HomeMy WebLinkAboutFCS-13-023 - Surplus Lands - Joseph Schoerg Crescent REPORT TO:Committee of the Whole DATE OF MEETING: March 4, 2013 SUBMITTED BY: Steve Ross, Assistant City Solicitor, Ext. 7266 PREPARED BY: Steve Ross, Assistant City Solicitor, Ext. 7266 WARD(S) INVOLVED: 3 DATE OF REPORT: February 15, 2013 REPORT NO.: FCS13-023 SUBJECT: DECLARE SURPLUS TO THE CITY’S NEEDS LAND ON JOSEPH SCHOERG CRESCENT FOR THE PURPOSE OF RE-CONVEYANCE TO THE SUBDIVIDER RECOMMENDATION: That the City declare surplus to its needs land legally described as Lot 38, Plan 58M-400 to permit the re-conveyance of the said lands to the Subdivider; and further That Legal Services be directed to re-convey the said lands to the Subdivider at no cost, on terms and conditions satisfactory to the City Solicitor. BACKGROUND: Pursuant to Conditions of Draft Approval of Subdivision Application 30T-95016 Lot 38, Plan 58M-400 was conveyed by the Subdivider, 346874 Ontario Limited, to the City by Transfer/Deed of Land registered as Instrument Number WR222386 on June 21, 2006 for temporary road purposes. The Conditions of Draft Approval of Subdivision Application 30T-95016 provided that once the said temporary road was no longer required, the Lot would be declared surplus to the City’s needs and re-conveyed to the Subdivider without cost. REPORT: Engineering Services has confirmed that the temporary road is no longer required and can be re-conveyed to the Subdivider. FINANCIAL IMPLICATIONS: The Conditions of Draft Approval stated that the land was to be re-conveyed to the Subdivider without cost. There will be minimal disbursements incurred to complete the re-conveyance. 3 - 1 CONCLUSION: Engineering has confirmed that the temporary road is no longer required and the lands can be re-conveyed to the Subdivider pursuant to the conditions of draft approval.
