HomeMy WebLinkAboutCouncil Minutes - 2000-05-29 SSPECIAL COUNCIL MINUTES MAY 29, 2000 CITY OF KITCHENER A special meeting of City Council was held at 10:50 a.m. this date and Chaired by Mayor C. Zehr with all members present. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council was in receipt of Legal Department report LEG-00-010 (J. Shivas) recommending the City consent to the leasing of 5 Washburn Drive. Moved by Councillor G. Lorentz Seconded by Councillor J. Ziegler "That the City consent to a lease from Ukcan II Inc. to Brambles Canada Inc. for a portion of the property described as Parts 6 & 21 on Reference Plan 58R-7426, municipally known as 5 Washburn Drive, Kitchener." Carried. Mayor C. Zehr advised of four additional matters for in-camera discussion this date, all involving solicitor-client privilege. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Ziegler "That an in-camera meeting of City Council be held immediately following this special meeting to consider a personal matter, a labour relations matter, two land acquisition matters, a litigation matter and eight matters subject to solicitor-client privilege." Carried. The meeting then recessed at 10:55 a.m. and re-convened at 3:40 p.m., Chaired by Mayor C. Zehr with all members present except Councillor C. Weylie. It is noted for the record, and pursuant to Section 25.8.9 of Chapter 25 (Council Procedure) of the Municipal Code, that Councillors B. Vrbanovic and J. Haalboom disclosed pecuniary interests at the in-camera meeting held this date in regard to separate items involving labour relations and solicitor- client privilege respectively. At the Planning and Economic Development Committee meeting held prior to this meeting, it was agreed to forward recommendations to this meeting for ratification pertaining to Zone Change Application ZC 00/15/TC/JG and an extension of time for the Mediator to report on the access to Raylene Drive matter. Moved by Councillor M. Yantzi Seconded by Councillor B. Vrbanovic That Zone Change Application ZC 00/15/TC/JG (City wide changes to Single Detached Residential and Duplex Regulations) be approved in accordance with the Proposed Revised By-law attached, dated May 19, 2000, without conditions. It is the opinion of this Committee that approval of this application is proper planning for the City and is in conformity with the City's Municipal Plan. That Council adopt the recommendations contained in "Kitchener's Residential Streetscapes Final Report" and direct the Department of Business and Planning Services to prepare a Design Brief based on these recommendations for incorporation in the City's Urban Design Manual approved by Council. That Council confirm its commitment to mixing lot sizes within subdivisions as set out in the Municipal Plan and direct the Department of Business and Planning Services to continue to include appropriate supportive policies in community plans and prepare implementing zoning by-laws for Plan of Subdivision respecting this objective where appropriate." Vrbanovic "That the revision to the proposed by-law respecting Zone Change Application ZC 00/15/TC/JG is considered to be minor and no further public notification is required." Moved by Councillor M. Yantzi Seconded by Councillor B. Vrbanovic Carried. "That Council's May 8, 2000 resolution respecting the existing access to Raylene Drive from 50 Westmount Road West be amended to grant an extension from June 5 to June 19, 2000 for the Mediator to report to City Council; and further, That affected parties be notified of this change in meeting date from June 5 to June 19, 2000 at which time Council will further consider this matter." Moved by Councillor T. Galloway Seconded by Councillor John Smola Carried. "That leave be given the Mover and Seconder to introduce the following by-laws for three readings and that the same be taken as read a first, second and third times, be finally passed and numbered serially by the Clerk. (By-law No. 2000-86) (a) Being a by-law to amend By-law 85-1, known as the Zoning By-law. (By-law No. 2000-87)." Carried. (b) To confirm all actions and proceedings of the Council.
