HomeMy WebLinkAboutCouncil Minutes - 1999-06-14 SJUNE 14, 1999 SPECIAL COUNCIL MINUTES CITY OF KITCHENER A special meeting of City Council was held at 12:40 p.m. this date and Chaired by Mayor C. Zehr with all members present. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council was in receipt of a report from J. Shivas, City Solicitor, dated June 8, 1999 relative to a proposed purchase and sale in respect to the linking of Trillium Drive. Moved by Councillor M. Yantzi Seconded by Councillor T. Galloway "That the City hereby consents to the sale of Lot 5 according to Registered Plan 58M-98, by Huron Woods Development Corporation to National Engineered Fasteners Inc., or as it may direct; and, That the City hereby confirms that it shall purchase the remaining land, namely, Lot 4, Registered Plan 58M-98 according to the terms and conditions of the Offer to Sell from Huron Woods Development Corporation, accepted by the City on July 20, 1998, save and except for the purchase price previously reduced to reflect the sale of Lot 3, now further reduced to reflect the sale of Lot 5, and to the sum of $195,975 which is the purchase price of Lot 4 at the rate of $75,000/acre; and further, That if the sale of Lot 5 to National Engineered Fasteners Inc., or as it may direct, is not completed, the Offer to Sell from Huron Woods Development Corporation accepted by the City shall remain in full force and effect respecting Lots 4 and 5." Carried. Council then considered a recommendation arising from the Public Works and Transportation Committee meeting of this date relative to changes in the natural gas supply delivery rates and other ancillary rates. Moved by Councillor J. Ziegler Seconded by Councillor K. Taylor-Harrison "That, effective June 1, 1999, the proposed rates for natural gas delivery outlined in Appendix 'A' attached to the June 6, 1999 report from D. Quinn, Director of Utilities, be adopted; and, That, effective June 1, 1999, the proposed rate of $0.1155 per cubic meter for natural gas supply be adopted; and further, That, effective June 1, 1999, the proposed rate of $0.035268 for natural gas transportation be adopted." - and - "That, effective July 1, 1999, the proposed rates for rental water heaters as outlined in revised Appendix 'A' to the June 6, 1999 report from D. Quinn, Director of Utilities, presented to the Public Works and Transportation Committee on June 14, 1999, be adopted." - and - "That, effective July 1, 1999, the proposed rates for appliance service as outlined in Appendix 'B' attached to the June 6, 1999 report from D. Quinn, Director of Utilities, be adopted." Carried. Council was in receipt this date of Business and Planning Services Department Report No.99/92 (J. Jantzi/B. Stanley )recommending an extension of the inspection period in the Canderel Stoneridge Properties Inc. agreement of purchase and sale relative to lands in the Lancaster Corporate Centre. JUNE 14, 1999 SPECIAL COUNCIL MINUTES - 262 - CITY OF KITCHENER Councillor T. Galloway enquired whether Council should be concerned with the extension given that there was another potential purchaser of the property. Mr. J. Shivas replied that to the best of his knowledge this is strictly a problem of insufficient time to make the necessary arrangements. Moved by Councillor J. Ziegler Seconded by Councillor G. Lorentz "That in conjunction with the Offer to Purchase Lots 4,5,6,7,8,9,10,11 & 12, Reference Plan 58R-10893, submitted by Canderel Stoneridge Properties Inc. and accepted by Kitchener City Council on May 17, 1999, the City extend the first inspection period by 18 days to expire on July 5, 1999 rather than June 17, 1999; and further, That the Mayor and Clerk be authorized to execute any necessary documentation required by the City Solicitor." Carried Council was in receipt of a report from J. Koppeser, Manager of Licensing, dated June 11, 1999 in regard to a request from Dandy's Restaurant for permission to operate a barbecue and patio on King Street during Cruise Night and also to sell alcoholic beverages on the patio. The staff report recommends approval of the patio and barbeque, but refusal of permission to sell alcoholic beverages. Moved by Councillor B. Vrbanovic Seconded by Councillor T. Galloway "That the request of Dandy's Restaurant for permission to operate a barbecue and have a patio on King Street during Cruise Night on July 9, 1999 be approved, provided the necessary Special Event Licence, including Health and Fire approvals, is obtained, the licence fee in this regard to be waived; and further, That the request for permission to sell alcoholic beverages on the patio, be refused." Carried Council was in receipt of a memorandum from L. Gordon, Manager of Purchasing, dated June 3, 1999 recommending the awarding of Tender T 99-041 (Furniture - New Fire Hall). Moved by Councillor B. Vrbanovic Seconded by Councillor K. Taylor-Harrison "That Tender T 99-041, Furniture - New Fire Hall, be awarded as follows: · Dispatch Furniture to Lordly Jones Limited, Hamilton, at a total bid price of $26,612 plus G.S.T. and P.S.T.; · General Furniture and Seating to R.C. Dawson, Kitchener, at a total bid price of $72,915.79 plus G.S.T. and P.S.T." Carried. On motion, the meeting recessed at 12:50 p.m. and reconvened at 11:25 p.m., chaired by Mayor C. Zehr and with all members present. Moved by Councillor B. Vrbanovic Seconded by Councillor T. Galloway "That ratification of the recommendations of the Finance and Administration Committee of this date concerning the rationalization/regionalization of municipal services be deferred and referred to the June 21, 1999 Council meeting; and further, That in the interim, the Finance and Administration Committee recommendations in this regard be forwarded to the Region by June 16, 1999 along with an indication that they will be considered by Council on June 21, 1999." Galloway "That leave be given the Mover and Seconder to introduce the following by-law for three readings and that the same be taken as read a first, second and third times, be finally passed and numbered 99-103 by the Clerk: (a) To confirm all actions and proceedings of the Council."
