HomeMy WebLinkAboutCouncil - 2012-05-28 SSPECIAL COUNCIL MINUTES MAY 28, 2012 CITY OF KITCHENER A special meeting of City Council was held at 9:04 a.m. this date, chaired by Mayor C. Zehr with all members present except Councillor J. Gazzola. Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Mayor C. Zehr announced that Mr. Jeff Willmer has been selected for appointment as the new Chief Administrative Officer. Mayor Zehr also expressed Council's appreciation to Mr. Willmer, Ms. P. Houston and Mr. D. Chapman for their leadership and the extra work they took on over the past 3 months. Moved by Councillor B. Vrbanovic Seconded by Councillor B. loannidis "That leave be given the Mover and Seconder to introduce the following by-laws for three readings and that the same be taken as read a first, second and third times, be finally passed and numbered serially by the Clerk. (a) Being a by-law to amend Chapter 101 of the City of Kitchener Municipal Code with respect to Appointment of Staff. (By-law No. 2012-075) (b) Being a by-law to amend Chapter 115 of the City of Kitchener Municipal Code with respect to Corporate Leadership Team. (By-law No. 2012-076)." Carried. Moved by Councillor B. loannidis Seconded by Councillor Y. Fernandes "That an in-camera meeting of City Council be held this date to consider a land acquisition / disposition matter." Carried. The meeting then recessed at 9:06 and reconvened at 6:16 p.m. chaired by Mayor C. Zehr with all members present except Councillors J. Gazzola and B. Vrbanovic. Council considered a recommendation arising from the Finance and Corporate Committee meeting held earlier this date concerning a laneway closure. Moved by Councillor K. Galloway Seconded by Councillor P. Singh "That the closure of the non-travelled laneway running between Edna Street and Indiana Street, attached as Schedule "A" to Finance & Corporate Services Department report FCS-12- 105, described as the whole of PIN 223110110, City of Kitchener, Regional Municipality of Waterloo, be approved in principle, and that Legal Services be instructed to proceed with the preparation and advertising of a by-law to close said laneway, subject to the following conditions: 1. That the non-travelled laneway running between Edna Street and Indiana Street to be closed, described as the whole of PIN 223110110 in the City of Kitchener be declared surplus to the City's needs for the purpose of conveying any easements to outside utility agencies, if necessary; and, 2. That the Property Owner(s) entering into the encroachment agreement(s) contemplated in this resolution be responsible for all costs associated with the closure of said laneway, including, but not limited to, any necessary reference plans, appraisals, SPECIAL COUNCIL MINUTES MAY 28, 2012 - 141- CITY OF KITCHENER advertising, by-law registration, easement registrations, all Registry Office fees and disbursements, as well as costs pertaining to the encroachment agreement and the Legal Services administration fee; with advance payment of the costs to be adjusted once actual costs are known; and, That subject to the laneway being closed, the Mayor and Clerk be authorized to execute Encroachment Agreement (s), satisfactory to the City Solicitor, with one or both of the abutting property owner(s) and any mortgagee(s) of the properties municipally known as 29 Edna Street and 26 Indiana Street, to allow one or both property owner(s) to use that portion of the laneway to be closed, as part of their respective property for general yard purposes, incorporating the area within their fenced yard with landscaping, provided no structures requiring a building permit are built; and further, That staff be directed to waive the annual encroachment fee associated with the Encroachment Agreement, as outlined in Report FCS-12-105." Carried. Council considered a recommendation arising from the Community and Infrastructure Services Committee meeting held earlier this date concerning the 2012 Best Bets for Air Quality. Moved by Councillor Y. Fernandes Seconded by Councillor B. loannidis "That in accordance with the Air Quality in Kitchener (2010) Report, attached to Development Technical Services Department DTS-10-149 approved August 2010, the following be approved as the Five Best Bets for 2012: Best Bet #1 -The City should continue to preserve and acquire parklands and natural lands in existing developments [Recommended Action 1.1 a from the Air Quality in Kitchener report (2010)]; Best Bet #2 -The City and Region should provide creative measures to curb idling at traffic lights by adjusting the timing of traffic lights during non-peak hours [Recommended Action 3.3b from the Air Quality in Kitchener report (2010)]; Best Bet #3 -Encourage the City to establish a Tree Planting and Partnership Program by offering incentives to residents, community organizations, schools, business improvement areas and volunteers to expand resources for the planting, maintenance and care of trees [Recommended Action 1.2a from the Air Quality in Kitchener report (2010)]; Best Bet #4 -Continue to support by way of education, signage, advertising support, and website updates private and/or community vegetable gardens within the City [Recommended Action 4.4c from the Air Quality in Kitchener report (2010)]; and, Best Bet #5 -Ecological diversity (primarily native species) should be promoted in City parks, private, commercial and industrial properties (e.g. butterfly habitat, wildflower sections, plants that attract and/or sustain pollinators and removal of invasive species.) [Recommended Action 1.1 c from the Air Quality in Kitchener report (2010)]; and further, That staff through the City's Environmental Study Group be directed to investigate the feasibility and, if appropriate, pursue the implementation of the Air Quality in Kitchener Five Best Bets for 2012." Carried. Council considered the following motion with respect to a motion adopted by Council at its meeting of May 14, 2012. SPECIAL COUNCIL MINUTES MAY 28, 2012 - 142- CITY OF KITCHENER Moved by Councillor Z. Janecki Seconded by Councillor D. Glenn-Graham "That notwithstanding the direction given at the May 14, 2012 Council meeting, the Clerk shall postpone publishing the Notice of Intention to designate the property known as 324 Old Huron Road pursuant to Section 29 of the Ontario Heritage Act, until such time as draft approval has been given to Draft Plan of Subdivision (30T-11202), as outlined in Community Services Department report CSD-12-055." Carried. Council considered the following recommendation that was inadvertently missed at the Council meeting of May 14, 2012. Moved by Councillor Z. Janecki Seconded by Councillor D. Glenn-Graham "That the following properties in the former Village of Bridgeport, municipally addressed as 574, 595-599, 598-600, 606, 609 and 616 Lancaster Street West, not be listed on the Municipal Heritage Register as non-designated properties of cultural heritage value or interest as the original built structures have lost historical integrity due to a high degree of alterations." Carried. Moved by Councillor F. Etherington Seconded by Councillor P. Singh "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2012-077 by the Clerk."
