CITY OF KITCHENER
A special meeting of City Council was held at 11:05 a.m. and Chaired by Acting Mayor T. Galloway with
the following members present: Councillors John Smola, C. Weylie, J. Ziegler, M. Yantzi, K. Taylor-
Harrison and G. Lorentz.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Acting Mayor T. Galloway advised that no action is required at this time in regard to the tax arrears item
involving 227 Louisa Street. The recommendation of the Finance and Administration Committee
involving no action on the owner's request for an extension of the deadline for payment of the
cancellation price will be dealt with at the regular Council meeting on February 28, 2000.
Acting Mayor T. Galloway advised that Councillor Jake Smola had requested deferral of the appointment
to the Waterloo Region Airport Noise Management Committee.
Moved by Councillor J. Ziegler
Seconded by Councillor G. Lorentz
"That Council consideration of an appointment to the Waterloo Region Airport Noise
Management Committee be deferred and referred to the February 28, 2000 Council meeting."
Carried.
It was noted that the terms of reference for the Restructuring Co-ordinating Committee are not available;
and, staff were directed to list this item on the February 28, 2000, Committee of the Whole agenda for
consideration.
Council was in receipt of a report from L. MacDonald dated February 17, 2000, recommending the
execution of encroachment agreements pertaining to the sale of the former Goudies building.
Moved by Councillor M. Yantzi
Seconded by Councillor K. Taylor-Harrison
"That the Mayor and Clerk be authorized to execute an encroachment agreement, satisfactory to
the City Solicitor, with the owner(s) of Part Lot Marked "Pts of 2 & 7", Registered Plan 401
being Part 1 on Plan 58R-12285, municipally known as 8 Queen Street North, to legalize an
existing concrete loading dock shown as Part 6 on Plan 58R-12285 as it encroaches 1.5
metres, more or less, at its widest point, onto Goudies Lane."

"That the Mayor and Clerk be authorized to execute an encroachment agreement, satisfactory
to the City Solicitor, with the property owner(s) of Part Lot Marked "Pts of 2 & 7", Registered
Plan 401 being Part 1 on Plan 58R-12285, municipally known as 8 Queen Street North, to
legalize the upper level of the City's Duke and Ontario Parking Garage as it overhangs the
building at 8 Queen Street North by .116 metres, more or less, said encroachment being
shown as Part 4 on Reference Plan 58R-12285."
Carried.
Councillor K. Taylor-Harrison previously gave notice that she would request reconsideration this date of
an earlier motion of no action on a proposal for the City to undertake a facade restoration involving 156-
158 King Street West. Councillor Taylor-Harrison requested that this matter be considered at the
February 28, 2000 meeting due to the absence of several members of Council.
Council was previously advised of an additional matter for in-camera discussion this date which is
subject to solicitor-client privilege.

Seconded by Councillor C. Weylie
"That an in-camera meeting of City Council be held immediately following this special meeting to
consider a personal matter, two land acquisition matters, a labour relations matter, a litigation
matter and two matters subject to solicitor-client privilege."
Carried.
Moved by Councillor J. Ziegler
Seconded by Councillor M. Yantzi
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and number 2000-31 by the Clerk."
Carried.
On motion, the meeting adjourned at 11:10 a.m.
