Goodeve, Committee Administrator INS-12-084 - CLASS ENVIRONMENTAL ASSESSMENT FOR STRASBURG ROAD 1. - NORTH OF STAUFFER DRIVE TO NEW DUNDEE ROAD - ADDITIONAL SCOPE OF WORK AND NEXT STEPS The Committee considered Infrastructure Services Department report INS-12-084, dated November 14, 2012, recommending additions to the scope of work for the Class Environmental Assessment (EA) on the extension of Strasburg Road from north of Stauffer Drive to New Dundee Road. In addition, the Committee was in receipt this date of a cost comparison for the routing of the Strasburg Road extension, prepared by Mr. Ryan Despres, dated November 23, 2012. The Committee was in further receipt this date of correspondence from Mr. Mark L. Dorfman, R.P.P. on behalf of the owner of 500 Stauffer Drive, dated November 23, 2012, which expresses support for the staff recommendation. Mr. B. Korah presented the report, advising that Mr. Ian Upjohn, SNC-Lavalin Inc., was in attendance to respond to any questions the Committee may have on the EA. He indicated that based on the nature of the comments received to date, it was determined that additional time and work was required for this project. He noted the northern portion of the Strasburg Road extension, from Rush Meadow Drive to north of Stauffer Drive, was not being considered as part of the Class EA process on the southern section. He pointed out that the northern section is not currently under review, nor are comments being received, except as they relate to final design details. He indicated that staff are proposing to hold a public workshop with City Council on February 4, 2013 to present and receive feedback on the EA’s revised evaluation criteria. He added that the project team intend on making similar presentations to Heritage Kitchener and the Environmental Committee. He stated that it is anticipated that the preferred alignment for the southern section would be presented by May 2013; and, the finalized EA would be filed with the Ontario Ministry of the Environment (MOE) by September / October 2013. Mr. Korah further advised that to achieve this, staff are recommending that the project budget be increased as well as the Purchase Order for SNC-Lavalin Inc. He noted that a total of $565,000. would be required to undertake the additional scope of work on the EA. It was noted that while listed on the agenda as delegations, neither Mr. Nick Bogart nor Ms. Carole Wiebe would be addressing the Committee this date. Mr. Paul Britton, MHBC Planning presented an overview of the history of the Strasburg Road extension project. He advised that Strasburg Road was identified as an essential component of the planned City / Regional arterial road network and would serve as an important link between Highway 7/8 and Highway 401. He indicated that the extension of Strasburg Road would accommodate significant volumes of traffic and is required to reduce the amount of vehicles on the local and collector road network. He added that Strasburg Road is also a planned transit route and would act as a servicing spine for several plans of subdivision. He stated that the alignment of the northern section of the road extension has been established and that the issue now is to determine the preferred alignment for the southern section through the subject EA. He commented that MTE Consultants Inc. are proposing an alternative alignment for the southern section that would minimize the impact of the road extension on 500 Stauffer Drive and is endorsed by a majority of area land owners. He spoke in support of the recommendation contained in Report INS-12-084, which proposes an additional comparative analysis of the possible alignments; including the one being put forward by MTE. PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES NOVEMBER 27, 2012 - 85 - CITY OF KITCHENER INS-12-084 - CLASS ENVIRONMENTAL ASSESSMENT FOR STRASBURG ROAD 1. - NORTH OF STAUFFER DRIVE TO NEW DUNDEE ROAD - ADDITIONAL SCOPE OF WORK AND NEXT STEPS (CONT’D) In response to questions, Mr. Britton indicated that with respect to approvals, the overall road network for the subject area has not changed since 1994. He added that the establishment of the northern alignment of the Strasburg Road extension was done concurrently with his clients’ registration of their draft plan of subdivision. He acknowledged that the studies conducted in 1994 which fixed the northern alignment also expressed support to the designation of 500 Stauffer Drive under the Ontario Heritage Act. He stated that the direction in 1994 was that the proposed designation should move forward at the same time as the establishment of the southern alignment of the Strasburg Road extension. He commented that this would allow those issues to be dealt with in a more comprehensive manner. Mr. Jeff Martin, MTE Consultants Inc. addressed the Committee in support of the recommendation contained in Report INS-12-084 and presented a proposed alternative alignment for consideration as part of the expanded scope of work on the EA. He advised that this alternative was being put forward on behalf of the following area land owners: Hallman Construction Ltd., Becker Estates Inc. (Schlegel), Primeland Developments Ltd. (Freure), Activa Holdings Inc., Stonefield Properties Corp. and Sunvest Reid Ltd. He indicated that MTE completed a comparative analysis of the preferred technical alignment (E4) versus the land owners preferred alignment (W2). He defined the northern section of the Strasburg Road extension as going from Rush Meadow Drive to north of Stauffer Drive, adding that it was not being considered as part of this EA process. He noted that the terminus of the north section does not constrain either the E4 or W2 alignments. He clarified the following as the properties that would be directly affected by the southern portion of the Strasburg Road extension: 500 Stauffer Drive, as well as those lands owned by Activa, Sunvest Reid and Stonefield. He advised that MTE’s review of the EA determined that the E4 alignment was overrated with respect to socio-economic and financial / technical elements. He indicated that based on their analysis, the W2 alignment scored better in terms of socio-economic, cultural, natural environment and financial. He pointed out that the E4 alignment would fragment 500 Stauffer Drive by coming within approximately 70 metres of the homestead; while W2 would leave that property largely intact and would only pass within 320 metres of the homestead. He added that the E4 alignment would cross a wider area of Blair Creek compared to W2. He estimated the total cost for the E4 alignment at $19.8M, noting that W2 would cost approximately $17.5M. He commented that the landowners represented by MTE would be willing to enter into a funding agreement to front-end the costs of constructing the road extension using the W2 alignment. He noted this is conditional on the City agreeing to proceed with the construction of the southern portion of the Strasburg Road extension in an expeditious manner. In response to questions, Mr. Martin advised that as part of MTE’s comparative analysis, they staked and walked both proposed alignments. He stated that when considered within the context of the width of the road right-of-way it is their belief that the W2 alignment would not impact the Provincially Sensitive Wetland (PSW) located near Blair Creek. He stated that their analysis characterized the wetland that would be crossed by W2 as being of a lower quality compared to the one that would be crossed if the City proceeded with the E4 alignment. He indicated that a bridge would be needed to facilitate both crossings. He estimated that the E4 alignment would require a bridge crossing of approximately 11 metres, while W2 would only require a crossing of approximately 9 metres. He noted that both bridges would allow the indigenous species to flow freely through them. At the request of Councillor Y. Fernandes, Mr. Martin agreed to circulate to the Committee copies of MTE’s comparative analysis as well as the presentation he gave this date. Ms. Claire Griffioen, area resident, addressed the Committee in opposition to the proposed extension of Strasburg Road, advising that in her opinion, it does not seem logical to have the proposed road extension designed as two separate parts; being north and south. She stated that in terms of environmental factors such as, species at risk, sensitive wetlands, as well as ground water impacts, north and south designations do not apply. She commented that if there are environmentally sensitive issues affecting the southern part of the road, it is more than likely that they also affect in the northern portion. She stated that the 1982 City of PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES NOVEMBER 27, 2012 - 86 - CITY OF KITCHENER INS-12-084 - CLASS ENVIRONMENTAL ASSESSMENT FOR STRASBURG ROAD 1. - NORTH OF STAUFFER DRIVE TO NEW DUNDEE ROAD - ADDITIONAL SCOPE OF WORK AND NEXT STEPS (CONT’D) Kitchener Official Plan called for the completion of a full EA for any proposed development or road passing through the subject area. She noted that to date, not all of the phases of an EA have been completed for the northern alignment. She advised that while an EA on this section was started in 1994, it was her understanding that only Phases I and II were completed. She requested that if the City intended to allocate additional funds to this project, then the road should be considered in its entirety and not in two separate parts. In response to questions, Ms. Griffioen advised that the junction where the northern portion ends and the southern portion begins seems to have been arbitrarily selected. She added that the environmental impacts incurred by the proposed road extension would affect both sections; and therefore, consideration should be given to its overall impact. She spoke in support of the more westerly alignment previously presented by Mr. Karl Cober, indicating that it appeared to have less of an impact on the environment compared to what was proposed in the EA and by the development industry. Mr. Derek Griffioen, area resident, addressed the Committee in opposition to the proposed extension of Strasburg Road. He expressed a strong connection to the Strasburg Creek area, noting that a large portion of his childhood was spent playing in that forest. He requested that the City preserve the forest to enable future generations to enjoy this natural area. In response to questions, Mr. Griffioen advised that consideration should be given to minimizing the impact on the area’s natural environment. He suggested that the City should explore the potential to implement the western alignment previously presented by Mr. Karl Cober; which would not impact the subject forest. Ms. Karen von Knobloch, area resident, gave a presentation on the value of protecting the natural environment. She expressed concerns regarding the impact that the proposed road extension would have on Strasburg Creek, noting it is one of the areas only cold water streams. She stated that the technically preferred alignment would negatively affect the provincially significant wetlands along with the surrounding forest and meadows as well as the species at risk within this area. She commented that there was also the potential loss of areas of archeological and heritage significance if the City proceeded with the E4 alignment. She suggested that a more westerly alignment would be preferable, given the detrimental effect that an eastern alignment would have on the area’s significant environmental features. In response to questions, Ms. von Knobloch spoke to a need to have an archeological assessment conducted on all previously undisturbed sites along the route of the proposed road extension. She acknowledged that development would occur in this area, noting that it needed to be properly planned to ensure the long-term preservation of the natural environment. She commented that while a more westerly route for the Strasburg Road extension would facilitate a need to shift the alignment of the northern section, it would be preferable given the reduced impact to the environment. She suggested that the City could possibly pursue a land exchange with the developers who own the properties adjacent to the northern section to allow that portion of the road extension to be re-aligned. Mr. Ryan Despres reviewed his circulated cost comparison, presenting concerns regarding the calculations used for the proposed alignments, bridge construction and extension of Robert Ferrie Drive. He questioned the accuracy of the estimates put forward in the EA, commenting that the proposed eastern alignments would have greater long-term costs. He advised that approximately $800,000. has been budgeted for structures, which in his opinion would only be sufficient to cover the costs associated with installing culverts. He suggested that the estimate put forward for the W1 alignment should be re-examined, given that the cost of building a bridge over the wetlands would be greater than the cost of building a road to go around them. He requested that information be provided on the costs associated with constructing a four lane clear span bridge, which would allow for a better understanding of the full costs involved with crossing a PSW; as proposed by the eastern alignments. PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES NOVEMBER 27, 2012 - 87 - CITY OF KITCHENER INS-12-084 - CLASS ENVIRONMENTAL ASSESSMENT FOR STRASBURG ROAD 1. - NORTH OF STAUFFER DRIVE TO NEW DUNDEE ROAD - ADDITIONAL SCOPE OF WORK AND NEXT STEPS (CONT’D) In response to questions, Mr. Despres explained the cost impacts of constructing a bridge over the wetlands, noting that it would involve greater excavation requiring heavy equipment on site as well as bridge supports given the length of span. He stated that the complexities associated with this kind of construction over an environmentally sensitive wetland would likely add to the projects overall construction costs. He commented that the installation of a culvert would require extensive excavation, which would defeat the purpose of trying to go over the environmentally sensitive wetlands. He acknowledged that his comparison was not meant to be a cost benefit analysis; rather, it was to demonstrate that western alignments should not be ruled out based on financial viability. Questions were raised as to what was proposed to be constructed to cross the PSW in the alignment being put forward by the area land owners. Mr. Martin advised that the cost estimates he provided accounted for two bridge structures. He clarified that several options could be utilized to minimize the impact of constructing a clear span bridge. He stated that a three legged box structure could be used, in which a footing is dropped in place and the road is built over top of it. He added that such bridges do not require in-stream work, nor would it affect any of the wetland in the immediate vicinity. He noted that precast three legged box structures have been used for bridges spanning up to 15 metres and would be more than adequate to accommodate the crossings proposed for either the E4 or W2 alignments. Mr. Korah responded further that a 10 metre clear span bridge was proposed as part of the EA, and that crossing was supported by the Grand River Conservation Authority (GRCA). He noted that the construction method that will be utilized for the bridge, would be determined as part of the detailed design process. Ms. Alicia Pokluda, area resident, addressed the Committee in opposition to the proposed extension of Strasburg Road. She stated that the road extension would have a dramatic and undesirable impact on endangered species habitat, provincially significant wetlands, pristine forest, Regional wellheads and water recharge areas. She expressed concerns regarding the potential increase in traffic through the residential neighbourhood and impact on air quality resultant to the road extension. She suggested that the northern and southern portions of the road should be planned as one entity; thereby ensuring that consideration is given to the overall effect this project would have on the natural environment. In response to questions, Ms. Pokluda advised that while she acknowledges the necessity for new roads, careful consideration is needed to ensure the selected alignment has as little impact as possible on the environment. She indicated that she was supportive of the proposal put forward by City staff to expand the scope of the EA. Mr. Karl Cober addressed the Committee in opposition to the proposed road extension, advising that the western alignment he previously presented was not reflected in the staff report. He stated that the Strasburg Road extension needs to be examined as one block and not in the current piecemeal manner. He questioned why there were no community representatives on the Steering Committee, suggesting that this could have helped to address the issues being raised by area residents. He indicated that all of the alignments that have been put forward for consideration would result in the destruction of approximately 2.2 acres of forest. He added that the alternative he presented at the May 7, 2012 Planning and Strategic Initiatives Committee meeting would avoid this significant environmental feature. He estimated that his alternative alignment would have a similar overall cost and implementation timeframe as the technically preferred alignment; however, it would avoid sensitive environmental areas. He advised that he understands the position taken by City staff that the northern alignment of the proposed road extension has been established and that this is based on correspondence from MOE that deems that the City has satisfied the intent of the Class EA process through a history of area studies. He added that he has confirmed with the Ontario Ministry of Natural Resources (MNR) that a PSW exists within the alignment of the northern section. He stated that if the northern section is found to be impacting a PSW that would be grounds to sustain a Part 2 Order by MOE. He suggested that the City should undertake a full EA on the entire PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES NOVEMBER 27, 2012 - 88 - CITY OF KITCHENER INS-12-084 - CLASS ENVIRONMENTAL ASSESSMENT FOR STRASBURG ROAD 1. - NORTH OF STAUFFER DRIVE TO NEW DUNDEE ROAD - ADDITIONAL SCOPE OF WORK AND NEXT STEPS (CONT’D) road extension, including an examination of his alternative alignment to avoid the 2.2 acres of forest and the PSW in the northern section. He proposed that to maintain costs, some of the other alignments currently included in the EA could be removed from consideration. In response to questions, Mr. Cober displayed his proposed alternative alignment, estimating that it was approximately 8% longer than the technically preferred alignment. He stated that while Robert Ferrie Drive would have to be extended beyond what is currently proposed some of the other roads would be shortened. He commented that options for pedestrian movement could be incorporated into the design of the future subdivision to mitigate the transit issues associated with relocating the Robert Ferrie Drive intersection to the outskirts of the development. Responding to questions regarding the countryside line, Mr. Cober advised that it was his understanding that development would primarily occur to the east of Strasburg Road. He stated that while his alignment would move Strasburg Road to the west of the countryside line, this would not automatically allow for expanded development activity. He acknowledged that his proposed alignment would impact Primelands Development’s draft approved Plan of Subdivision, by having the northern section of the road extension routed through Stages 5A and 5B. He suggested that the City could pursue an arrangement with the developer and/or use the funds remaining in the Local Environmental Action Fund (LEAF) account to purchase the required lands. He proposed that the cost of purchasing those lands would be partially offset by not having to expend funds to construct a bridge crossing of a PSW. He estimated that his proposed alignment would only increase the overall project costs by approximately 8%. Mr. Kevin Ramessar, area resident, addressed the Committee in opposition to the proposed extension of Strasburg Road. He suggested that it was in the best interest of the City to dialogue with all parties concerned with this matter, as doing so may allow this project to move forward in a more sustainable manner. He expressed concerns regarding the negative impact the northern alignment of the road extension would have on the environment, adding that greater transparency is needed in relation to the work being conducted on that section. He commented that in his opinion, there was an arbitrary delineation of the north and south sections and proposed that consideration should be given to what was the most appropriate alignment for the overall road extension. He added that the City needs to ensure that the selected alignment serves the interests of future generations, with a more progressive approach to issues, such as public transit. In response to questions, Mr. Ramessar expressed a desire for more information to be shared related to the detailed design process being undertaken on the northern alignment. He requested that consideration be given to including Mr. Cober’s alternative alignment as part of the EA’s expanded scope, which should also include a re-evaluation of the northern section. Mr. David Gilhula, area resident, addressed the Committee regarding the need to retain 500 Stauffer Drive and its historic bed and breakfast / conference centre. He raised concerns with the proposed alignment being routed through these privately owned lands, noting that other alternatives were presented that would by-pass the Stauffer Drive property and most of the environmentally sensitive areas. He added that the proposed extension of Robert Ferrie Drive would render the property useless as a farm. He then suggested that the road extension should be built to the west of the Stauffer property so the owner’s business would be left intact. Mr. Gilhula responded to questions, advising that the business at 500 Stauffer Drive is a thriving bed and breakfast, with geographically wide ranging clientele. He confirmed that his primary concern was the impact of the road extension on that property. Mr. Glenn Beckwith addressed the Committee and displayed photographs of 500 Stauffer Drive and spoke to the property’s unique natural setting within the City’s urban landscape. He commented on the numerous events that he has attended at that location and described the various heritage features of the property. He urged the Committee to select an alignment for the proposed road extension that would have a minimal impact on this property. PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES NOVEMBER 27, 2012 - 89 - CITY OF KITCHENER INS-12-084 - CLASS ENVIRONMENTAL ASSESSMENT FOR STRASBURG ROAD 1. - NORTH OF STAUFFER DRIVE TO NEW DUNDEE ROAD - ADDITIONAL SCOPE OF WORK AND NEXT STEPS (CONT’D) In response to questions, Mr. Beckwith expressed concerns that an EA was only deemed as being completed on the northern alignment. He suggested that further consideration should be given to the alignment proposed by Mr. Cober. Ms. Ann O’Donnell-Beckwith spoke in opposition to the proposed extension of Strasburg Road, which would to run through 500 Stauffer Drive. She commented on the many activities that she has enjoyed at that property, noting a need to preserve 500 Stauffer Drive as a cultural heritage landscape. She requested that if the proposed road extension is to move forward, that the alignment be changed to avoid this property. Ms. Louisette Lanteigne addressed the Committee in opposition to the proposed extension of Strasburg Road, citing various environmental impacts that may be incurred if this project were to move forward. She commented that the subject area is vital to the region’s water supply, suggesting that stormwater management ponds would not be able to replace the benefits derived from natural wetlands. The Committee then briefly recessed at 11:06 p.m. and reconvened at 11:11 p.m., chaired by Councillor B. Vrbanovic and with all members present. Mr. Harald Drewitz addressed the Committee requesting clarification regarding the process with respect to the use of a point of order by a member of the public. Mr. C. Goodeve advised that pursuant to Section 25.1.13 of the City’s Procedural By-law, a point of order is defined as a statement made by a member during a meeting, drawing to the attention of the Chair, a breach of the rules of procedure. He added that as outlined by Section 25.1.6, a member is defined as someone elected to Kitchener City Council. Clarification was requested as to what was intended to be brought forward for consideration with respect to the northern alignment. Mr. Korah confirmed that staff would be presenting the results of the detailed design on the approved alignment of the northern portion of the Strasburg Road extension in 2013. He pointed out that this would not include options regarding the routing of that alignment. Questions were raised regarding whether consideration has been given to the alternative alignment proposed by Mr. Cober. Mr. Korah advised that since April 2010 staff have sent correspondence and discussed this project on several occasions with Mr. Cober. He stated that all of the documentation and background information dating back to the 1970s establishes the fixed alignment of the northern section of the Strasburg Road extension. He commented that in order to consider Mr. Cober’s proposal, direction would need to be given for staff to reconsider the alignment of the northern section. He confirmed that the southern portion of the W1 alignment was similar to the alignment put forward by Mr. Cober. In response to questions as to the potential for cost savings if some of the eastern alignments were removed from the EA, Mr. Upjohn advised that while there was the potential for cost savings; it would not be advisable to remove those alignments as that could jeopardize the integrity of the EA. Mr. S. Ross advised that at a minimum the City would need to retain the technically preferred alignment, so that the other options can be weighed against it. Mr. Korah added that it would be more appropriate to reduce the number of options being evaluated following the presentation of the revised evaluation criteria in February 2013. Ms. B. Robinson advised that based on her experience, all alternatives should be considered as part of the evaluation process in order to meet the requirements for an EA. Councillor B. Vrbanovic advised that in accordance with Municipal Code Chapter 25.4.18 (Termination of Council Proceedings) the proceedings of Council and/or one of its Committees on any day shall be terminated by midnight, unless such proceedings are continued after such hour with the unanimous consent of the members present. On motion by Councillor B. Ioannidis - it was resolved: PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES NOVEMBER 27, 2012 - 90 - CITY OF KITCHENER INS-12-084 - CLASS ENVIRONMENTAL ASSESSMENT FOR STRASBURG ROAD 1. - NORTH OF STAUFFER DRIVE TO NEW DUNDEE ROAD - ADDITIONAL SCOPE OF WORK AND NEXT STEPS (CONT’D) “That approval be given for this meeting of the Planning and Strategic Initiatives Committee to continue past midnight.” Carried Unanimously by all members present. On motion, Mayor C. Zehr brought the recommendation contained in Report INS-12-084 forward for consideration, with an additional clause stipulating that any recommendation arising from the Committee this date would be considered at the December 17, 2012 Council meeting; and, not at the December 3, 2012 Council meeting. Mr. J. Willmer commented that the deadline to add materials to the agenda for the December 3, 2012 Council meeting was the morning of November 28, 2012. Accordingly, given the late hour and that, this was a special Tuesday meeting; it would not be possible to add the Committee’s recommendation to that agenda. A motion was brought forward by Councillor Z. Janecki to amend Mayor Zehr’s motion to include the alternative alignment put forward by Mr. Karl Cober as part of the expanded scope of work proposed for the EA on the Strasburg Road extension. Mayor Zehr advised that should the Committee wish to consider Councillor Janecki’s amendment, than it would be advisable to resolve into an in-camera meeting to obtain the advice of the City’s solicitor as to the potential legal implications this may have on the City. Moved by Mayor C. Zehr Seconded by Councillor S. Davey "That an in-camera meeting of the Planning and Strategic Initiatives Committee be held this date to consider potential litigation matters, which are subject to solicitor-client privilege." Carried. The Committee then recessed at 12:12 a.m. and re-convened at 12:27 a.m., chaired by Councillor B. Vrbanovic and with all members present. Zehr - it was resolved: “That the additional Scope of Work for the Strasburg Road Extension from North of Stauffer Drive to New Dundee Road be approved, as outlined in Infrastructure Services Report INS-12-084; and, That the Purchase Order for SNC-Lavalin Inc., the consultant for this project, be extended for the amount of $490,096. plus applicable taxes to complete the Class Environmental Assessment for Strasburg Road Extension from North of Stauffer Drive to New Dundee Road; and, That the development charges funded budget for Strasburg Road Extension from North of Stauffer Drive to New Dundee Road be increased by $146,000.; and further, That consideration of this matter be referred to the December 17, 2012 Council meeting.” PLANNING & STRATEGIC INITIATIVES COMMITTEE MINUTES NOVEMBER 27, 2012 - 91 - CITY OF KITCHENER ADJOURNMENT 2.
