HomeMy WebLinkAboutFCS-13-030 - Encroachment Agmt - 207 Coach Hill Drive REPORT TO:Committee of the Whole DATE OF MEETING: March 4, 2013 SUBMITTED BY: Jennifer Sheryer, Assistant City Solicitor x7265 PREPARED BY: Sherry Handsor, Legal Assistant x7856 WARD(S) INVOLVED: 9 DATE OF REPORT: February 26, 2013 REPORT NO.: FCS-13-029 SUBJECT: ENCROACHMENT AGREEMENT REQUEST – PROPOSED SIGN AT 81 YORK ST ON YORK ST ROAD ALLOWANCE RECOMMENDATION: “That, subject to obtaining all necessary approvals and obtaining a minor variance for the setback, the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with the property owner(s) and any mortgagee(s) of the property municipally known as 81 York St. (PIN 22421-0176) to legalize a proposed sign which will encroach approximately 0.8m, more or less, on the City’s York St. road allowance.” BACKGROUND: The owner would like to erect an updated sign for this property in a location where a previous sign has been located for the past ten years. The sign will be installed by a professional sign company. REPORT: A professional sign company, on behalf of the owner, has requested legalization of a proposed sign encroachment for an updated sign for this property to aid with the identification and overall presentation of the property. The previous sign has been removed as part of the scope of work in replacing the signs on the property and the proposed sign will be installed in the previous location which encroaches to a maximum of 0.8m onto the City’s York St. road allowance. It will be requirements of the encroachment agreement that the owner obtain minor variance approval for the setback and a sign permit. Attached is a drawing illustrating the location of the proposed sign. Due to timing of Council meetings, this matter is being brought to Council in advance of obtaining all necessary staff approvals. 9 - 1 ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: Efficient and Effective Government – Customer Service FINANCIAL IMPLICATIONS: N/A COMMUNITY ENGAGEMENT: Community engagement is not necessary for this process. Internal staff and outside utility companies are circulated for their comments and/or approval.
