NOVEMBER 26, 2012 CITY OF KITCHENER
A special meeting of City Council was held at 12:51 p.m. this date, chaired by Mayor C. Zehr with all
members present.
Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant
to Chapter 25 (Council Procedure) of the Municipal Code.
Moved by Councillor K. Galloway-Sealock
Seconded by Councillor Y. Fernandes
"That an in-camera meeting of City Council be held this date to consider two land acquisition /
disposition matters, two litigation /potential litigation matters one of which is also subject to
solicitor-client privilege and a labour relations matter."
Carried.
The meeting then recessed and re-convened at 5:35 p.m., chaired by Mayor C. Zehr and with all
members present.
Council considered Finance and Corporate Services Department report FCS-12-192 (L. MacDonald),
dated November 21, 2012, requesting authorization to execute amendments to the Agreement of
Purchase and Sale and Development Agreement for the Centre Block.
Councillor B. loannidis declared a pecuniary interest as his family owns property in the area, did not
participate in discussion and did not vote.
Moved by Councillor S. Davey
Seconded by Councillor P. Singh
"That the Mayor and Clerk be authorized to execute amendments to the Agreement of
Purchase and Sale and to the Development Agreement with Andrin Investments Limited to
extend the timing to transact the various phases of the property and commence construction
such that the Phase 1 lands shall be transacted no later than the earlier of thirty days following
the issuance of a building permit or August 30, 2013 and the Phase 2 lands shall be transacted
no later than the earlier of thirty days following the issuance of a building permit or November
30, 2016; provide further clarity regarding the boundaries of the phases; delete the City's
acquisition of any public parking in Phase 1 and reduce the number of parking spaces to be
acquired in Phase 2 from 250 to 139 spaces; and any other incidental changes which, as a
result of change in circumstances, require adjustments; said amendments to be satisfactory to
the City Solicitor."

Council considered a recommendation arising from the Finance and Corporate Services Committee
meeting held earlier this date concerning leasing of a City Hall retail unit.
Councillor B. loannidis declared a pecuniary interest as his family owns property in the area, did not
participate in discussion and did not vote.
A recorded vote was requested.

Seconded by Councillor B. Vrbanovic
"That the Mayor and Clerk be authorized to enter into a lease agreement with the preferred
prospective tenant for the City Hall Retail Space, located at 220 King Street West (ground
floor retail unit in City Hall), subject to the satisfaction of the City Solicitor; and further,

That if staff are unable to come to an agreement on a lease with the preferred prospective
tenant, the Mayor and Clerk be authorized to enter into a lease agreement with the second
prospective tenant."

Committee meeting held earlier this date concerning a noise exemption request.
Moved by Councillor K. Galloway-Sealock
Seconded by Councillor S. Davey
"That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to TRP Construction for 2 evenings between November 27t" and December 7t", 2012, between
the hours of 7:00 PM and 4AM, for necessary construction work on Jean Steckle Public
School, located at 130 Woodbine Avenue."

Seconded by Councillor P. Singh
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2012-155 by the Clerk."
Carried.
On motion the meeting adjourned at 5:38 p.m.
