SUBJECT: ENCROACHMENT AGREEMENT REQUEST -
PROPOSED RETAINING WALLS, DRIVEWAY,
CONCRETE WALKWAY AND STAIRS AT 76 EARL ST. ON
ARGYLE ST. ROAD ALLOWANCE
RECOMMENDATION:
"That, subject to final approval of a minor variance and to Staff obtaining all necessary
approvals for the encroachments, the Mayor and Clerk be authorized to execute an
Encroachment Agreement, satisfactory to the City Solicitor, with the property owner(s)
and any mortgagee(s) of the property municipally known as 76 Earl St. (PIN 22421-0049)
to legalize proposed retaining walls, driveway, concrete walkway and sidewalk which
encroach approximately 2.01 m, more or less, on the City's Argyle St. road allowance."
BACKGROUND:
The owners of 76 Earl St. are proposing to construct a garage addition at the rear of the existing
residential dwelling. As part of the proposed construction, a new driveway access off Argyle St.
along with retaining walls, concrete walkway and stairs is required due to the grade of the
property. The retaining wall, walkway and stairs will encroach onto the City's Argyle St. road
allowance.
REPORT:
The owners of 76 Earl St. would like to construct a garage addition at the rear of their property
which will require a new driveway access off Argyle St. The driveway access will have precast
concrete retaining walls on either side that measure approximately 2.01 m in length and
measure approximately 0.1 m to 0.91 m in height to accommodate the existing grade of the
property. Anew 1.22m wide concrete walkway and stairs to follow the grade are also proposed.
Attached is a plan illustrating the location and dimensions of the proposed encroachments.
Modifications to the plan may be made to address any concerns that may arise.
The garage addition and required minor variances associated with the addition were approved
at Committee of Adjustment on June 19, 2012 and the appeal period ends July 9, 2012. If no
appeals are received during the appeal period, final approval will be granted.
Due to timing of Council meetings, this matter is being brought to Council in advance of
obtaining all necessary approvals.

COMMUNITY ENGAGEMENT:
Community engagement is not necessary for this process. Internal staff and outside utility
companies are circulated for their comments and/or approval.
CONCLUSION:
Provided all appropriate staff and outside utility companies reviews and approvals are obtained,
it would be in order to authorize the execution of an encroachment agreement with the property
owner(s) and any mortgagee(s) of 76 Earl St.
