DEMOLITION CONTROL APPLICATION DC12/19/E/MD

RECOMMENDATION:
That Demolition Control Application DC12/19/E/MD requesting permission to demolish
one (1) single detached dwelling located at 50 Edmund Road, owned by 1803036 Ontario
Inc., legally described as Plan 657 Lot 15 Part Lot 16, be approved with the following
condition:
That the Chief Building Official may authorize and issue a demolition permit under
Section 33(6) of the Planning Act subject to the following condition:
In the event that construction of the new dwelling unit is not substantially complete
within 2-years from the day demolition of the existing residential property is commenced,

municipal taxes, $20,000 for each dwelling unit contained in the residential properties in
respect of which the demolition permit is issued and such sum shall, until the payment
thereof, be a lien or charge upon the land in respect of which the permit to demolish the
residential property is issued.
REPORT:
The Community Services Department has received an application requesting the demolition of a
single detached dwelling municipally addressed as 50 Edmund Road.The subject lands are
zoned Residential Four(R-4) in the Zoning By-law and designated Low Rise Residential in the
The owner is proposing to demolish the single detached dwelling in order to redevelop the
property with a semi-detached dwelling as permitted in the Zoning By-law and Official Plan. The
Planning Act provides the authority to impose conditions relating to the timing and completion of
new construction. The purpose of these conditions is to ensure that redevelopment of the site
occurs in a timelymanner. As a result, staff isrecommending approval subject to the condition
that in the event that construction of the semi-detached dwelling is not substantially complete
within 2-years, than a fine of $20,000 for each dwelling unit in the form of a lien or charge upon
the land maybe imposedupon the owner.
Internal Circulation Comments:
Preliminary circulation of the demolition control application was undertaken from August 3, 2012
to August 27, 2012 to all applicable internal departments. All comments that were received from
internal departments are attached (Appendix B). There were no objections to the proposed
demolition.
Planning Analysis:
Planning staff conducted a site visit on August 15, 2012. It is the opinion of staff that the
proposed demolition will have minimal impact on the adjacent lands and overall neighbourhood
because the subject lands areproposed to be redeveloped with a semi-detached dwellingas
permitted in the Residential Four (R-4) Zone. The proposed redevelopment will result in an
increase to the housing stock. In addition, theproposed redevelopment is consistent with the
land usedesignation,which favours the mixing
and integration of different forms of housing to achieve a low overall intensity of use. All internal

no concerns with the proposeddemolition.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The proposed demolition is required prior to the redevelopment of the subject site and will align
with the Kitchener Strategic Plan as it ensures the implementation of the community priority
; with comprehensive redevelopment that is consistent with Provincial, Regional
and City planning policies.
FINANCIAL IMPLICATIONS:
No new or additional capital budget requests are expected with this recommendation.

COMMUNITY ENGAGEMENT:
A neighbourhood circulation was not made as part of this application as the applicant intends to
redevelop the site. However, all property owners within 60 metres of the subject property will
receive a courtesy notice of the Committee meeting considering this demolition control
application.
CONCLUSION:
Planning staff have considered this application and are of the opinion that the proposed
demolition is justified as the removal of the existing single detached dwelling will enable the
redevelopment of the subject lands with a semi-detached dwelling. As such, staff recommends
that Demolition Control Application DC12/19/E/MD, requesting permission to demolish the
existing single detached dwelling, be approved subject to the condition outlined in the
recommendation of this report.
