Gosse, Committee Administrator CSD-12-112 - DEMOLITION CONTROL APPLICATION DC12/14/G/ATP 1. - 99 GAGE AVENUE - MANSOUR ZARKARI The Committee considered Community Services Department report CSD-12-112, dated July 24, 2012 recommending approval of a demolition permit. On motion by Councillor B. Ioannidis - it was resolved: “That Demolition Control Application DC12/14/G/ATP requesting permission to demolish one (1) single detached dwelling located at 99 Gage Avenue, owned by 2329204 Ontario Inc., be approved without conditions.” CSD-12-118 - NOISE EXEMPTION - HOLY TRINITY SERBIAN ORTHODOX CHURCH 2. - 700 FISCHER-HALLMAN ROAD The Committee considered Community Services Department report CSD-12-118, dated August 2, 2012 recommending approval of a noise exemption request. On motion by Councillor B. Ioannidis - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Holy Trinity Serbian Orthodox Church at 700 Fischer Hallman Road, for a special event on September 9, 2012 from 12:00 p.m. to 10:00 p.m.” CSD-12-119 - NOISE EXEMPTION - WILLIAMSBURG COMMUNITY FESTIVAL 3. - 1187 FISCHER-HALLMAN ROAD The Committee considered Community Services Department report CSD-12-119, dated August 2, 2012 recommending approval of a noise exemption request. On motion by Councillor B. Ioannidis - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to RBJ Schlegel Holdings for their Williamsburg Community Festival 2012 on September 9, 2012, from 9:00 a.m. to 4:00 p.m.” CSD-12-120 - NOISE EXEMPTION - KITCHENER-WATERLOO OKTOBERFEST EVENTS 4. The Committee considered Community Services Department report CSD-12-120, dated August 2, 2012 recommending approval of a noise exemption request. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE AUGUST 13, 2012 - 70 - CITY OF KITCHENER CSD-12-120 - NOISE EXEMPTION - KITCHENER-WATERLOO OKTOBERFEST EVENTS 4. (CONT’D) It was pointed out that the exemption for the Transylvania Club did not include a location. Mr. H. Gross, as a member of the Transylvania Club Board, advised that a 5-year agreement has been reached with the Stampede Corral Bar located at 248 Stirling Avenue South, for use of the facility by the club during Oktoberfest. On motion by Councillor B. Ioannidis - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to K-W Oktoberfest Inc. for a series of events being held at various clubs between October 5 and October 13, 2012, as outlined in the letter from K-W Oktoberfest Inc., dated May 28, 2012, attached to Community Services Department report CSD-12- 120.” CSD-12-121 - NOISE EXEMPTION 5. - CHICOPEE SKI AND SUMMER RESORT (MOTOMOTION) - 396 MORRISON ROAD The Committee considered Community Services Department report CSD-12-121, dated August 2, 2012 recommending approval of a noise exemption request. It was noted in the agenda that any recommendation from the Committee regarding this matter would be forwarded for consideration to the Special Council meeting to be held later this same date. On motion by B. Ioannidis - it was resolved: “That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Chicopee Ski and Summer Resort for their Motomotion event on August 26, 2012 between 9:00 a.m. and 5:00 p.m.” INS-12-055 - ON-STREET PARKING REGULATIONS - MELROSE AVENUE 6. The Committee considered Infrastructure Services Department report INS-12-055, dated June 20, 2012 recommending a parking prohibition for a portion of Melrose Avenue. Councillor S. Davey raised a concern suggesting it was too soon to extend the parking prohibition year-round and asked if the by-law could come into effect January, 2013. Mr. J. McBride advised that the parking prohibition was initiated by the residents, the majority of which are in favour to the proposed change. Mr. McBride added that the plan was to implement the change prior to the hockey season when parking becomes an issue in the area. On motion by Councillor S. Davey - it was resolved: “That effective January 1, 2013, parking be prohibited at anytime (year-round) on the south side (odd number side) of Melrose Avenue from Krug Street to Stirling Avenue; and further, That the Uniform Traffic By-law be amended accordingly.” INS-12-061 - ON-STREET PARKING REGULATIONS - HELENA FEASBY STREET 7. The Committee considered Infrastructure Services Department report INS-12-061, dated August 7, 2012 recommending a parking prohibition for a portion of Helena Feasby Street. On motion by Councillor B. Ioannidis - it was resolved: COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE AUGUST 13, 2012 - 71 - CITY OF KITCHENER INS-12-061 - ON-STREET PARKING REGULATIONS - HELENA FEASBY STREET 7. (CONT’D) “That parking be prohibited on both sides of Helena Feasby Street between Max Becker Drive and Riehm Street; and further, That the Uniform Traffic By-law be amended accordingly.” INS-12-062 - ON-STREET PARKING REGULATIONS 8. - MICHAEL STREET, LINDEN AVENUE AND OAK STREET The Committee considered Infrastructure Services Department report INS-12-062, dated August 7, 2012 recommending changes to the existing on-street parking regulations on Michael Street, Linden Avenue and Oak Street. On motion by Councillor B. Ioannidis - it was resolved: “That parking be permitted for two (2) consecutive hours, 8:00 a.m. - 12 midnight Monday - Saturday on the south side of Michael Street, east side of Linden Avenue and north side of Oak Street, along with including all three (3) roadways in the no re-parking area in the Downtown; and further, That the Uniform Traffic By-law be amended accordingly.” INS-12-066 - ON-STREET PARKING REGULATIONS - EXECUTIVE PLACE 9. The Committee considered Infrastructure Services Department report INS-12-066, dated August 1, 2012 recommending a parking prohibition for a portion of Executive Place. On motion by Councillor B. Ioannidis - it was resolved: “That parking be prohibited at any time on the west side of Executive Place from a point 270 metres south of New Dundee Road to the south limit of Executive Place; and, That parking be prohibited at any time on the east side of Executive Place from a point 270 metres south of New Dundee Road to the south limit of Executive Place; and further, That the Uniform Traffic By-law be amended accordingly.” INS-12-053 - ALL-WAY STOP - OLD HURON ROAD AT BATTLER ROAD 10. The Committee considered Infrastructure Services Department report INS-12-053, dated June 14, 2012 recommending the installation of an all-way stop at the intersection of Old Huron Road and Battler Road. Councillor Y. Fernandes raised a concern advising there is a sharp curve on Old Huron Road approaching Battler Road that could cause drivers not to see the stop sign in time to stop, resulting in possible accidents. Mr. J. McBride advised that prior to installing the three-way stop, staff will review the sightlines and, if required, warning signs will be installed. Councillor Fernandes added that in her opinion, the amount of traffic entering the intersection wouldn’t warrant a three-way stop and requested that the traffic data compiled at the intersection be made available to members of Council. On motion by Councillor Y. Fernandes - it was resolved: “That consideration of the recommendation contained in Infrastructure Services Department report INS-12-053 pertaining to an all-way stop traffic control at Huron be referred to the August 27, 2012 Council meeting Road and Battler Road, , to allow staff time to provide traffic data with respect to the intersection: COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE AUGUST 13, 2012 - 72 - CITY OF KITCHENER INS-12-053 - ALL-WAY STOP - OLD HURON ROAD AT BATTLER ROAD 10. (CONT’D) ‘That an all-way stop control be installed at the intersection of Old Huron Road and Battler Road; and further, That the Uniform Traffic By-law be amended accordingly.’” INS-12-057 - ALL-WAY STOP - COUNTRY HILL DRIVE AT OLD COUNTRY DRIVE 11. The Committee considered Infrastructure Services Department report INS-12-057, dated July 4, 2012 recommending the installation of an all-way stop at the intersection of Country Hill Drive and Old Country Drive. On motion by Councillor B. Ioannidis - it was resolved: “That an all-way stop be installed at the intersection of Country Hill Drive and Old Country Drive; and further, That the Uniform Traffic By-law be amended accordingly.” INS-12-060 - NOISE EXEMPTION - HIGHWAY 85 REPAIRS AND RESURFACING 12. The Committee considered Infrastructure Services Department report INS-12-060, dated July 17, 2012 concerning a noise exemption request for construction work on Highway 85. On motion by Councillor B. Ioannidis - it was resolved: “That the Ministry of Transportation and its contractor(s) be exempt from the provisions of Chapter 450 Noise of the City of Kitchener Municipal Code Article 6 (Construction Work) during the repair and resurfacing work of Highway 85 from Krug Street to 0.4 km north of Regional Road 15 (King Street), in the City of Kitchener, Ministry of Transportation W.P 168-89-00.The request for the noise by-law exemption is only between the hours of 7:00 p.m. to 7:00 a.m. for the period from October 1, 2012 to November 30, 2014.” INS-12-063 - CLOSURE OF TILT DRIVE, STAUFFER DRIVE, GROH DRIVE 13. - DECLARATION OF SURPLUS FOR EASEMENT PURPOSES The Committee considered Infrastructure Services Department report INS-12-063, dated July 23, 2012 recommending the closure of portions of Tilt Drive, Stauffer Drive and Groh Drive. On motion by Councillor B. Ioannidis - it was resolved: “That the closure of portions of Tilt Drive, from Robert Ferrie Drive to Stauffer Drive, Stauffer Drive from Tilt Drive to Caryndale Drive and Groh Drive from Stauffer Drive to Dodge Drive as indicated in Infrastructure Services Department report INS-12-063, Schedule “A”, be approved in principle, and that Legal Services be instructed to obtain a reference plan and proceed with the preparation and advertising of a By-law to close those parts of Tilt Drive, Stauffer Drive and Groh Drive. To permanently prohibit all motor vehicle traffic from using that part of the public highways known as Tilt Drive, Stauffer Drive and Groh Drive, subject to the following condition: That the portion of Tilt Drive, Stauffer Drive and Groh Drive to be closed, to be further described on a Reference Plan to be prepared, be declared surplus to the City’s needs for the purpose of conveying possible easements for the affected agencies; and further, COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE AUGUST 13, 2012 - 73 - CITY OF KITCHENER INS-12-063 - CLOSURE OF TILT DRIVE, STAUFFER DRIVE, GROH DRIVE 13. - DECLARATION OF SURPLUS FOR EASEMENT PURPOSES (CONT’D) That the Mayor and Clerk be authorized to execute all documentation, satisfactory to the City Solicitor, to close the portions of Tilt Drive, Stauffer Drive and Groh Drive to convey the required easements over the portion of roads as required.” CSD-12-108 - DELEGATION OF SIGNING AUTHORITY - CEMETERY AGREEMENTS 14. The Committee considered Community Services Department report CSD-12-108, dated July 31, 2012 recommending the delegation of signing authority for cemetery agreements. On motion by Councillor B. Ioannidis - it was resolved: “That the Manager of Cemeteries or designate be delegated the authority to sign agreements respecting the provision and receiving of cemetery services and goods provided that such agreements are satisfactory to the City Solicitor.” CAO-12-031 - COMPASS KITCHENER LEAF CONSULTATION 15. - REQUEST FOR EXTENSION The Committee considered Chief Administrator’s Office report CAO-12-031, dated July 31, 2012 requesting an extension for the report on the results of the Local Environmental Action Fund (LEAF). On motion by Councillor B. Ioannidis - it was resolved: “That Compass Kitchener be granted an extension from September 10, 2012 to the October 15, 2012 Standing Committee meeting for a report on the results of the Local Environmental Action Fund (LEAF) community consultation.” CSD-12-109 - REGION OF WATERLOO PRE-CONSULTATION 16. - DRAFT POLICIES FOR SOURCE PROTECTION PLAN - ONTARIO CLEAN WATER ACT The Committee considered Community Services Department report CSD-12-109, dated August 3, 2012 recommending that the report be forwarded to the Region of Waterloo as the City’s comments with respect to the pre-consultation on the Draft Policies for the Source Protection Plan. It was noted in the agenda that any recommendation from the Committee regarding this matter would be forwarded for consideration to the Special Council meeting to be held later this same date. Mr. E. Hodgins, Manager of Hydrogeology and Source Water for the Regional Municipality of Waterloo was in attendance. Ms. B. Steiner explained that the Ontario Clean Water Act, 2006, was enacted to protect existing and future sources of drinking water throughout the province. Many of the provisions of the Act will be implemented through Source Protection Committees established for each source protection area or region. Ms. Steiner added that the report before the Committee is a follow-up to Community Services Department report CSD-11-135 which came before Council on October 17, 2011 and provides comments on the Region’s Source Protection Plan draft policies. Ms. Steiner advised that the draft policies will affect several Divisions within the City and a variety of activities including: Operations - road salt applications, snow storage and sanitary wastewater facilities; Stormwater Utilities - mandatory monitoring, maintenance and reporting; Building - private septic inspections; Engineering - new design standards and review/approval processes; and, Planning - development approval processes and snow storage as a use. COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE AUGUST 13, 2012 - 74 - CITY OF KITCHENER CSD-12-109 - REGION OF WATERLOO PRE-CONSULTATION 16. - DRAFT POLICIES FOR SOURCE PROTECTION PLAN - ONTARIO CLEAN WATER ACT (CONT’D) Mr. E. Hodgins advised that the draft policies are complex and have been reduced from 300 to 65. He added that the policies will be coming before Regional Council later this week and if approved, will be circulated to the municipalities and the public for further comments. Councillor J. Gazzola raised a concern with the costs to municipalities in implementing the policies and asked if the Province will be contributing financially and if the total cost across the region was known. Mr. Hodgins advised that the Province is not providing funding and total costs are unknown and could only be given as an estimate. He added that some municipalities may already be undertaking certain practices within the draft policies therefore there would be no new costs. On motion by Councillor Y. Fernandes - it was resolved: “That the City of Kitchener supports efforts by the Province and the Region to protect the drinking water supply; and, That effective and implementable measures to protect the drinking water supply continue to be strongly pursued by all orders of government; and, That the City of Kitchener continues to monitor, and participate in, ongoing consultation in respect of the Source Protection Plan for the area including the City of Kitchener; and further, That the City of Kitchener forward Community Services Department report CSD-12-109 to the Regional Municipality of Waterloo as the City’s comments as part of the pre- consultation on the Draft Policies for the Source Protection Plan.” INS-12-064 - QUEEN ELIZABETH II PARK NAMING REQUEST 17. The Committee considered Infrastructure Services Department report INS-12-064, dated August 8, 2012 recommending that no action be taken with regards to the request to rename the park commonly referred to as Civic Centre Park. On motion by Councillor J. Gazzola - it was resolved: “That no action be taken with respect to the Monarchist League of Canada’s request to rename the park with lands fronting onto Queen Street North commonly referred to as Civic Centre Park to Queen Elizabeth II Park in honour of the Diamond Jubilee of our Head of State, Queen Elizabeth II.” ADJOURNMENT 18.
