HomeMy WebLinkAboutCouncil Minutes - 2000-11-06 SSPECIAL COUNCIL MINUTES NOVEMBER 6, 2000 CITY OF KITCHENER A special meeting of City Council was held at 3:45 p.m. this date and Chaired by Mayor C. Zehr with the following members present: Councillors G. Lorentz, J. Ziegler, B. Vrbanovic, T. Galloway, John Smola and C. Weylie. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Moved by Councillor C. Weylie Seconded by Councillor J. Ziegler "That an in-camera meeting of City Council be held immediately following this special meeting to consider a litigation matter." Carried. The meeting then recessed at 3:46 p.m. and re-convened at 4:55 p.m. with all members present except Councillors J. Haalboom and M. Yantzi. Council then considered a recommendation arising from in-camera discussion this date concerning a final settlement in regard to the Ralgreen lawsuit. Mayor C. Zehr reviewed the recommendation before Council and advised that a news conference is planned following the meeting. Moved by Councillor G. Lorentz Seconded by Councillor J. Ziegler That the Mayor and Clerk be authorized to execute Minutes of Settlement dated November 6, 2000 and Addendum to Minutes of Settlement dated November 6, 2000 respecting Ontario Court (General Division) action no. 1717/97; and, That the City accept offers to sell 15 properties on Ralgreen Crescent from their owners, for the sum of $65,000 each, as follows: Non-Plaintiff Owners: 1. Offer dated October 2, 2000, from Patricia Louise Metzloff for 76 Ralgreen Crescent, being Lot 21, Registered Plan 1248; 2. Offer dated October 17, 2000, from Victor Randal Wong and Barbara Lilietha Wong for 68 Ralgreen Crescent, being Part Lot 24, Registered Plan 1248; 3. Offer dated October 4, 2000, from James Lawrence Harrison and Diane Harrison for 73 Ralgreen Crescent, being Lot 61, Registered Plan 1248; 4. Offer dated October 17, 2000, from Stanislaw Wrobel and Viola Clara Irene Wrobel for 77 Ralgreen Crescent, being Lot 63, Registered Plan 1248; Offer dated October 24 and November 1, 2000, from Dennis Edward Nafziger and The Estate of Mark Wayne Nafziger for 72 Ralgreen Crescent, being Lot 23, Registered Plan 1248; Plaintiff Owners: 1. Offer dated October 4, 2000, from John Robert Edge and Cindy Louise Edge for 65 Ralgreen Crescent, being Part Lot 59, Registered Plan 1248; 2. Offer dated October 24, 2000, from Frank John Engrich and Maria Engrich for 79 Ralgreen Crescent, being Lot 64, Registered Plan 1248; Offer dated October 24, 2000, from Geraldine Phyllis Kieswetter and Raymond Jerome Kieswetter for 70 Ralgreen Crescent, being Part Lot 24, Registered Plan 1248; 7. Offer dated October 30, 2000, from Bradley Yasui and Mary Wong Yasui (as consenting spouse) for 67 Ralgreen Crescent, being Part Lot 59, Registered Plan 1248; and, That the City confirm settlements with the non-Plaintiff owners as negotiated by its legal counsel, Giffen, Lee, and set out in correspondence dated October 17, 2000; and, That the Mayor and Clerk be authorized to execute any documents required by the City Solicitor to give effect to the Minutes of Settlement and Addendum to Minutes of Settlement; and, That the City's legal counsel, Giffen, Lee, be authorized to execute a Consent to Dismissal without costs of Ontario Court (General Division) action no. 1717/97; and further, That the City provide to all non-plaintiff owners of properties on Ralgreen Crescent, save for owners of properties being purchased by the City, grants in the sum of $4,500 per property for improvements to such properties on the same basis as specified in Section 10 of the Minutes of Settlement." Carried Unanimously. Moved by Councillor K. Taylor-Harrison Seconded by Councillor C. Weylie "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2000 -208 by the Clerk." Carried. On motion, the meeting adjourned at 5:00 p.m. MAYOR CLERK
