RECOMMENDATION:
That Zone Change Application ZC12/11/R/MV for the subject lands (3-16 Rauch Court,
603489 Ontario Inc.), for the purpose of changing the zoning from Arterial Commercial
Zone (C-6) to Residential Four (R-4), in the City of Kitchener, be approved in the form
shown in the attached "Proposed By-law" dated July 7, 2012 attached to Report CSD-12-
101 as Appendix A.

REPORT:
The subject lands were originally a part of the York Nursery lands located along Highland Road,
near the intersection of Highland Road and Trussler Road. The subject lands were severed and
rezoned from Arterial Commercial Zone (C-6) to Residential Four (R-4). A plan of subdivision
was draft approved for the lands on July 5, 1996 as 30T-94001. The subdivision was registered
on January 20, 2012 as 58M-535.
The applicant has recently started the severance application process to develop the lots with
semi-detached dwellings. During the severance application process it was determined that a
small portion of the Rauch Court lands are duel zoned as Arterial Commercial Zone (C-6) and
Residential Four (R-4). Further investigation showed that during the original rezoning
application, a small linear portion of the Rauch Court subdivision was not zoned to Residential
Four (R-4) zone.
The purpose of this Zoning By-law Amendment application is to correct a technical error and
rezone the small linear portion at the rear of 3-16 Rauch Court.
The subject properties are currently zoned Arterial Commercial (C-6) and Residential Four (R-
4). The Owner proposes to rezone the Arterial Commercial Zone (C-6) portion of the lots to
Residential Four Zone (R-4) in order to have the residential lots in one zone and develop the
properties with semi-detached dwellings.
The properties are designated as Low Rise Residential in the City's Official Plan. The Low Rise
Residential designation recognizes the existing scale of residential development and allows for
a variety of low density residential uses.
Conclusion
Planning staff is of the opinion that the proposed zone change from Arterial Commercial Zone
(C-6) to Residential Four (R-4) will correct a technical error and allow residential development to
occur as intended in the original subdivision. Planning staff recommend approval of the zone
change as outlined in the Recommendation section of this report.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
This proposal supports development of our community and will align with the Kitchener Strategic
Plan as it ensures the implementation of the community priority Development and is consistent
with all guiding documents that implement the Strategic Plan.
FINANCIAL IMPLICATIONS:
No new or additional capital budget requests are anticipated with this recommendation.
COMMUNITY ENGAGEMENT:
As this Zoning By-law Amendment is to correct a technical error, there was no public circulation
required in accordance with the City's Public Participation Policy and in consultation with the
Ward Councillor. Notice of the August 13, 2012 meeting of the Planning and Strategic Initiatives
Committee will be advertised in The Record newspaper on July 20, 2012.

The purpose of this application is to change the zoning on the subject lands from Arterial Commercial Zone (C-6) to
Residential Four (R-4) so that the subject lots are zoned entirely Residential Four (R-4). The zoning applies only to a
small sliver of land at the rear of the lots.
The public meeting will be held by the City's Planning and Strategic Initiatives Committee, a Committee of Council which
deals with planning matters on:

200 KING STREET WEST, KITCHENER.
Any person may attend the Public Meeting and make written and/or verbal representation either in support of, or in
opposition to, the above noted proposal. If a person or public body that files a notice of appeal of a decision, does
not make oral submissions at this public meeting or make a written submission prior to approval/refusal of this
proposal, the Ontario Municipal Board may dismiss all or part of a subsequent appeal.
