HomeMy WebLinkAboutCouncil - 2013-01-07 SSPECIAL COUNCIL MINUTES JANUARY 7, 2013 CITY OF KITCHENER A special meeting of City Council was held at 6:31 p.m. this date, chaired by Mayor C. Zehr with all members present. Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council considered Finance and Corporate Services Department report FCS-12-201 (R. Gosse), dated December 21, 2012 regarding appointments to the Centre in the Square Board of Directors. Moved by Councillor P. Singh Seconded by Councillor B. Vrbanovic "That Tim Jackson and David Strucke be re-appointed to the Board of the Centre-in-the- Square for a term ending December 31, 2013." Carried. Council considered Finance and Corporate Services Department report FCS-13-002 (R. Hagey), dated January 2, 2013 regarding contribution agreements related to the Community Infrastructure Improvement Fund. Moved by Councillor K. Galloway-Sealock Seconded by Councillor P. Singh "That the Deputy CAO, Finance and Corporate Services, be authorized to enter into contribution agreements on behalf of the Corporation of the City of Kitchener for funding under the Community Infrastructure Improvement Fund with regard to the following projects, said agreements to be subject to the satisfaction of the City Solicitor: Upgrades to Primary Trails; and, Expansion of Washroom Facilities in Victoria Park." Carried. Council considered Community Services Department report CSD-13-003 (K. Kugler), dated December 13, 2012 regarding soil and earthworks purchases for the Williamsburg Cemetery. In response to questions, Ms. K. Kugler, Director of Enterprise, confirmed that during the design work for Phase II of the Williamsburg Cemetery development, it was identified that approximately 100,000 cubic metres of additional soil was required to protect the groundwater table and provide sufficient depth for burials. She indicated that the original cost for this soil was estimated at $1.2M, which was not accounted for in the project's budget. She stated that the proposal to waive the Purchasing By- law's tendering requirements would enable the City to enter into an agreement with an adjacent developer, Mattamy Homes, to acquire the additional soil and associated earthworks for only $342,000. She noted there was sufficient capacity within the Williamsburg Cemetery Phase II Capital account to accommodate that expense. Moved by Councillor Y. Fernandes Seconded by Councillor D. Glenn-Graham "That the City of Kitchener's Purchasing By-law for tendering be waived to permit the purchase of topsoil and earthworks services from Tru-Villa Inc. & 2040796 Ontario Limited (Mattamy Homes) for development of Phase II at Williamsburg Cemetery; and further, That the Director of Supply Services be authorized to execute an agreement, satisfactory to the City Solicitor, with Tru-Villa Inc. & 2040796 Ontario Limited for the securement of topsoil and earthworks services." Davey "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2013-001 by the Clerk."
