Weylie, Chair, with the following members present: Mayor C. Zehr and Councillors B. Vrbanovic, G. Lorentz, J. Smola, J. Gazzola and Councillor M. Galloway. Officials Present: Ms. F. McCrea and Messrs. G. Stewart, J. Willmer, J. McBride, L. Masseo, R. Shamess and L.W. Neil. 1. DTS-03-182 DIXON STREET AND ECKERT STREET INTERSECTION TRAFFIC CONTROL MEASURES FOREST - ROCKWAY WARD The Committee considered Development and Technical Services Department report DTS-03-182 dated October 28, 2003 dealing with a recommendation to install an all-way stop control at the intersection of Dixon Street and Eckert Street. On motion by Councillor J. Smola- it was resolved: "That an all-way stop control be installed at the intersection of Dixon Street at Eckert Street; and further, That the Uniform Traffic By-law be amended accordingly." 2. DTS-03-183 KING STREET EAST FROM STIRLING AVENUE TO OTTAWA STREET NORTH ON-STREET PARKING BRIDGEPORT - CENTRE WARD AND WEST - VICTORIA PARK WARD The Committee received Development and Technical Services Department report DTS-03-183 dated October 27, 2003 dealing with a recommendation to prohibit parking on a portion of King Street East. In response to the Committee, Mr. J. McBride advised that the recommendation to remove the parking was identical with the redevelopment plan for King Street East that was presented to Council some time ago. On motion by Mayor C. Zehr - it was resolved: "That on-street parking be prohibited at anytime on both sides of King Street East from Stirling Avenue to Ottawa Street North; and further, That the Uniform Traffic By-law be amended accordingly." 3. DTS-03-186 DOON MILLS DRIVE AND TILT DRIVE INTERSECTION TRAFFIC CONTROL MEASURES SOUTH WARD The Committee considered Development and Technical Services Department report DTS-03-186 dated November 3, 2003 pertaining to a recommendation to install an all-way stop control at Doon Mills Drive and Tilt Drive. Councillor J. Gazzola referred to a letter received and distributed this date from R. Haalboom objecting to the recommendation. Mr. J. McBride briefly commented on the safety concerns related to the recommendation and advised that the issues raised in Mr. Haalboom's letter did not influence staff's recommendation. On motion by Mayor C. Zehr - it was resolved: "That an all-way stop control be installed at the intersection of Doon Mills Drive and Tilt Drive; and further, That the Uniform Traffic By-law be amended accordingly." DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 17~ 2003 -218- CITY OF KITCHENER 4. DTS-03-187 GLEN ROAD FROM PLEASANT AVENUE TO REX DRIVE ON-STREET PARKING - WEST - VICTORIA PARK WARD The Committee was in receipt of Development and Technical Services Department report DTS- 03-187 dated November 5, 2003 dealing with implementation of permit only parking on a portion of Glen Road. Mr. J. McBride responded to a question from Councillor J. Gazzola dealing with the property at the corner of Pleasant Avenue and Glen Road which would already have parking by permit because the property fronts on Pleasant Avenue. On motion by Councillor J. Gazzola - it was resolved: "That the 'Permit Only Parking' program be implemented between 8:00am and 8:00pm on both sides of Glen Road between Pleasant Avenue and Rex Drive; and, That each single family household residing on Glen Road between Pleasant Avenue and Rex Drive be provided, on an annual basis, with two (2) Residential Visitor Parking Permits at no cost to the residents; and further, That the Uniform Traffic By-law be amended accordingly." 5. DTS-03-189 DUKE STREET WEST AND WELLINGTON STREET NORTH INTERSECTION TRAFFIC CONTROL MEASURES BRIDGEPORT-CENTRE WARD The Committee considered Development and Technical Services Department report DTS-03-189 dated November 6, 2003 dealing with a recommendation to install all-way stop controls at the intersection of Duke Street West and Wellington Street North. It was noted that the intersection meets only two of four evaluation criteria for installation of an all-way stop control. However, Mr. J. McBride noted collision history of the intersection has overriding predominance over the remaining criteria and that was the reason the staff recommendation had been put forward. Councillor J. Smola commented that the public generally perceives four-way stop intersections to be safer but noted that some of the problem with this intersection relates to traffic from regional roads short- cutting through the area. At the request of Councillor J. Smola, Mr. J. McBride agreed to review the operation of the intersection after one year and advise the Committee of results. On motion by Councillor J. Smola - it was resolved: "That an all-way stop control be installed at the intersection of Duke Street West and Wellington Street North; and further, That the Uniform Traffic By-law be amended accordingly." VERBAL UPDATE 381 PIONEER TOWER ROAD REQUEST FOR DEFERRAL UNTIL SUCH TIME AS LAND APPRAISALS CAN BE COMPLETED AND CONSIDERED REPORTS DTS-03-122, DTS-03-147 AND DTS-03-172 SUBDIVISION APPLICATION 30T-96004 ZONE CHANGE APPLICATION ZC 96/30/P/JG JHS PROPERTIES LIMITED FAIRVIEW - GATEWAY WARD Mr. J. Willmer, advised that at the October 6, 2003 Development and Technical Services Committee meeting staff had presented options for consideration by the Committee with respect to the applications and preservation of the Sherk property. A recommendation was approved by the Committee; however, at the October 20, 2003 Council meeting it was deferred and referred to the meeting this date for further consideration and reads as follows: DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 17~ 2003 -219- CITY OF KITCHENER 6. VERBAL UPDATE 381 PIONEER TOWER ROAD REQUEST FOR DEFERRAL UNTIL SUCH TIME AS LAND APPRAISALS CAN BE COMPLETED AND CONSIDERED REPORTS DTS-03-122, DTS-03-147 AND DTS-03-172 SUBDIVISION APPLICATION 30T-96004 ZONE CHANGE APPLICATION ZC 96/30/P/JG JHS PROPERTIES LIMITED FAIRVIEW - GATEWAY WARD (CONT'D) "That with respect to Zone Change Application ZC 96/30/P/JG (381 Pioneer Tower Road - JHS Properties Limited) and Subdivision Application 30T-96004 considered within Development and Technical Services Department reports DTS-03-122, DTS-03-147 and DTS-03-172, planning staff be directed to prepare a report containing revised recommendations regarding the zoning by- law and subdivision conditions necessary to implement development option # 1 described in Development and Technical Services Department report DTS-03-172 as follows: 'Take the barn site (shown as Area 9 on Map No. 1 of the draft zoning by-law attached to report DTS-03-122) as park dedication, allow the proposed park site (Area 2) to be developed as residential lots on a cul-de-sac and provide playground equipment on part of the Open Space block immediately west of Area 2'." Mr. Willmer advised the Committee that parties have been meeting in regards to these applications and there appears to be a consensus on a land exchange involving JHS Properties Limited, the City and the Grand River Conservation Authority. He advised that staff were unable to put forward a recommendation at this time as land appraisals must be completed and considered before staff prepare a report and recommendation regarding this matter. It was resolved: "That further consideration of Development and Technical Services Department reports DTS-03-122, DTS-03-147 and DTS-03-172 pertaining to Zone Change Application ZC 96/30/P/JG and Subdivision Application 30T-96004 (381 Pioneer Tower Drive - JHS Properties Limited) be deferred to a future meeting of the Development and Technical Services Committee to allow for land appraisals to be completed." 7. DTS-03-188 ADDENDUM TO REPORT DTS-03-159 HOMER WATSON BOULEVARD / BLOCK LINE ROAD (SOUTHEAST CORNER) MUNICIPAL PLAN AMENDMENT APPLICATION MP 02/08/H/BS ZONE CHANGE APPLICATION ZC 02/06/H/BS (TWO PROPOSED BY- LAWS) REPEAL OF COUNTRY HILLS EAST COMMUNITY PLAN D.G.F. INVESTMENTS LIMITED FAIRVIEW - GATEWAY WARD The Committee was in receipt of Development and Technical Services Department report DTS- 03-188 dated November 7, 2003 dealing with applications for municipal plan amendment and zone change submitted by D.G.F. Investments Limited that were previously considered at the October 6, 2003 Development and Technical Services Committee meeting and recommended to City Council at its meeting held October 20, 2003. However, Council deferred and referred the Committee recommendations to the meeting this date for further consideration as a result of new information that was provided by the Region of Waterloo regarding traffic issues that may impact the D.G.F. development. It was noted in the report that City and Regional staff have met to discuss traffic matters with representatives of D.G.F. and a course of action has been agreed to in this regard. Mr. L. Masseo briefly summarized the report and pointed out that staff recommend a further deferral of the applications to allow traffic matters to be fully addressed. He did request that the recommendation in the staff report be changed to provide for deferral to the December 8, 2003 DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 17~ 2003 - 220- CITY OF KITCHENER 7. DTS-03-188 ADDENDUM TO REPORT DTS-03-159 HOMER WATSON BOULEVARD / BLOCK LINE ROAD (SOUTHEAST CORNER) MUNICIPAL PLAN AMENDMENT APPLICATION MP 02/08/H/BS ZONE CHANGE APPLICATION ZC 02/06/H/BS (TWO PROPOSED BY- LAWS) REPEAL OF COUNTRY HILLS EAST COMMUNITY PLAN D.G.F. INVESTMENTS LIMITED FAIRVIEW - GATEWAY WARD (CONT'D) meeting of the Development and Technical Services Committee rather than to a future meeting as parties were hopeful of having concluded this matter prior to the December 8th meeting. On motion by Councillor G. Lorentz - it was resolved: "That consideration of development applications submitted by DGF Investments Ltd. respecting Municipal Plan Amendment Application MP 02/08/H/BS and Zone Change Application ZC 02/06/H/BS (Homer Watson Boulevard and Block Line Road) be deferred and referred to the December 8, 2003 Development & Technical Services Committee meeting to allow traffic matters to be addressed. It is the opinion of this Committee that deferral of these applications is proper planning of the City." 8. DTS-03-176 207 CENTENNIAL COURT ZONE CHANGE APPLICATION ZC 031171CIBT - WAG N TRAIN INC. (MS. ELLIE ROSS) CHICOPEE - GRAND RIVER WARD The Committee was advised that an application has been received from Wag n Train Inc. (Ms. Ellie Ross) to change the zoning of lands known municipally as 207 Centennial Court. The purpose of the application was to add a special use provision allowing dog boarding as a permitted use in addition to the existing canine grooming and training facility currently permitted on the subject site which is located near the southeast corner of Centennial Court and Centennial Road. In this regard, the Committee considered Development and Technical Services Department report DTS-03-176 dated October 20, 2003 and a proposed by-law dated November 17, 2003 attached to the report. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. L. Masseo briefly outlined the purpose of the application and advised that staff had nothing further to add. No delegations were registered respecting this matter. On motion by Councillor B. Vrbanovic - it was resolved: "That Zone Change Application ZC 03/17/C/BT (207 Centennial Court -Wag n Train Inc. [Ms. Ellie Ross]) to change the zoning on the subject lands from General Industrial Zone (M-2) with Special Regulation Provision 31 R to General Industrial Zone (M-2) with Special Regulation Provision 31 R and Special Use Provision 322U, on lands legally described as Lot 8, Registered Plan 1698, in the City of Kitchener, be approved in the form shown in the "Proposed By-law", dated November 17, 2003, without conditions. It is the opinion of this Committee that approval of this application is proper planning for the City and is in conformity with the City's Municipal Plan." DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 17~ 2003 - 221- CITY OF KITCHENER 9. DTS-03-184 DIRECT DETECT INFORMATION UPDATE REPORT The Committee considered Development and Technical Services Department report DTS-03-184 dated October 27, 2003 prepared as an information update on the Direct Detect program. It was noted in the report that since completion of the two-year pilot project in October 2000, Direct Detect's customer base had increased from 240 to 1260 made up of 994 residences, 152 schools and 114 commercial properties, all of which generate approximately $150,200 in gross yearly income. In addition, it was pointed out that Direct Detect has created several collaborative partnerships within both the existing housing market and the new home industry through relationships with a real estate firm and a large local builder. It was anticipated that other builders will seek to participate in Direct Detect as well. Mr. Randy Kalan, Chief Fire Prevention Officer, briefly summarized the content of the report and responded to a number of questions from the Committee wherein he noted that preliminary discussions have taken place with the City of Cambridge regarding the program, ownership of the Direct Detect service and the towerless and wireless service not being affected by power failure. Further to the issue of legal protection of the service as raised by the Mayor, Councillor B. Vrbanovic requested that legal staff prepare a report for consideration by Council pertaining to protection of the trademark logo of Direct Detect and the towerless / wireless service. On motion by Councillor B. Vrbanovic - It was resolved: "That Development and Technical Services Department report DTS-03-184 (Direct Detect Information Update) be received." 10. DTS-03-178 LYNDALE SUBDIVISION - GRAND RIVER SOUTH PUMPING STATION - WAIVER OF CONSULTANT SELECTION PROCESS AND RETENTION OF ENGINEERING CONSULTANT CHICOPEE - GRAND RIVER WARD The Committee considered Development and Technical Services Department report DTS-03-178 dated October 7, 2003 dealing with consulting services pertaining to the Lyndale subdivision and the Grand River South pumping station. It was noted in the report that a request has been received from Auburn Developments Inc. that the City retain Stantec Consulting Limited as it's consultant for a sewage facility for the Grand River south pumping station and that Stantec has already completed extensive preliminary work on this project for the developer. Mr. R. Shamus briefly summarized the purpose of the report and advised in response to a question that pricing for the consultant's services was competitive. On motion by Councillor B. Vrbanovic - it was resolved: "That the City waive it's normal procedure for the selection of consultants and retain Stantec Consulting Limited, as our Engineering Consultant to complete the design, supervision, and construction services for the above referenced pumping station at their upset fee of $433,000.00 plus G.S.T." 11. DTS-03-190 UNIVERSITY AVENUE AND GLASGOW STREET CONVEYANCE OF LAND FOR PARKLAND AND ROAD WIDENING PURPOSES PLANS OF SUBDIVISION 30T-01202 AND 30T-01205 SUNVEST DEVELOPMENT CORPORATION - WEST - VICTORIA PARK WARD The Committee considered Development and Technical Services Department report DTS-03-190 dated November 13, 2003 dealing with conveyance of land to the City for parkland and road widening purposes in connection with plans of subdivision of Sunvest Development Corporation in DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES NOVEMBER 17~ 2003 the Glasgow Heights community. - 222- CITY OF KITCHENER 11. DTS-03-190 UNIVERSITY AVENUE AND GLASGOW STREET CONVEYANCE OF LAND FOR PARKLAND AND ROAD WIDENING PURPOSES PLANS OF SUBDIVISION 30T-01202 AND 30T-01205 SUNVEST DEVELOPMENT CORPORATION - WEST - VICTORIA PARK WARD (CONT'D) Mr. L. Masseo briefly summarized the report and advised that staff had nothing further to add. The Committee was circulated with a letter dated November 17, 2003 from T. Hardacre, Planning and Engineering Initiatives Limited, advising of support for the recommendation in the staff report. On motion by Mayor C. Zehr - it was resolved: "That Council agrees to accept the conveyance of lands legally described as Part Lot 34, German Company Tract, being Part 3, Plan 58R-6687 for parkland purposes and the lands described as Part 5 for road widening purposes in connection with Plans of Subdivision 30T-01202 and 30T-01205 (Sunvest Development Corp.); and further, That the Mayor and Clerk be authorized to execute an agreement for the conveyance to be prepared to the satisfaction of the City Solicitor." 12. CRPS-03-189 ENVIRONMENTAL COMMITTEE RECOMMENDATION RE: REQUEST OF M. WASlLKA TO ESTABLISH A WORKING GROUP TO DEVELOP A PLANNING TOOL TO MEASURE IMPACT OF URBAN EXPANSION ON AIR QUALITY The Committee considered Corporate Services Department report CRPS-03-189 dated October 14, 2003 dealing with a recommendation received from the City's Environmental Committee resulting from it's October 9, 2003 meeting regarding a request of Ms. Mary Ann Wasilka that the City establish a working group to develop a planning tool to measure the impact of urban expansion on air quality. On motion by Councillor B. Vrbanovic - it was resolved: "That no action be taken on the request of Mary Ann Wasilka to establish a working group to develop a planning tool to measure the impact of urban expansion on air quality." 13. CRPS-03-190 ENVIRONMENTAL COMMITTEE RECOMMENDATION RE: PROPOSALS FOR TOUGHER AIR QUALITY MEASURES The Committee considered Corporate Services Department report CRPS-03-190 dated October 14, 2003 dealing with recommendations arising from the October 9, 2003 Environmental Committee meeting on the subject of proposals for tougher air quality measures. Councillor B. Vrbanovic advised that an Environmental Committee member has proposed that the City become more proactive in respect to tougher air quality measures and indicated that he was in agreement with the recommendation. Councillor G. Lorentz was of the view that the City should do a better job of enforcing its own regulations before applying tougher measures to the wider community. Councillor Vrbanovic commented that at this time the undertaking boils down to an issue of better education. On motion by Councillor B. Vrbanovic - it was resolved: "That staff be directed to develop and post 'No Idling' signs outside City facilities, community centres, school zones and any other relevant sites." CRPS-03-190 ENVIRONMENTAL COMMITTEE RECOMMENDATION RE: PROPOSALS FOR TOUGHER AIR QUALITY MEASURES (CONT'D) - and - "That staff be directed to investigate the feasibility of incorporating into the City's Parking By-laws designated 'No Idling' zones within specified public areas and prepare a report for consideration at a future meeting of the Environmental Committee." 14.
