HomeMy WebLinkAboutCouncil Minutes - 2000-02-07 SSPECIAL COUNCIL MINUTES February 7, 2000 CITY OF KITCHENER A special meeting of City Council was held at 12:00 Noon this date and Chaired by Acting Mayor T. Galloway with the following members present: Councillors G. Lorentz, J. Ziegler, Jake Smola, John Smola, J. Haalboom, C. Weylie and M. Yantzi. Councillor K. Taylor-Harrison was in attendance for part of the meeting. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council was in receipt of a recommendation from the Kitchener Downtown Advisory Committee endorsing a facade restoration for the City-owned property at 156-158 King Street West. Consideration of the recommendation was referred by Council on January 31, 2000, to the meeting this date. They were also in receipt of a recommendation from Heritage Kitchener in support of the City undertaking the facade restoration. Council was in receipt of a report from D. Corks, dated February 2, 2000, in response to Council's previous request for additional information. The report outlines two options in regard to the restoration; the first, involving the City undertaking the restoration prior to sale of the property; and, the second, wherein restoration would be imposed as a condition of sale and be undertaken by the new owner. Councillor J. Ziegler put forward a motion, seconded by Councillor J. Haalboom, undertake a facade restoration of the City-owned property at 156-158 King recommended by Wayne Pearce, Loans/Incentives Co-ordinator. directing staff to Street West, as Councillor John Smola asked that he be recorded as opposed to the City undertaking such a restoration, as the property was purchased on the understanding that it would be re-sold as quickly as possible, and with no consideration of additional expenditures. Councillor J. Haalboom referred to the Heritage Kitchener report circulated this date and indicated her support for that recommendation as well as the recommendation of the Kitchener Downtown Advisory Committee. She noted that the building is on the City's Heritage Inventory and has both architectural and historic significance. Councillor Galloway suggested that the recommendation of Heritage Kitchener would not be dealt with as it merely indicates support for one of the two options in the staff report. The motion by Councillor J. Ziegler, seconded by Councillor J. Haalboom, directing that the City undertake the restoration was voted on and was Lost on a Tie Vote. Council was in receipt of a report from P. Houston dated February 3, 2000, recommending execution of a demutualization form which would result in a cash redemption of the City's share allocation relative to its' group life insurance policy. The report indicates an estimated value of $240,000 - $360,000. Moved by Councillor J. Ziegler Seconded by Councillor G. Lorentz "That the Mayor and Clerk be authorized to execute Sun Life Assurance Company of Canada's demutualization form consenting to the redemption in the form of cash of the share allocation pertaining to the City's group life insurance policy, said documentation to be completed by February 16, 2000." Carried. Councillor K. Taylor-Harrison entered the meeting at this time. NOTICE OF MOTION Councillor K. Taylor-Harrison gave notice that at the February 21, 2000 special Council meeting she would introduce a Motion to Reconsider Council's resolution of this date directing that no action be taken by the City to undertake a facade restoration of its property at 156-158 King Street West. Council was advised of an additional matter for in-camera discussion this date involving solicitor-client privilege. Ziegler Seconded by Councillor Jake Smola "That an in-camera meeting of City Council be held immediately following this special meeting to consider a personal matter, a labour relations matter and two matters subject to solicitor-client privilege." Carried. Moved by Councillor Jake Smola Seconded by Councillor John Smola "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and number 2000-24 by the Clerk." Carried. On motion, the meeting adjourned at 12:20 p.m. MAYOR CLERK
