SPECIAL COUNCIL MINUTES
CITY OF KITCHENER
A special meeting of City Council was held at 12:45 p.m. this date and Chaired by Mayor C. Zehr with all
members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Council considered a recommendation arising from the Finance and Administration Committee meeting
of this date relative to the proposed purchase by the City of a heritage log building formerly located at
146 Pioneer Drive.
Moved by Councillor J. Haalboom
Seconded by Councillor K. Taylor-Harrison
"That the City of Kitchener purchase the log house discovered at 146 Pioneer Tower Road
from The Timeless Materials Company (Kieswetter) for a cost of $23,000.00 plus applicable
taxes, to be taken out of Capital Contingency, with such cost to include purchase of original
shell timbers, joists, floorboards, cleansing of all timbers, plotted blueprints of tagging
sequence, archival documentation and storage consultation; and further,
That arrangements be made through the City to load, relocate, stop and secure the timbers of
the log house, discovered at 146 Pioneer Tower Road, in the Guelph Street storage facility;
and further,
That City staff, in consultation with Heritage Kitchener, further review alternatives for the
reconstruction of the log house discovered at 146 Pioneer Tower Road, and report back to City
Council within six months time; and further,
That the Mayor and Clerk be authorized to execute an agreement with The Timeless Material
Company (Kieswetter), to the satisfaction of the City Solicitor, relating to their offer to buy back
the log house, discovered at 146 Pioneer Tower Road, for $20,000.00."

Council was in receipt of a report from J. Koppeser, Manager of Licensing, dated March 30, 1999
recommending approval of a request from the Forest Heights Community Association for permission
to operate a refreshment stand during a proposed fireworks display.

Seconded by Councillor C. Weylie
"That the Forest Heights Community Association, c/o Forest Heights Community Centre, 429
Westheights Drive, Kitchener, Ontario, N2N 1M3, be granted permission to operate a
refreshment stand at Westheights Park, Kitchener, on May 24, 1999, provided the necessary
license and health approvals are obtained; and further,
That the necessary permit be obtained from the Fire Prevention Office to allow for a fireworks
display."

Council considered a recommendation arising from the Finance and Administration Committee
meeting this date relative to various changes in respect to the licensing and hours of operation of
Downtown hot dog carts and outside patios.

"That a Street Vendor's By-law be given three meetings at the Special Council meeting on
April 12, 1999, with the following hours of operation imposed for:
a) Hot Dog/Refreshment Vehicle; 9 a.m. to 11:59 p.m.,

b) Portrait Artist Stand: 9 a.m. to 11:59 p.m.,
c) Flower Stand: 9 a.m. to 11:59 p.m.; and further,
That encroachment agreements permitting Hot Dog Carts on public property shall contain
hours of operation, namely: 9 a.m. to 11:59 p.m.; and further,
That staff prepare amendments to the City of Kitchener Municipal Code, specifically Chapter
584 - Refreshment Places and Chapter 586 - Refreshment Vehicles, to impose a condition
restricting the hours of operation to 9 a.m. to 11:59 p.m.; and further,
That staff prepare the necessary amendments to the City of Kitchener Municipal Code to
establish a licence fee of $205.00 for an extension of use of a valid licensed place of
refreshment."

Council then considered recommendations in regard to various encroachment agreements in the
Downtown, consideration of which were deferred at the March 29, 1999 Council meeting and referred
to the meeting this date.

"That, subject to obtaining all necessary approvals and the payment of all required licence fees,
the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the
City Solicitor, with the owner(s) of Sol-Mar Restaurant to operate a hot dog cart in front of Sol-Mar
Restaurant located at 323 King Street West for the 1999 season."

"That, subject to obtaining all necessary approvals and the payment of all required licence fees,
the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the
City Solicitor, with the owner(s) of Go Internet Cafe to permit the use of six feet, six inches (6'6"),
more or less, of sidewalk directly in front of Go Internet Cafe, located at 10 King Street East, for
the operation of a sidewalk patio for the 1999 season."

"That, subject to obtaining all necessary approvals and the payment of all required licence
fees, the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory
to the City Solicitor, with the owner(s) of The Strand to permit the use of four feet eleven
inches (4'11"), more or less, of sidewalk directly in front of The Strand located at 185 King
Street West, for the operation of a sidewalk deck for the 1999 season."

"That, subject to obtaining all necessary approvals and the payment of all required licence fees,
the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the
City Solicitor, with the owner(s) of Dandy's Restaurant to permit the use of five feet (5') of
sidewalk directly in front of Dandy's Restaurant located at 85 King Street West, for the operation
of a sidewalk patio for the 1999 season."

"That, subject to obtaining all necessary approvals and the payment of all required licence fees,
the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the
City Solicitor, with the owner(s) of Slices Restaurant to permit the operation of a hotdog cart in
front of Slices Restaurant for the 1999 season and the use of eleven feet seven inches (11'7"),
more or less, of sidewalk directly in front of Slices Restaurant located at 300 King Street West, for
the operation of a sidewalk patio for the 1999 season."

"That, subject to obtaining all necessary approvals and the payment of all required licence fees,
the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the
City Solicitor with the owner(s) of Just Desserts to permit the use of seven feet six inches (7'6"),
more or less, of sidewalk directly in front of Just Desserts located at 273 King Street West, for the
operation of a sidewalk patio for the 1999 season."

"That, subject to obtaining all necessary approvals and the payment of all required licence fees,
the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the
City Solicitor, with the owner(s) of The Alley to permit the use of eleven feet six inches (11'6"),
more or less, of sidewalk directly in front of The Alley located at 215-219 King Street West, for the
operation of a sidewalk patio for the 1999 season."

"That, subject to obtaining all necessary approvals and the payment of all required licence fees,
the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the
City Solicitor, with the owner(s) of Big City Donut to permit the use of six feet (6'), more or less, of
sidewalk directly in front of Big City Donut located at 24 Gaukel Street, for the operation of a
sidewalk patio for the 1999 season."

"That, subject to obtaining all necessary approvals and the payment of all required licence fees,
the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the
City Solicitor, with the owner(s) of Reggie's to operate a hot dog cart in front of Reggie's located
at 1 King Street West for the 1999 season."

Mayor C. Zehr advised of an additional item for in-camera discussion this date involving solicitor-
client privilege.

"That an in-camera meeting of City Council be held immediately following this special meeting
to consider two personal matters, a land acquisition matter, a labour relations matter and three
matters subject to solicitor-client privilege."

"That leave be given the Mover and Seconder to introduce the following by-laws and that the
same be taken as read a first, second and third times, be finally passed and numbered serially by
the Clerk

A by-law to licence Street Vendors in Victoria Park and at specific street intersections,
expiring December 31, 1999

(b)
To confirm all actions and proceedings of the Council
(By-law No. 99-59)
