HomeMy WebLinkAboutFCS-13-016 - Surplus Lands - Rauch CourtREPORT TO:Committee of the Whole DATE OF MEETING: February 4, 2013 SUBMITTED BY: Steve Ross, Assistant City Solicitor, Ext. 7266 PREPARED BY: Steve Ross, Assistant City Solicitor, Ext. 7266 WARD(S) INVOLVED: 7 DATE OF REPORT: January 28, 2013 REPORT NO.: FCS13-016 SUBJECT: DECLARE SURPLUS TO THE CITY’S NEEDS VACANT LAND ON RAUCH COURT FOR THE PURPOSE OF CONVEYANCE TO THE ABUTTING LAND OWNERS RECOMMENDATION: That the City declare surplus to its needs vacant land legally described as Blocks 110 and 111, Registered Plan 1712 being Parts 1, 2, 3 and 4 on Reference Plan 58R-17536 to permit the conveyance of the said lands to the abutting land owners; and further That Legal Services be directed to convey the said lands to the abutting land owners at no cost, with all disbursements to be paid by the Subdivider, 603489 Ontario Inc., on terms and conditions satisfactory to the City Solicitor. BACKGROUND: Pursuant to Conditions of Draft Approval of Subdivision Application 30T-88003 Blocks 110 and 111 on Registered Plan 1712 were conveyed by the previous Subdivider to the City by Transfer/Deed of Land registered as Instrument Number 1030535 on March 5, 1990 for a temporary turning circle. The Conditions of Draft Approval of Subdivision Application 30T-94001 provided that the said temporary turning circle in the City’s ownership on Blocks 110 and 111, Registered Plan 1712 be removed and fully restored including landscaping, driveway ramps, curbs and gutters and conveyed to the abutting owners on Rauch Court all at the cost of the Subdivider. REPORT: The Subdivider wishes to proceed with the conveyance of Parts 1, 2, 3 and 4 on the attached Reference Plan 58R-17536 to the abutting owners on Rauch Court. î ó ï FINANCIAL IMPLICATIONS: The Subdivider has paid for the preparation of Reference Plan 58R-17536 and will be responsible for all legal fees and disbursements incurred with respect to the conveyance of each Part to the abutting owner(s). CONCLUSION: Engineering has confirmed that the temporary turning circle has been removed and restored to its satisfaction and the lands can be conveyed to the abutting land owners pursuant to the conditions of draft approval.
