NOVEMBER 17, 2003
CITY OF KITCHENER
A special meeting of City Council was held at 5:18 p.m. this date, Chaired by Mayor C. Zehr with all
members present except Councillor M. Galloway.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council was in receipt of Development and Technical Services Department report DTS-03-183 (J.
Given), dated November 13, 2003, recommending that Clause 15 of the Development and Technical
Services Committee report of August 25, 2003 be amended to correct administrative errors.
Moved by Councillor C. Weylie
Seconded by Councillor B. Vrbanovic
"That Clause 15 of the Development and Technical Services Committee report approved by
Council on August 25, 2003 be amended to correct administrative errors reflected in report
DTS-03-147 wherein item a) - condition numbering revision and item c) - introduction of
revised proposed by-law, listed under Recommendation 1 of the staff report should have been
listed under Recommendation 2 as applying to 346874 Ontario Limited rather than to JHS
Properties and the following amendments to Clause 15 be approved in that regard:
1)
that recommendation la) in DTS 03-147 ("That recommendation 2 cite a revision to
Condition 50, not 51as written .") shall apply to Condition 2 in DTS 03-123 (346874
Ontario Ltd.) and shall not apply to DTS 03-122 (JHS Properties Ltd.)
2)
the date of the proposed Zoning By-law listed in Clause 15.A should be corrected by
changing it from July 31, 2003 to August 8, 2003 which reflects the actual by-law
attached to report DTS-03-147 and which was passed by Council as By-law No. 2003-
160 on August 25, 2003 pertaining to Zone Change Application ZC 03/12/P/JG (346874
Ontario Limited)."

"That an in-camera meeting of City Council be held immediately following this special meeting to
consider a land acquisition / disposition matter, a personal matter, a potential litigation matter and
a matter subject to solicitor-client privilege."
Carried.
Moved by Councillor B. Vrbanovic
Seconded by Councillor G. Lorentz
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 2003-200 by the Clerk."
Carried.
On motion, the meeting adjourned at 5:20 p.m.
