ADDENDUM TO REPORT FCS-13-031
ENCROACHMENT AGREEMENT REQUEST – EXISTING
STEPS AT 87-93 CEDAR ST S ON CEDAR ST S ROAD
ALLOWANCE
RECOMMENDATION:
“That, provided all necessary approvals and a complete submission for a minor revision
to Site Plan Application SP11/072/C/AP in compliance with condition #1 of minor variance
A2013-010 to the satisfaction of the Manager of Site Development and Customer Service
are obtained, the Mayor and Clerk be authorized to execute an Encroachment Agreement,
satisfactory to the City Solicitor, with the property owner(s) and any mortgagee(s) of the
property municipally known as 87-93 Cedar St. S. (PIN 22503-0092 and 22503-0091) to
legalize existing steps which encroach approximately 0.39m, more or less, on the City’s
Cedar St. S. road allowance.”
BACKGROUND:
The matter was brought to Council on March 4, 2013 at which time it was deferred for Council to
receive further information. The matter is being brought back to Council for final consideration
and new details are being provided.
REPORT:
The developer has submitted new drawings showing a reduced encroachment of the existing
concrete steps to 0.39m instead of the previous encroachment of 0.92m onto the City’s Cedar
St. S. road allowance. A new recommendation has been included to reflect the reduced
measurement of the encroachment. Attached is a drawing illustrating the location and revised
dimensions of the steps.

FINANCIAL IMPLICATIONS:
Fees have been paid in accordance with the City’s fee schedule.
COMMUNITY ENGAGEMENT:
Community engagement is not necessary for this process. Internal staff and outside utility
companies are circulated for their comments and/or approval.
CONCLUSION:
Once all appropriate staff and outside utility companies reviews and approvals have been
obtained, it would be in order to authorize the execution of an encroachment agreement with the
property owner(s) and any mortgagee(s) of 87-93 Cedar St. S.
