SUBJECT: HOUSEKEEPING AMENDMENT TO CHAPTER 711 —
OUTDOOR BURNING
RECOMMENDATION:
"That a by -law be enacted to implement a housekeeping amendment to City of Kitchener
Municipal Code Chapter 711 (Outdoor Burning) clarifying the definition of open air
burning; and further,
That the by -law be given first and second readings."
BACKGROUND:
On March 4, 2013, Council passed a by -law to repeal and replace Chapter 711 of The City of
Kitchener Municipal Code.
REPORT:
Minor errors in the open air burning definition in Chapter 711 have been identified. Therefore, a
housekeeping amendment to Chapter 711 is required. This amendment will not change the
intent of the by -law approved by Council.
The definition of open air burning is meant to exclude a) types of burning regulated elsewhere in
the by -law and b) types of burning not regulated at all by the by -law. The amended definition
will:
• use the defined terms within the by -law for "outdoor fireplace" and "outdoor fire pit"
instead of redefining these terms;
• exclude "outdoor appliances" because they are regulated elsewhere in the by -law; and
• no longer require appliances excluded from the open air burning definition to be for
outdoor use or installed in accordance with manufacturers' instructions. This is because
these requirements are enforced by Technical Standards and Safety Authority (TSSA)
rather than the City.
