HomeMy WebLinkAboutCouncil Minutes - 1999-12-06 SSPECIAL COUNCIL MINUTES DECEMBER 6, 1999 CITY OF KITCHENER A special meeting of City Council was held at 1:30 p.m. this date and Chaired by Mayor C. Zehr with all members present except Councillor T. Galloway. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council was in receipt of Business & Planning Services Department report BPS 99/192 (G. Borovilos) recommending acceptance of an Offer to Sell Site 95 in Phase 2 of the Huron Business Park. Moved by Councillor C. Weylie Seconded by Councillor J. Ziegler "That the City accept an Offer to Sell Part 30, Reference Plan 58R-5668 from K.S.K. Framing Construction Ltd. in Phase 2 of the Huron Business Park for the sum of $98,810.00, said Offer involving re-purchase by the City; and further, That the Mayor and Clerk be authorized to execute any necessary documentation required by the City Solicitor." Carried. Council then considered recommendations arising from the Finance and Administration Committee meeting of this date concerning local governance reform. Recorded votes were requested. Moved by Councillor G. Lorentz Seconded by Councillor K. Taylor-Harrison "WHEREAS over the past several months the seven Kitchener, Waterloo, Woolwich, Wilmot, Wellesley and Waterloo have endorsed a two-tier system; and, lower tier municipalities (Cambridge, North Dumfries) and the Region of WHEREAS in recent days it has become apparent that the Province is moving away from a two- tier system in the four "A" list municipalities; and as a result of these actions, the two viable options that should be considered for local governance within the Regional Municipality of Waterloo are a single-tier, one municipality model or a single-tier, two municipality model; THEREFORE BE IT RESOLVED that Kitchener City Council requests its senior staff to approach and work with the senior staff of the other six lower tier municipalities and senior staff from the Region of Waterloo to review and report on the merits of both a one municipality and two municipality model for the communities which presently make up the Regional Municipality of Waterloo; AND FURTHER, that senior staff report back to all local tier Councils by the first Council or Committee meetings in January, 2000." In Favour: Mayor C. Zehr, Councillors K. Taylor- Harrison, G. Lorentz, J. Ziegler, B. Vrbanovic, Weylie, John Smola and Jake Smola. Contra: Councillors J. Haalboom and M. Yantzi. Motion Carried. Moved by Councillor G. Lorentz Seconded by Councillor K. Taylor-Harrison "That the City of Kitchener requests the following standard set of principles be adopted when considering any amalgamated municipality, whether it be a one or two municipality model: (a) preserve the distinctive characteristics and historic names of existing individual communities; SPECIAL COUNCIL MINUTES DECEMBER 6, 1999 - 518 - CITY OF KITCHENER (b) recognize and preserve the distinctive nature of neighbourhood associations/groups for social and recreational purposes; (c) recognize the cultural diversity of our communities; (d) recognize the importance and necessity of retaining an identifiable rural component in planning, environmental and governance matters; (e) recognize and preserve the distinctive value of financial prudence for which our combined municipalities are known; (f) insist that the savings resulting from further local government reform be retained at the local level for the reduction of property taxes or for additional required services, rather than repatriated by the Province in the form of reduced transfer payments or further downloading of services; (g) maintain the high quality level of service delivery to all communities; (h) ensure the continuance of full and open access to Council by residents and taxpayers on all matters of community interest; (i) preserve and enhance the supportive role that our municipalities have given to economic growth resulting in one of the lowest rates of unemployment in Canada; (J) continue to promote the high level of public volunteer involvement with the delivery of services and quality of life activities." Carried Unanimously. Moved by Councillor G. Lorentz Seconded by Councillor B. Vrbanovic "That an in-camera meeting of City Council be held immediately following this special meeting to consider three labour relations matters, two personal matters and four matters subject to solicitor-client privilege." Carried. The meeting then recessed at 1:35 p.m. and re-convened at 5:17 p.m. Chaired by Mayor C. Zehr with all members present except Councillor T. Galloway. A delegation was in attendance in support of Zone Change Application ZC 99/24/Q/PB - 384 Queen Street South. The recommendation approved by the Planning and Economic Development Committee at its meeting held earlier this date was referred to this meeting for consideration of both ratification and three readings of the relevant zoning by-law. Moved by Councillor C. Weylie Seconded by Councillor M. Yantzi "That Zone Change Application ZC 99/24/Q/PB (384 Queen Street South - Catholic Family Counselling Centre), to add special use provision 274U on lands zoned Existing Use Zone (E- 1) and legally described as German Company Tract, Subdivision of Lot 17, Lots 171 and 172 and Part Lots 169 and 170 and Plan 58, Part Lot 11, be approved in the form shown in the attached "Proposed By-law", dated November 12, 1999, without conditions. It is the opinion of this Committee that approval of this application is proper planning for the City and is in conformity with the City's Municipal Plan." Carried. SPECIAL COUNCIL MINUTES DECEMBER 6, 1999 - 519 - CITY OF KITCHENER On motion by Councillor C. Weylie, seconded by Councillor M. Yantzi, it was agreed that the by-law for Zone Change Application ZC 991241QIPB (384 Queen Street South - Catholic Family Counselling Centre) would receive three readings this date. Councillor Jake Smola raised traffic concerns regarding signage for right turn prohibitions involving a few intersections on the east side of the City. He indicated that he would be requesting Traffic staff to review these issues and also asking that staff contact Sgt. Chipman, Waterloo Regional Police, in this regard. Councillor Jake Smola requested that when a report is complete, it be brought to the Public Works and Transportation Committee for consideration. The Council meeting then recessed at 5:28 p.m. to allow consideration of the balance of the in- camera agenda of this date and re-convened at 7:48 p.m. Chaired by Mayor C. Zehr with all members present except Councillors M. Yantzi, C. Weylie and T. Galloway. Pursuant to Section 25.8.9 of Council's Procedural By-law, it is noted that Councillor B. Vrbanovic disclosed a pecuniary interest in respect to one of the labour relations matters discussed in-camera this date. Moved by Councillor J. Ziegler Seconded by Councillor G. Lorentz "That leave be given the Mover and Seconder to introduce the following by-laws for three readings and that the same be taken as read a first, second and third times, be finally passed and numbered serially by the Clerk: (a) Being a by-law to further amend By-law No. 88-171 to designate private roadways as fire routes and to prohibit parking thereon. (By-law No. 99-218) (b) Being a by-law to further amend By-law No. 88-172 to authorize certain on-street and off- street parking of vehicles for use by physically handicapped persons, and the issuing of permits in respect thereof. (By-law No. 99-219) (c) To confirm all actions and proceedings of the Council. (By-law No. 99-220) (d) Being a by-law to amend By-law 85-1, as amended, known as the Zoning By-law for the City of Kitchener - Catholic Family Counselling Centre - Queen Street South.
