SUBJECT:
EXEMPTION TO CHAPTER 450 (NOISE) – HOLY TRINITY
SERBIAN ORTHODOX CHURCH
RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be
granted to the Holy Trinity Serbian Orthodox Church at 700 Fischer Hallman Road, for a
special event on September 9, 2012 from 12:00 p.m. to 10:00 p.m.
BACKGROUND:
The Holy Trinity Serbian Orthodox Church at 700 Fischer Hallman Road will be holding a
special event on September 9, 2012. A copy of their exemption request is attached.
REPORT:
The Church holds a couple of festivals each year and obtain the required noise exemption. A 2

day event was held earlier this summer, June 28 and 29. Staff report that a complaint was
received from an adjacent residential area. Specifically, the complaint appeared to relate to the
Sunday evening and that the music was not turned off by the 11PM deadline.
The Church’s submission indicates a request for live music until 10PM for this event. By-law

Enforcement staff will meet with the Church organizers in advance of September 9 to ensure
they understand that the music must cease at the prescribed deadline. In addition, staff will
monitor the site to check compliance with the prescribed timelines.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The aforementioned amendments support the Community Priority of Quality of Life, as
contained in the City’s Strategic Plan.
