SEPTEMBER 27, 1999
CITY OF KITCHENER
A special meeting of City Council was held at 12:30 p.m. this date and Chaired by Mayor C. Zehr with all
members present.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Moved by Councillor J. Ziegler
Seconded by Councillor T. Galloway
"That the City accept the Offer to Purchase from Top Fuelers Inc. for Lot 130E in Phase I of
the Huron Business Park, known as Parts 13, 14, 15, 16, 17 and 18 on Reference Plan 58R-
10219 having an area of approximately 1.0719 acres at a total purchase price of $66,120.00;
and further,
That the Mayor and Clerk be authorized to execute any documentation in this regard required
by the City Solicitor."
Carried.
Council then considered a recommendation arising from the Finance and Administration Committee
meeting this date related to a lot maintenance matter.
Moved by Councillor J. Ziegler
Seconded by Councillor John Smola
"That at the September 27, 1999 Special Council meeting, three readings be given to a by-law
authorizing the removal of waste material from 16 Gildner Street at the property owner's
expense."
Carried.
Mayor C. Zehr advised of an additional item for in-camera discussion this date which is subject to
solicitor-client privilege.
Moved by Councillor C. Weylie
Seconded by Councillor M. Yantzi
"That an in-camera meeting of City Council be held immediately following this special meeting
to consider a labour relations matter, three land acquisition matters and four matters subject to
solicitor-client privilege."
Carried.
The meeting then recessed at 12:35 p.m. and reconvened at 5:53 p.m., Chaired by Councillor M.
Yantzi with all members present except Mayor C. Zehr.
Council then considered a staff recommendation arising from the in-camera meeting earlier this date.
Moved by Councillor B. Vrbanovic
Seconded by Councillor K. Taylor-Harrison
"That the City accept the Offer from 673195 Ontario Inc. to sell their property described as Part
of Lot 34 according to Registered Plan 393 designated as Part 1 on Reference Plan 58R-5790,
municipally known as 55 Joseph Street, for the sum of Two Hundred Forty Thousand Dollars
($240,000.00), said Offer being conditional upon the Vendor obtaining the written approval of
all registered encumbrancers as to the final acceptance of this Offer and their agreement to
discharge their encumbrances; and further,
That the Mayor and Clerk be authorized to execute any necessary documentation as required
by the City Solicitor."

Councillor John Smola requested to be recorded as opposed to accepting the Offer.
Moved by Councillor Jake Smola
Seconded by Councillor K. Taylor-Harrison
That leave be given the Mover and the Seconder to introduce the following by-laws and that
the same be taken as read a first, second and third times, be finally passed and numbered
serially by the Clerk.
(a) To confirm all actions and proceedings of the Council
(By-law 99-167)
(b)
Being a by-law to authorize the carrying out of the provisions of Chapter 650 of the City
of Kitchener Municipal Code with respect to the property known municipally as 16
Gildner Street, Kitchener
(By-law 99-168)
On motion, the meeting adjourned at 5:55 p.m.
