HomeMy WebLinkAboutFCS-12-165 - Delegated Authority to Execute Minutes of Settleme REPORT TO:Committee of the Whole DATE OF MEETING: October 1, 2012 SUBMITTED BY: Lesley MacDonald, City Solicitor and Director of Legal Services, (519)741-2267 PREPARED BY: Lesley MacDonald, City Solicitor and Director of Legal Services, (519)741-2267 WARD(S) INVOLVED: N/A DATE OF REPORT: October 1, 2012 REPORT NO.: FCS-12-165 SUBJECT: DELEGATION OF SIGNING AUTHORITY RE MINUTES OF SETTLEMENT IN ASSESSMENT REVIEW BOARD MATTERS RECOMMENDATION: That the Treasurer and/or the Deputy Treasurer be authorized to execute Minutes of Settlement on behalf of The Corporation of the City of Kitchener in Assessment Review Board Matters where the resolution is satisfactory to MPAC and the City; said agreement is to be to the satisfaction of the City Solicitor. BACKGROUND: Property owners appeal their property assessments to the Assessment Review Board. The Municipal Property Assessment Corporation (MPAC) is the primary responder to these appeals and from time to time the City participates in the hearing and settlement discussions as well. REPORT: In those situations where the City has participated in the discussions, it would be appropriate for the City to execute the Minutes of Settlement where the resolution is satisfactory to MPAC and the City concurs with the resolution. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Not applicable. FINANCIAL IMPLICATIONS: Not directly but there could be some adjustment to the assessment which will translate into adjustments to the taxes charged. COMMUNITY ENGAGEMENT: Not applicable. CONCLUSION: The City participates in some Assessment Review matters from time to time and although, MPAC has the lead in those matters, both participating parties are asked to execute any Minutes of Settlement. To facilitate the settlement it would be efficient if the Treasurer and the Deputy Treasurer are authorized to execute these Minutes on behalf of the City.
