SUBJECT: Transfer of Land from Region of Waterloo and Assumption
of Laneway by Region of Waterloo – Weber Street Grade
Separation Project
RECOMMENDATION:
That subject to receipt of appropriate Reference Plans, the City of Kitchener purchase
lands from the Region of Waterloo that form part of a laneway road allowance for
nominal consideration, subject to any easements or encroachments required by the
Region of Waterloo or others (Parcels “A” and “B” on attached Appendix “A”);
That the Mayor and Clerk be authorized to execute any documentation in this regard
required by and to the satisfaction of the City Solicitor; and
That the City of Kitchener support in principle the assumption by the Region of
Waterloo of a portion of an opened lane that lies west of Weber street, between
Breithaupt and Wellington, required for the widening of Weber Street (Parcel “C” on
attached Appendix “A”).

REPORT:
The City is working with the Region of Waterloo in facilitating the widening and grade
separation of Weber Street at the CN tracks north of Victoria.
On lands expropriated or purchased by the Region, the Region will be constructing a
hammerhead for the end of the unnamed City of Kitchener lane on the west side of Weber
Street, to accommodate vehicular turn around for the public and snow removal vehicles. Upon
completion of the construction of the hammerhead, the City of Kitchener will purchase from the
Region the additional lands required for the hammerhead for nominal consideration.
Similarly, a service road will be installed at the Region’s cost to serve houses cut-off by the
grade separation that formerly fronted Weber Street on the east side of Weber. Ultimately,
this road will be downloaded to the City of Kitchener.

As part of the same project the Region requires a portion of an unnamed lane that runs
westward from Weber Street. The Region will pass a by-law to assume the lane from the City
as it is a public, open road. The Region will undertake the road closing or renaming
procedure. It is the Region’s practise to, where possible, obtain permission from the lower tier
municipality in these circumstances.

CONCLUSION:
Staff recommends that Council accept the Offer to Sell for nominal consideration as well as
indicate support for the uploading that portion of the lane required for the expansion of Weber
Street.
