HomeMy WebLinkAboutCouncil Minutes - 2000-12-11 SSPECIAL COUNCIL MINUTES DECEMBER 11, 2000 CITY OF KITCHENER A special meeting of City Council was held at 12:05 p.m. this date and Chaired by Mayor C. Zehr with all members present. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council considered a recommendation from the Finance and Administration Committee meeting of this date appointing members to the Citizen's Ad Hoc Advisory Committee on Council Compensation. Moved by Councillor J. Ziegler Seconded by Councillor G. Lorentz "That the following individuals be appointed to the Citizen's Ad Hoc Advisory Committee on Council Compensation: David A. Park, Jim Gibbons, Terry Flynn, Mac Voisin and Bruce Lauckner." Carried. Council considered a recommendation from the Finance and Administration Committee meeting of this date concerning the 2001 Council/Committee meeting schedule. Moved by Councillor G. Lorentz Seconded by Councillor B. Vrbanovic "That the year 2001 meeting schedule for Council and Committees as attached to the memorandum of G. Sosnoski, City Clerk, dated December 6, 2000, be approved." Carried. Mayor C. Zehr noted that given the reduced size of Council, it is important that all Councillors are kept informed when any member plans to be away for a Committee or Council meeting. Council considered a recommendation from the Finance and Administration Committee meeting of this date concerning the use of Victoria Park/Civic Square for the Festival of the Night celebration. Moved by Councillor G. Lorentz Seconded by Councillor J. Ziegler "That four food and one merchandise vendor be granted permission to locate in Victoria Park or on Civic Square during the Festival of the Night celebrations, December 31, 2000, provided the necessary licence is obtained, including Fire and Health approvals, with the Special Event Licence fee of $25. being applied; and further, That this celebration be granted an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code." Carried. Council considered a recommendation from the Finance and Administration Committee meeting of this date in regard to the Cemetery Division Tariff of Fees and Charges for 2001. Moved by Councillor J. Ziegler Seconded by Councillor G. Lorentz "That the 2001 Cemetery Tariff of Fees and Charges, as outlined in the Comprehensive Fee Review document, dated November 1, 2000, be approved; and further, That staff forward the Tariff of Fees and Charges to the Cemeteries Regulations Branch of the Ministry of Consumer and Commercial Relations for filing in order that the proposed fees become effective on January 1, 2001 ." Carried. SPECIAL COUNCIL MINUTES DECEMBER 11, 2000 - 621 - CITY OF KITCHENER Council was in receipt of revised Legal Department report LEG-00-074 (L. MacDonald), dated December 5, 2000, recommending execution of an agreement to permit the drilling of twelve test holes in City road allowances. Moved by Councillor C. Weylie Seconded by Councillor J. Ziegler "That the Mayor and Clerk be authorized to execute an agreement with Imperial Oil Limited to permit drilling of a total of twelve test holes in the Union Boulevard, Belmont Boulevard and Belmont Lane East road allowances." Carried. Council was in receipt of Legal Department report LEG-00-076 (J. Shivas), dated December 5, 2000, recommending consent to an assignment of the Offer to Purchase for a site in the Huron Industrial Park. Council agreed to amend the staff recommendation to remove the reference to Hybrid Turkeys Inc. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Ziegler "That the City consent to an assignment of the Offer to Purchase dated August 28, 2000 between lan Cook Construction Limited and The Corporation of the City of Kitchener to Nutreco Canada Inc. for the property described as Part 4 on Reference Plan 58R-9683 in Phase III of the Huron Industrial Park." Carried. Council was in receipt this date of Community Services Department report CSD-00-116 (D. Daly/F. Pizzuto), dated December 8, 2000, recommending execution of an agreement with the Walter Bean Grand River Community Trails Corporation with respect to a Millennium Grant application. Moved by Councillor G. Lorentz Seconded by Councillor J. Ziegler "That the Mayor and Clerk be authorized to execute an agreement dated December 11, 2000, with the Walter Bean Grand River Community Trails Corporation to acknowledge the City's commitment to the provisions of an agreement dated November 29, 2000, between the Walter Bean Grand River Community Trails Corporation and the Millennium Bureau of Canada with respect to Millennium Funds." Carried. Mayor C. Zehr requested Council's endorsement of the appointment of Councillor B. Vrbanovic to the Federation of Canadian Municipalities' Board of Directors. He noted that an opportunity arose for Councillor Vrbanovic to sit on the Board due to a number of vacancies, and that the appointment is conditional upon Council approval. Moved by Councillor C. Weylie Seconded by Councillor M. Galloway "That Council endorse the appointment of Councillor B. Vrbanovic to the Board of Directors of the Federation of Canadian Municipalities." Carried. Councillor B. Vrbanovic advised that he would be preparing a brief report for Council on December 18, 2000, outlining issues discussed at the FCM Board meeting. SPECIAL COUNCIL MINUTES DECEMBER 11, 2000 - 622 - CITY OF KITCHENER Council was advised of an additional in-camera item for discussion this date which is subject to solicitor- client privilege. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Ziegler "That an in-camera meeting of City Council be held immediately following this special meeting to consider two personal matters, a labour relations matter and two matters subject to solicitor-client privilege." Carried. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Ziegler "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2000 - 214 by the Clerk."
