey of the businesses. These revised parking regulations were again reviewed in 2011, in an effort to best serve the needs of Belmont Village and its businesses. ë ó ï Through our 2011 parking review, it was discovered that the existing parking agreement between the Belmont Improvement Area Board of Management (Belmont Village) and the City of Kitchener for the off-street parking lot located at the southerly terminus of Argyle St, off Belmont Lane West, had expired. Discussions with the Board of Management confirmed the desire to renew this agreement. The previous agreement permitted Belmont Village business owners, staff and customers to park in this parking lot for the sole purpose of parking motor vehicles. Belmont Village were required to operate, manage and regulate the lot and enforce regulations established therefor, and to maintain the lot, including the asphalt parking surface, markings for parking spaces, concrete curbing, catch basins, manholes, drains and storm sewers and other installations thereon, as well as remove all ice and snow and keep the lot clean and free from refuse, garbage, litter and other objectionable material. The desire, from both the Belmont Improvement Area Board of Management and City staff, is to maintain a similar agreement to allow the businesses, their staff and customers, to utilize the Argyle Street parking lot to support Belmont Village. Accordingly, it is recommended that the Mayor and Clerk be authorized to enter into an agreement satisfactory to the City Solicitor with the Belmont Improvement Area Board of Management for lease of this City-owned parking lot. It is recommended that the parking lease agreement be for an initial ten (10) year term, with an option to renew for an additional ten (10) years based on mutual consent by both the Belmont Improvement Area Board and the City of Kitchener (Director of Transportation Services). Upon expiry of the renewal term, this agreement would include the ability to renew on a six (6) month term basis. Despite both parties being in agreement for the ten (10) year term, it is recommended that this agreement include the option for either party to terminate the agreement with six (6) months notification required. COMMUNICATIONS: The Belmont Improvement Board of Management has been involved throughout the process of reviewing parking regulations within Belmont Village. Accordingly, the Belmont Improvement Board of Management supports the renewal of this parking lease agreement. FINANCIAL IMPLICATIONS: None.
